On the morning of September 20, at the National Assembly House, continuing the 26th Session, the National Assembly Standing Committee gave opinions on the draft Law on the Capital (amended).
During the preliminary review of the draft Law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung stated that the Standing Committee of the Law Committee and the agencies participating in the review all agreed with the necessity of promulgating the Law on the Capital (amended), in order to promptly institutionalize the viewpoints and orientations for the development of the capital city of Hanoi set out in the resolutions of the Politburo, create a breakthrough mechanism, mobilize all resources, effectively exploit the potentials and strengths of the capital, and help the capital continue to develop rapidly and sustainably.

At the same time, the Standing Committee of the Law Committee assessed that the draft Law on the Capital (amended) was prepared by the Government very carefully, seriously, and with high quality, including all documents as prescribed in Clause 1, Article 64 of the Law on Promulgation of Legal Documents, and is qualified to be submitted to the Standing Committee of the National Assembly for consideration and comments before submitting to the National Assembly.
Chairman of the Law Committee Hoang Thanh Tung emphasized that the draft Law on the Capital (amended) has relatively fully and comprehensively reflected the 9 groups of policies that the Government submitted to the National Assembly when proposing to develop the Law; the draft Law has many breakthrough and specific contents, many contents showing inheritance, supplementation and development compared to the current Law on the Capital, which through practical summary, can be seen to continue to promote its value.

Regarding the organization of the government in the capital, Chairman of the Law Committee Hoang Thanh Tung said that it is necessary to strengthen and enhance the capacity of the Hanoi People's Council through increasing the number of People's Council delegates; increasing the number of full-time People's Council delegates and increasing the number of Vice Chairmen of the People's Council, ensuring the ability to undertake additional tasks and powers delegated by law and in accordance with the requirements of the organization of urban government. However, this is an important issue related to the implementation of resolutions and conclusions of the Central Committee and the Politburo, so it needs to be reported to competent authorities for consideration and decision before being stipulated in the draft Law to be submitted to the National Assembly for consideration and approval.
Regarding urban planning and management, the Standing Committee of the Law Committee basically agrees with the provisions of the draft Law. However, to ensure feasibility and avoid overlaps and conflicts with other relevant legal provisions, Chairman of the Law Committee Hoang Thanh Tung suggested that the drafting agency pay attention to some contents such as: There should be solutions to improve the effectiveness and efficiency of state management of planning in the area; supplement regulations on capital sources for planning and selection of consulting units in planning work; specify the principles of management and use of underground space, ensuring requirements on national defense and security, associated with civil defense work...

Regarding financial, budgetary and resource mobilization policies for the capital's development, Chairman of the Law Committee Hoang Thanh Tung suggested that the drafting agency continue to review and specify some contents to ensure feasibility. For example: Determining the total outstanding loan balance not to exceed 120% of the budget revenue that Hanoi City is entitled to according to decentralization (Clause 4, Article 35 of the draft Law); researching to have regulations suitable to the actual conditions of Hanoi in urban development according to the orientation of public transport (TOD) (Article 39 of the draft Law), implementing a controlled pilot model (Article 41) and managing public assets (Article 42); preferential tax policies, preferential policies for strategic investors (Article 45)...
Chairman of the Law Committee Hoang Thanh Tung also said that the Standing Committee of the Law Committee agreed that it is necessary to have regulations on the mechanism for linking and developing the Capital region in the draft Law, but the content and connotation of regional linking need to be further studied and clarified to ensure practicality, feasibility, and to handle current difficulties and shortcomings.
