The electronic voting results showed that 446/455 National Assembly deputies participated in the vote in favor, accounting for 93.11% of the total number of National Assembly deputies. Thus, the National Assembly officially passed the Law amending and supplementing a number of articles of the Law on Health Insurance with a high approval rate.
Previously, Member of the National Assembly Standing Committee, Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh presented a report explaining, accepting and revising the draft Law amending and supplementing a number of articles of the Law on Health Insurance.
Ms. Nguyen Thuy Anh said that in the process of receiving and revising, the National Assembly Standing Committee has directed the dissemination and implementation of the policy of innovative thinking in law-making, ensuring that regulations are clear, substantive, concise, easy to understand, easy to implement, and closely following reality; strengthening decentralization and delegation of authority in conjunction with the tasks and powers of agencies, organizations, and individuals to improve enforcement capacity; simplifying administrative procedures; only prescribing contents within the authority of the National Assembly; assigning the Government and ministries to prescribe contents within their authority to promptly amend and supplement when necessary.
The revised draft law consists of 3 articles. Article 1 amends and supplements 42 articles of the current Law on Health Insurance (including 3 new clauses in 2 articles) and adds 2 new articles; Article 2 abolishes 1 clause of the Law on Forces Participating in Protecting Security and Order at the Grassroots Level No. 30/2023/QH15; Article 3 on the effective date.
Compared with the current law, the draft law has 8 basic new groups of points:
1. Amend and update the subjects of participation, responsibility for paying health insurance, payment method, payment period, responsibility for making a list of health insurance payment, and card validity period to be more consistent and synchronized with the provisions of the Law on Social Insurance and other relevant laws.
2. Regulations on medical examination and treatment under health insurance, including initial registration for medical examination and treatment under health insurance, transferring patients between medical examination and treatment facilities under health insurance according to the technical expertise level of the Law on Medical Examination and Treatment 2023.
3. Regulate the level of health insurance benefits when implementing the universal health insurance examination and treatment in the direction of not distinguishing administrative boundaries, maintaining the rate of health insurance benefits according to the provisions of current law and expanding to some cases; including some cases of rare diseases, serious diseases... that are sent directly to specialized medical examination and treatment facilities; expand some scope of benefits for people with health insurance cards, including treatment of strabismus and refractive errors of the eyes for people under 18 years old; regulate cases of chronic diseases to be transferred to grassroots health care for management in some cases to promote the role of grassroots health care.
4. Adjust the ratio of expenditures for medical examination and treatment under health insurance, reserve expenditures and organization of health insurance activities from health insurance premiums; clearly stipulate the deadline for notification of the results of medical examination and treatment cost appraisal to overcome the problem of extending the payment and settlement time.
5. Supplement the payment mechanism for drugs and medical equipment transferred between medical examination and treatment facilities and payment for paraclinical service costs transferred to other facilities in case of shortage of drugs and medical equipment.
6. Supplement specific regulations on late payment and evasion of health insurance payment and measures to handle these cases.
7. Regulations on the responsibility of the Ministry of Health in reviewing and regularly updating treatment regimens to ensure convenience in medical examination, treatment and health insurance payment; regulations on assessing the reasonableness of providing medical examination and treatment services covered by health insurance; regulations on the application of information technology, digital transformation, data sharing in the field of health insurance, the interconnection and use of paraclinical results between medical examination and treatment facilities in accordance with professional requirements and providing solutions to enhance the capacity of medical examination and treatment covered by health insurance for grassroots health care; promulgate principles and criteria for developing a list of drugs, medical equipment, and medical services covered by health insurance to ensure standardization, transparency, and publicity.
8. Supplement regulations on issuing electronic health insurance cards, regulations on state audit to audit the annual report on settlement of health insurance organization and activities of social insurance agencies to synchronize with the Law on Social Insurance.
