Citizen identification card (CCCD) is an important identity document of a citizen. Vietnamese citizens are issued a CCCD card for the first time when they are 14 years of age or older.
According to Article 19 of the CCCD Law, Vietnamese citizens from 14 years old will be issued CCCD cards. After having an ID card and a barcode CCCD, citizens are required to change to a new chip-embedded CCCD card if they fall under the cases specified in Article 23 of the CCCD Law and Article 5 of Decree 05/1999/ND-CP.
According to Article 23 of the 2014 Citizen Identification Law, there are 8 cases where people using CCCDs with and without chips must apply for a new CCCD with chips, specifically:
- Cases requiring application for replacement of chip-embedded CCCD:
+ The CCCD card must be changed when the citizen is 25 years old, 40 years old and 60 years old.
+ The card is damaged and cannot be used.
+ Change information about last name, middle name, first name; identification characteristics.
+ Redefine gender and hometown.
+ There is an error in the information on the CCCD card.
+ When citizens request.
- Cases where re-issuance of chip-embedded CCCD is required:
+ Lost CCCD card;
+ Be able to regain Vietnamese nationality according to the provisions of the Law on Vietnamese Nationality.
According to Article 5 of Decree 05/1999/ND-CP, there are 6 cases where people must change from ID card to chip-embedded CCCD, including:
- The identity card (ID) expires 15 years from the date of issue.
- Damaged ID card cannot be used.
- Change last name, first name, middle name, date of birth.
- Change of permanent residence registration outside the province or centrally-run city.
- Change identification characteristics.
- Lost ID card.
Besides, in some cases, people who have chip-embedded ID cards are still fined for not complying with the law.
Specifically, according to Article 10 of Decree 144/2021/ND-CP:
1. Warning or fine from 300,000 VND to 500,000 VND for one of the following acts:
a) Failure to present Identity Card, Citizen Identification Card, CCCD Card or Identity Card Number Confirmation Certificate when requested for inspection by a competent authority;
b) Failure to comply with legal regulations on granting, changing, and re-granting CCCD cards;
c) Failure to return the Identity Card, Citizen Identification Card or CCCD card to the competent authority when the person is given up, has his/her nationality revoked, or has the decision to grant Vietnamese nationality revoked; failure to return the Identity Card, Citizen Identification Card or CCCD card to the agency executing the temporary detention order, the agency executing the prison sentence, the agency executing the decision to send him/her to a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.
2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for one of the following acts:
a) Appropriating or using another person's Identity Card, Citizen Identification Card, CCCD Card or Identity Card Number Confirmation Certificate;
b) Erasing, modifying or otherwise distorting the content of the Identity Card, Citizen Identification Card, CCCD Card or Identity Card Number Confirmation Certificate;
c) Destroying or intentionally damaging the Identity Card, Citizen Identification Card, CCCD Card or Identity Card Number Confirmation Certificate.
3. A fine of from VND 2,000,000 to VND 4,000,000 shall be imposed for one of the following acts:
a) Forging or using fake papers, documents, or data to obtain an Identity Card, Citizen Identification Card, CCCD Card, or Identity Card Number Confirmation Certificate;
b) Providing false information or documents to obtain an Identity Card, Citizen Identification Card, CCCD Card or Identity Card Number Confirmation Certificate.
4. A fine of from VND 4,000,000 to VND 6,000,000 shall be imposed for one of the following acts:
a) Forging identity cards, citizen identification cards, CCCD cards or identity card number confirmation papers but not being prosecuted;
b) Using fake ID cards, citizen identification cards or ID card number confirmation papers;
c) Mortgage, pledge, accept pledge of Identity Card, Citizen Identity Card or CCCD card;
d) Buying, selling, renting, leasing Identity cards, ID cards or CCCD cards;
d) Borrowing or lending an identity card, citizen identification card, or CCCD card to commit an act against the provisions of law.
In addition to the above-mentioned warnings and fines, violations related to the issuance, management and use of CCCD/ID cards are also subject to additional penalties and remedial measures as prescribed.
