(BGDT) - The People's Committee of Bac Giang province has just issued Decision No. 21 on amending and supplementing a number of articles of the regulations issued together with Decision No. 10 dated May 21, 2019 of the People's Committee of Bac Giang province; Decision No. 70 dated December 14, 2021 of the People's Committee of Bac Giang province amending and supplementing a number of articles of the Regulations on land recovery, compensation, support, and resettlement when the State recovers land applicable in Bac Giang province.

Specifically, amend and supplement a number of articles of the Regulations on land recovery, compensation, support and resettlement when the State recovers land applicable in Bac Giang province, issued together with Decision No. 10 dated May 21, 2019 of the Provincial People's Committee. In particular, amend and supplement Point c, Clause 1, Article 5 with the content "The total compensation value at Point a, Point b of this Clause shall be prepared by the organization in charge of site clearance compensation and submitted to the District People's Committee for approval, not exceeding 100% of the new construction value of houses and constructions with technical standards equivalent to the damaged houses and constructions".
Amend and supplement Clause 3, Clause 4, Clause 5, Clause 6, Article 13 as follows: “3. The People's Committee at the commune level is responsible for determining agricultural land used for public purposes according to Clause 4, Article 132 of the Land Law. In case the land plot is not subject to the provisions of Clause 4, Article 132 of the Land Law, one of the following documents can be used for consideration:
Contracts or documents showing the content of leasing, contracting, and contracting between the People's Committee of the commune level; representatives of villages, hamlets, and residential areas; political and social organizations at the commune and hamlet levels with households and individuals and signed by representatives of such households and individuals.
In village and commune-level records established before July 1, 2004, there are names of households and individuals with the content of land allocation and lease; submission of products to implement the lease of agricultural land used for public purposes, confirmed by the collective Party Committee, leaders, Fatherland Front of the village, hamlet, residential area and the person who carried out the land allocation at that time (if still alive).
Documents established between the People's Committee of the commune or the leader of the village, hamlet, residential area and the household or individual before July 1, 2014 and confirmed by the representative of the household or individual currently using the land as agricultural land used for public purposes.
In case during the process of determining land type, if there is no consensus between the People's Committee at the commune level, the leaders of the village, hamlet, residential area and the households and individuals using the land, the People's Committee at the district level shall organize a conference to collect opinions from the people where the land is located as a basis for conclusion.
100% of the support money is paid into the state budget managed by the People's Committee at the commune level and can only be used for the purpose of investing in the construction of infrastructure works serving public purposes at the commune level.
In addition, the Decision also replaces and abolishes a number of phrases of the Regulations on land recovery, compensation, support and resettlement when the State recovers land applied in Bac Giang province, issued together with Decision No. 10 dated May 21, 2019 of the Provincial People's Committee and Decision No. 70 dated December 14, 2021 of the Provincial People's Committee. Amending and supplementing a number of articles of the Regulations on land recovery, compensation, support and resettlement when the State recovers land applied in Bac Giang province, issued together with Decision No. 10 dated May 21, 2019 of the Provincial People's Committee and Decision No. 40 dated August 20, 2021 of the Bac Giang Provincial People's Committee.
