On December 18, the Steering Committee on summarizing the implementation of Resolution No. 18 of the Government (Steering Committee) issued Official Dispatch No. 24 to the Provincial and Municipal Party Committees directly under the Central Government on orientation and suggestions on some contents on the organization of specialized agencies under the People's Committees at the provincial and district levels.

Notably, the Steering Committee requires ensuring that the total number of departments under the provincial People's Committee does not exceed 14. Hanoi and Ho Chi Minh City alone do not exceed 15 departments.

Maintain 3 offices, arrange internal apparatus

According to the direction of the Steering Committee, the specialized agencies under the provincial People's Committee maintain 3 departments including: Department of Justice; Department of Culture, Sports and Tourism (or Department of Culture and Sports for localities maintaining the Department of Tourism); Provincial Inspectorate; Office of the provincial People's Committee.

Merge the Department of Planning and Investment with the Department of Finance, expected to become the Department of Economics and Finance, receiving the original functions and tasks of the two departments.

Merge the Department of Transport with the Department of Construction, expected to become the Department of Construction and Transport, receiving the original functions and tasks of the two departments.

Merge the Department of Natural Resources and Environment with the Department of Agriculture and Rural Development, expected to become the Department of Agriculture and Environment, receiving the original functions and tasks of the two departments.

Merge the Department of Information and Communications with the Department of Science and Technology, expected to become the Department of Science, Technology and Communications, receiving the original functions and tasks of the two departments.

Merge the Department of Labor, War Invalids and Social Affairs with the Department of Home Affairs, expected to become the Department of Home Affairs and Labor. The new Department will perform the function of advising and assisting the provincial People's Committee in State management of the field of home affairs and take over the functions and tasks of labor, wages, employment, meritorious people, occupational safety and hygiene, social insurance, and gender equality.

In addition, the Steering Committee also oriented and suggested the arrangement and transfer of tasks with 3 other departments corresponding to the arrangement of Ministries at the Central level.

Specifically, the Department of Health will take over the functions, tasks and organization of the staff on social protection, children and social evil prevention; and management and use of the child protection fund from the Department of Labor, War Invalids and Social Affairs. The Department of Health will also take over the monitoring and management of the health of provincial officials (after the end of the operation of the Provincial Health Care Protection Board).

The Department of Education and Training takes over the functions, tasks and organization of the vocational education advisory apparatus from the Department of Labor, War Invalids and Social Affairs.

The Department of Industry and Trade received the original status of the Local Market Management Department from the Ministry of Industry and Trade and reorganized it into the Market Management Department under the Department of Industry and Trade.

Arrange with specific units

The Steering Committee also oriented the arrangement of some specific departments of Ho Chi Minh City, Hanoi and some localities such as the Department of Foreign Affairs, Department of Planning and Architecture, Ethnic Affairs Department, Department of Tourism, Department of Food Safety.

Accordingly, the Department of Foreign Affairs will merge into the Provincial People's Committee Office or maintain, consolidate, arrange, and streamline the internal organization of this Department, ensuring improved effectiveness and efficiency of operations.

Some localities with Department of Planning and Architecture will merge this Department into the Department of Construction and Transport. In case there are special requirements for State management of the transport sector in the area such as Hanoi and Ho Chi Minh City, it is possible to consider and decide to maintain the Department of Transport and implement the plan to merge the Department of Planning and Architecture into the Department of Construction, ensuring that it is suitable for the situation and characteristics in Hanoi and Ho Chi Minh City.

For localities that currently have an Ethnic Committee, the arrangement will be similar to the Ethnic Committee - Religion (at the Central level) in the direction of changing the name to the Ethnic Committee - Religion; receiving the functions, tasks and organization of the state management advisory apparatus on religion from the Department of Home Affairs; the task of poverty reduction from the Department of Labor - Invalids and Social Affairs.

For localities that do not establish an Ethnic Committee (even if they meet all criteria), they will proactively decide to transfer the advisory function on ethnic affairs from the Provincial People's Committee Office to the Department of Home Affairs - Labor (after consolidation) to unify the focal point for advising on state management of ethnic and religious affairs and implementing poverty reduction tasks.

For localities that currently have a Department of Tourism, based on the situation and characteristics of the locality, proactively decide on a plan to merge with the Department of Culture and Sports to form the Department of Culture, Sports and Tourism or maintain, consolidate, arrange, and streamline the internal organization of this Department, ensuring improved effectiveness and efficiency of operations.

As for the Department of Food Safety, if it is not maintained, the functions, tasks, and organization of the state management advisory apparatus on food safety will be transferred to the Department of Health; specialized food safety management tasks will be transferred to the Departments of Health; Industry and Trade; Agriculture and Environment.

At the district level, the Steering Committee guides and suggests the structure, arrangement and reorganization of specialized departments similar to the arrangement of Ministries at the Central level and Departments and branches at the provincial level.

Localities complete arrangements before February 20, 2025

The Steering Committee requested that hamlet committees and party organizations lead and direct local agencies and units to develop a project to reorganize and streamline the apparatus in accordance with the direction of the Central Committee, the Politburo, the Central Steering Committee and the orientation and suggestions of the Government Steering Committee.

At the same time, it is necessary to carefully prepare personnel plans, policies, headquarters, finance, assets, equipment, seals and other conditions to ensure implementation immediately after the Central and National Assembly approve (it is expected that the Central and National Assembly will meet in February 2025).

The People's Committees of provinces and centrally-run cities assign the Department of Home Affairs to preside over and coordinate with the Departments, Boards and branches to develop a Project on reorganizing specialized agencies under the Provincial People's Committees, submit it to competent authorities for consideration and decision; advise and submit to the Provincial People's Committees to issue documents guiding the District People's Committees on reorganizing specialized agencies under the District People's Committees.

" Localities must complete the arrangement and organization of specialized agencies under the People's Committees at the provincial and district levels, ensuring synchronization with the completion of the arrangement and streamlining of the Government's organization (expected to be completed before February 20, 2025 and report the results to the Ministry of Home Affairs before February 28, 2025) ," the dispatch stated.

From now until the implementation of the reorganization of specialized agencies of the People's Committees at provincial and district levels, the Ministry of Home Affairs will base on the direction of the Central Steering Committee and the Government Steering Committee to continue to guide and ensure that the reorganization of the State administrative apparatus is synchronous, unified and suitable to practical requirements in the new situation.
