On May 30, the National Assembly will divide into groups to discuss the draft Resolution on taking a vote of confidence and a vote of no confidence for people holding positions elected or approved by the National Assembly or People's Council (amended).
In the latest draft Resolution submitted to the National Assembly, the Standing Committee added the content "not to take a vote of confidence for people with serious illnesses who have been off work for 6 months or more", after summarizing the practice of taking votes of confidence and comments from many agencies.
The Law Committee (the examining body) agreed with this proposal because it "has a practical basis, demonstrates humanity and is consistent with the requirements of a vote of confidence". However, the Committee believes that it is necessary to clearly state that the period of non-executive work is "from 6 consecutive months or more" to ensure strictness.
The Committee also requested the drafting agency to explain more clearly why the draft does not include a number of positions elected or approved by the National Assembly or People's Council in the vote of confidence, such as Supreme People's Court Judges, members of the National Defense and Security Council, deputy heads of People's Councils, and People's Court Jurors.

A member of the inspection body said that the purpose of taking a vote of confidence is to help officials see their level of confidence in order to self-examine and self-correct. Therefore, the drafting committee needs to design regulations in the direction that "in the case where 2/3 or more of the total number of delegates rate their confidence as low, there should be a mechanism for them to proactively resign".
In case of non-resignation, the competent authority or person shall submit to the National Assembly or People's Council for consideration of dismissal or approval of the proposal for dismissal of that person. Such a provision ensures compliance with the spirit of Regulation No. 96 and the provisions of the Law on Organization of the National Assembly and the Law on Organization of Local Government.
Proposal to dismiss a person with 2/3 of delegates voting no confidence
According to Article 13 of the draft Resolution, cases where a vote of confidence is brought up at the National Assembly or People's Council are usually due to the discovery of signs of wrongdoing or through a vote of confidence showing that the person has a low level of confidence. However, the draft only stipulates that the most serious consequence is to submit to the National Assembly or People's Council for a decision on dismissal or approval of a proposal for dismissal.
The Law Committee believes that the vote of confidence should be considered a step in the process of considering discipline for officials who hold positions elected or approved by the National Assembly or People's Council. In cases where a person subject to a vote of confidence is rated as having no confidence by more than half of the total number of delegates, a more severe form of handling should be applied, that is, the National Assembly or People's Council shall dismiss or approve a proposal for dismissal.
According to the working program, on May 30, the National Assembly also listened to the report explaining, accepting and revising the draft Law on Electronic Transactions (amended) and discussed some contents with different opinions. The National Assembly then discussed in the hall the decision on the investment policy of the traffic project from National Highway 27C to Provincial Road DT.656 in Khanh Hoa province - connecting with Lam Dong and Ninh Thuan; the adjustment of the investment policy of the Ka Pet Reservoir Project, Ham Thuan Nam district, Binh Thuan province.
The draft resolution on the vote of confidence and the vote of no confidence for people holding positions elected or approved by the National Assembly or People's Council (amended) will be discussed by the National Assembly on June 9 and voted on June 23. It is expected that the 15th National Assembly will take a vote of no confidence for people holding positions elected or approved by the National Assembly at the sixth session, opening in October 2023.
