In the draft Decree amending and supplementing a number of articles of Decree 171/2016 of the Government regulating the registration, deregistration and purchase, sale and construction of new ships (amended and supplemented by Decree No. 86/2020), the Ministry of Transport proposed to amend many regulations related to administrative procedures in the registration and deregistration of ships.
The draft Decree amending and supplementing Decree 171 on registration and deregistration of ships amends many regulations on administrative procedures to create more favorable and effective conditions in carrying out administrative procedures for individuals and businesses (Illustration photo).
Specifically, the draft proposes that in implementing administrative procedures for registering and deregistering ships, electronic copies issued from the original book or certified electronic copies from the original are accepted.
At the same time, add the form of submitting documents via the Online Public Service Portal and paying fees via the Online Public Service Portal. At the same time, remove the document components of CCCD and Identity Card for individual ship owners.
This is in line with the Government's policies and directions in the Project on developing applications of population data, identification and electronic authentication to serve national digital transformation in the 2022-2025 period, with a vision to 2030.
Thereby, creating more favorable and effective conditions in carrying out administrative procedures for individuals and businesses, reducing travel costs for people when carrying out administrative procedures on the Online Public Service Portal.
According to the Ministry of Transport, currently, administrative procedures for ship registration and deregistration have been provided with level 4 public services through the National Single Window Portal nationwide (according to new regulations, it is a full-process public service) integrated into the National Public Service Portal.
However, the requirements for the components of the dossier for registration and deregistration of ships and the forms of submission are not suitable for individuals and organizations to implement according to Level 4 Public Services.
The Vietnam Maritime Administration has also proactively reviewed legal documents in the maritime sector, reported to the Ministry of Transport to propose reducing the number of documents, replacing information fields to simplify administrative procedures, and not requiring people to re-declare information already available on the national population database.
In addition, after reviewing legal documents for amendment and supplementation according to the Law on Electronic Transactions 2023, the Vietnam Maritime Administration believes that the regulations on the Vietnam National Ship Registry need to be amended and supplemented accordingly.
The components of the application for registration and deregistration of ships, along with the forms of submitting administrative procedures, need to be revised to comply with the provisions of Decree No. 45/2020 on performing administrative procedures in the electronic environment.
Notably, in the application for approval of naming a ship or registering a ship for a limited period, or registering a ship under construction, the draft Decree proposes to remove the document component of the business registration certificate or enterprise registration certificate.
Currently, information related to business registration can be looked up by state agencies from the national database on businesses.
The draft also proposes amendments to the Vietnamese ship registration agency. Accordingly, in addition to the Vietnam Maritime Administration performing the functions of the Vietnamese ship registration agency, maritime sub-departments and maritime port authorities will perform the task of registering ships under the authorization of the Vietnam Maritime Administration.
