The time limit for resolving complaints is no more than 180 days.
Standing member of the Secretariat Luong Cuong has just signed, on behalf of the Politburo, Decision No. 164 on the Procedure for handling denunciations against Party organizations directly under the Central Committee and Party members who are cadres under the Central Committee's management.
This process consists of 3 steps: preparation step; implementation step and completion step.

The first step in the preparation step is to establish a complaint handling team and develop a complaint handling plan.
Accordingly, the Central Inspection Commission (or the advisory and support agency of the Politburo and the Secretariat assigned by the Standing Secretariat) will work with the whistleblower to clearly identify the identity and address of the whistleblower; the party organization, the party member being denounced and the content of the denunciation.
The Politburo and the Secretariat will issue a decision to establish a delegation and a plan to handle the denunciation; based on the nature and content of the denunciation, they will decide on the head of the delegation, composition, and number of members of the inspection delegation as appropriate.
The Politburo stated that the plan to resolve denunciations must clearly define the purpose, requirements, content, subjects, timeline, methods, and implementation time... The time limit for resolving denunciations shall not exceed 180 days from the date of issuance of the decision to establish the inspection team. If necessary, a decision may be made to extend the time limit for resolution, but not more than 60 days.
After being established, the Inspection Team will study the complaint, develop an outline to request the accused Party organization and Party member to report and explain; plan the working schedule of the Inspection Team; and prepare relevant documents and materials.
In step 2 - the implementation step, the Inspection Team implements the decision and plan to resolve the complaint, agrees on the working schedule with the Party organization, the accused Party member and the representative of the Party organization managing the Party member.
The inspection team will also request the accused Party organization and Party member to prepare a report according to the outline. The accused Party organization and Party member will prepare a written explanation report and related records and documents to send to the Politburo and the Secretariat (via the inspection team).
Whistleblower Protection
During the investigation and verification stage, the Inspection Team will study the reports, records, documents and evidence received; conduct investigation, verification and work with the whistleblower, relevant organizations and individuals. During the investigation and verification process, the Inspection Team will meet and work directly with the whistleblower (if necessary) and implement measures to protect the whistleblower according to regulations.
Next, the Inspection Team drafts a report on the results of handling the complaint.
In cases where the violation is clear and requires disciplinary action, and the Party organization or accused Party member voluntarily reviews and accepts a disciplinary measure commensurate with the violation, the Head of the Inspection Team shall report to the Standing Secretariat to combine the disciplinary enforcement process with the complaint settlement process (dual process).
During the inspection and verification, if the party organization or party member accused of other violations is discovered, the Head of the Delegation shall report to the Politburo and the Secretariat for consideration and decision to transfer to inspection when there are signs of violations or assign the Central Inspection Commission to inspect when there are signs of violations; include the conclusion of the content of the accusation in the inspection results report when there are signs of violations for consideration and general conclusion; and at the same time, prepare a file to conclude the handling of the accusation.
Next, the Inspection Team held a conference to approve the report on the results of handling the complaint.
In the final step, the Politburo and Secretariat conference will review and conclude (if it is within the Central Committee's authority, the Inspection Team will report to the Politburo for direction before submitting to the Central Committee).
At this conference, the Inspection Delegation reported the results of handling the denunciation; fully presented the opinions of the Party organization, the accused Party member and the denouncer, and related Party organizations and Party members.
The conference discusses and concludes before voting to decide on disciplinary measures or proposes to competent authorities to discipline violating Party organizations and Party members (if implementing the dual process).
The inspection team then completes the notice of conclusion on handling the complaint, disciplinary decision or report to the competent authority to implement discipline and submit it to the Standing Secretariat for signing and promulgation.
