(Dan Tri Newspaper) - The enactment of the Law on Fire Prevention and Rescue is essential to meet the urgent requirements of fire prevention and rescue, serving the country's innovation and development and the peaceful lives of its people.

Strengthen fire and explosion prevention and control, and search and rescue operations.

According to the Fire Prevention and Rescue Police Department, in response to the objective need to strengthen fire prevention and rescue work to protect production and the peaceful lives of the people, the Party, the National Assembly , and the State have issued directives on the need to codify regulations on fire prevention and rescue to meet the practical requirements.

Furthermore, the Party's 13th National Congress documents identify the need to strengthen fire and explosion prevention and control, and search and rescue operations; to respond promptly and effectively to non-traditional security threats, especially in search and rescue, disaster prevention and control, and disease control; and to effectively implement social policies, ensuring social security and human security.

Authorities stated that the inclusion of search and rescue duties in the law is intended to protect human rights and civil rights as stipulated in the 2013 Constitution.

In fact, the fire prevention and rescue police force is still carrying out tasks related to state management of rescue and is the core, permanent force in this work.

Furthermore, the fire prevention and rescue police force possesses all the necessary professional qualifications, personnel, and equipment to carry out rescue missions. However, currently, only fire prevention and control activities are regulated in the Law on Fire Prevention and Control; rescue activities are only regulated in Decree No. 83/2017/ND-CP dated July 18, 2017, which stipulates the rescue and relief work of the fire prevention and control force. This lack of uniformity and consistency in the legal system, inconsistency with the 2013 Constitution, and failure to provide a legal basis for the fire prevention and rescue police force to perform its duties.

According to the Fire Prevention and Rescue Police Department, based on the experience of many countries around the world such as Japan, South Korea, Russia, the United States, Germany, France, Thailand, Singapore, Malaysia, etc., they all assign rescue tasks to specialized fire prevention and rescue forces as the core responsibility.

In addition, the coordinated participation of other local forces has yielded highly effective results in rescue operations when incidents or emergencies occur.

"Therefore, the promulgation of the Law on Fire Prevention and Rescue will overcome the limitations, obstacles, and inadequacies of the current law and meet the objective practical requirements mentioned above," the Fire Prevention and Rescue Police Department informed.

Purpose and perspectives when drafting the Law on Fire Prevention and Rescue.

According to the Fire Prevention and Rescue Police Department, there are three purposes in drafting the Law on Fire Prevention and Rescue. Firstly, it aims to institutionalize the Party's views and policies on strengthening and improving the effectiveness and efficiency of state management in fire prevention and control; and to concretize and create a legal basis to ensure the implementation of the provisions of the 2013 Constitution on human rights and citizens' rights.

Secondly, it aims to meet the practical requirements of ensuring security and order; protecting human lives and health, and the property of the state, agencies, organizations, and individuals; and creating a safe environment to serve economic , cultural, and social development and international integration.

Thirdly, it is necessary to create a complete legal basis for fire prevention and rescue activities; ensure consistency and uniformity in the legal system; overcome limitations, obstacles, and inadequacies of current laws and supplement regulations to meet practical requirements in the new situation.

Furthermore, there are three perspectives when drafting the Law on Fire Prevention and Rescue. Firstly, it is to comply with the Constitution, ensuring consistency and uniformity within the legal system; and secondly, to ensure that the law's provisions are specific and feasible.

Secondly, it is necessary to fully and comprehensively summarize the practical implementation of laws on fire prevention and rescue; inheriting regulations that are still relevant, overcoming limitations, obstacles, and inadequacies, and supplementing new regulations to improve the effectiveness of fire prevention and rescue work.

Thirdly, we will selectively refer to the laws of several countries regarding fire prevention and rescue to apply regulations that are appropriate to the practical conditions in Vietnam.
