The Ministry of Home Affairs is seeking comments on the draft Proposal, the draft Law on Cadres and Civil Servants (amended). In which, the Ministry of Home Affairs will remove regulations on civil servant ranks and instead manage civil servants according to job positions.
This is a step forward in public administration reform to build a team of professional, effective, efficient and productive civil servants.
According to the Ministry of Home Affairs, Article 5 of the Law on Cadres and Civil Servants stipulates that the principle of cadre and civil servant management is a combination of title standards, job positions and staffing quotas; the use, assessment and classification of the quality of cadres and civil servants must be based on political qualities, ethics and capacity to perform public duties, which is not entirely based on job positions.
The concept of job position in the Law on Cadres and Civil Servants is a job associated with a title, position, structure and civil servant rank to determine the payroll and arrange and use civil servants. The Ministry of Home Affairs assessed that these regulations lead to the implementation of determining and describing job positions that overlap with civil servant rank standards (standards applied generally to agencies and organizations in the same industry and field, with unclear requirements for results and work products).
The management of civil servants by rank and level is causing many problems in practice, not meeting the requirements of streamlining the payroll and restructuring and improving the quality of civil servants according to job positions according to the current policies of the Party and State.
Therefore, in the latest draft of the revised Law on Cadres and Civil Servants, the Ministry of Home Affairs has completely removed regulations on civil servant ranks. Instead, the draft has included new content on arranging civil servants according to job positions.
The proposed contents to be removed include: Civil servant ranks and appointment to civil servant ranks; transfer of civil servant ranks; promotion of civil servant ranks; organization of civil servant rank promotion exams; contents related to civil servant ranks in the current Law on Cadres and Civil Servants.
The drafting agency believes that innovation in the management of cadres and civil servants according to job positions will play a very important role in building a team of professional, effective, efficient and productive cadres and civil servants, and innovating the thinking of managing cadres and civil servants according to job positions, instead of ranks and grades.
The Ministry of Home Affairs proposes to add a separate chapter on job positions, in which the concept of job position is revised as the position, title, and work of a cadre or civil servant associated with the functions, tasks, and structure of the agency, organization, or unit; at the same time, remove the content "associated with the structure and civil servant rank" and "to determine the payroll" to overcome the overlap between management by job position and management by civil servant rank; not to serve as a basis for units to increase payroll.
To manage civil servants according to job positions, the Ministry of Home Affairs supplements regulations on classification, job position content; basis for determining job positions; job position system; placement of civil servants when changing job positions and contents of recruitment, evaluation, training, and fostering of civil servants...
The principle of determining job positions must be consistent with the organizational structure and operations of agencies, organizations and units with similar functions and tasks; ensure scientific, objective, public, transparent, democratic and consistent with reality; ensure consistency and synchronization in the recruitment, arrangement, use and management of cadres and civil servants according to job positions.
The system of civil servant job positions is ranked according to the standards of positions, titles, job descriptions and organizational structures of agencies, organizations and units, in accordance with the organizations of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front and socio-political organizations at the central, provincial and communal levels.
