The Ministry of Transport is conducting a comprehensive review and assessment of all BOT (Build-Operate-Transfer) transport projects.

The Government Office issued Notice No. 190/TB-VPCP dated May 3, 2024, summarizing the conclusions of Deputy Prime Minister Tran Hong Ha regarding solutions to address difficulties and obstacles in some infrastructure investment projects under the BOT contract form.

The announcement stated: The Government submitted to the National Assembly a proposal on solutions to address difficulties and obstacles in some BOT (Build-Operate-Transfer) infrastructure investment projects in Submission No. 402/TTr-CP dated October 11, 2022, and received guidance from the Standing Committee of the National Assembly in Notice No. 1843/TB-TTKQH dated November 28, 2022, from the Secretary General of the National Assembly. Government leaders provided detailed and specific guidance on the content and progress in Document No. 8352/VPCP-CN dated December 13, 2022, and Notice No. 428/TB-VPCP dated October 20, 2023. Although the Ministry of Transport has made efforts to implement the plan, the quality and progress of the Ministry's preparation of the dossier have not met the requirements of the Government leaders.

Deputy Prime Minister Tran Hong Ha requested the Ministry of Transport to be responsible for reviewing and fully implementing the directives of the National Assembly Standing Committee and the Government leaders in the aforementioned documents; to study and incorporate the opinions of relevant agencies (in writing and through speeches at meetings) to finalize the dossier (Project) to be submitted to the Politburo for comments.

The Deputy Prime Minister noted that the Ministry of Transport needs to continue to comprehensively review and evaluate all BOT transport projects, including those managed by the Ministry of Transport and those managed by localities; thoroughly review the subjective and objective causes, shortcomings due to changes in state policies, and the responsibilities of relevant agencies; resolutely refrain from proposing sanctions for projects due to subjective reasons on the part of the enterprise or investor (the enterprise or investor must bear full responsibility according to the signed contract); and fully and thoroughly assess the negative impacts of implementing proposed mechanisms and policies to report to competent authorities for consideration and decision.

At the same time, the report should specifically detail the work that the Ministry of Transport, other Ministries, the Prime Minister, and the Government have undertaken within their authority but have yet to resolve the difficulties and obstacles of BOT transport projects; clearly identify the issues beyond the Government's authority that need to be reported to higher authorities for consideration and decision (clearly stating the issues for which the Politburo's opinion is being sought).

The Deputy Prime Minister requested that the Ministries and agencies of Finance, Planning and Investment, Justice, the Government Inspectorate, and the State Bank of Vietnam be responsible for closely coordinating with the Ministry of Transport in the process of finalizing the dossier; and providing feedback within the deadline when the Ministry of Transport requests comments.

Regarding the progress and submission of documents, the Deputy Prime Minister requested the Ministry of Transport to urgently implement the above-mentioned contents, complete the dossier (in accordance with the regulations of the Working Regulations of the 13th Central Committee of the Communist Party of Vietnam and the Working Regulations of the Government); proactively seek opinions from relevant ministries and agencies (Ministry of Justice, Ministry of Planning and Investment, Ministry of Finance, Ministry of Public Security, Government Inspectorate, State Bank of Vietnam) and agencies of the Party and the National Assembly, and fully incorporate and explain the feedback before submitting it to the Standing Committee of the Government in accordance with the Working Regulations of the Government.

The Ministry of Transport reported to the Party Committee of the Ministry of Transport that it had sent a document to the Central Party Office to report and seek the Politburo's opinion on allowing the report to be submitted in early May 2024; and to finalize the report dossier for submission to the National Assembly at the 7th session (a document was sent to the National Assembly Office to report to the Standing Committee of the National Assembly for permission to submit the dossier before May 20, 2024).
