It is expected that in the morning, National Assembly deputies will hold a plenary session in the hall to listen to the Report on explanation, acceptance, and revision of the draft Law on Electronic Transactions (amended) and discuss this content.
After that, the National Assembly discussed the Decision on investment policy for the Road Project from National Highway 27C to Provincial Road DT.656 in Khanh Hoa Province - connecting with Lam Dong and Ninh Thuan; Adjustment of investment policy for the Ka Pet Reservoir Project, Ham Thuan Nam District, Binh Thuan Province.
In the afternoon, the National Assembly listened to the Presentation and Report on the examination of the draft Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils (amended).
Then, the National Assembly discussed in groups the Draft Resolution on taking a vote of confidence, a vote of no confidence for people holding positions elected or approved by the National Assembly and People's Councils (amended); the Draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City.
The draft Law on Electronic Transactions (amended) consisting of 8 chapters and 54 articles will continue to be commented on and considered for approval by the National Assembly at this 5th Session.
Previously, on May 10, at the 6th Plenary Session with the reception, explanation and completion of the draft Law on Electronic Transactions (amended).
On behalf of the agency reviewing the draft Law, Deputy Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan said that the draft Law has been sent for comments to 63 delegations of the National Assembly, the Council of Nationalities, Committees, the Vietnam Fatherland Front, and the Vietnam Federation of Commerce and Industry.
As of May 10, the Standing Committee of the Science, Technology and Environment Committee has received 50 Reports with comments on the draft Law, including opinions from 42 delegations of the National Assembly, the Council of Nationalities, 06 Committees and the Central Committee of the Vietnam Fatherland Front.
The Science, Technology and Innovation Subcommittee is continuing to synthesize the opinions of the National Assembly delegations and study, absorb and revise the draft Law. Up to now, the draft Law has amended and supplemented 33 Articles on content; amended and supplemented 9 Articles on technology; restructured 1 chapter and removed some provisions in 5 Articles and removed 3 Articles and added 2 Articles.
Regarding the issuance of the National Assembly Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly or People's Council , the National Assembly Standing Committee has just sent a Submission to the National Assembly deputies.
This resolution will replace Resolution No. 85/2014/QH13 (applied to the vote of confidence in the previous term of the National Assembly) to promptly implement the vote of confidence for people holding positions elected or approved by the National Assembly and People's Councils at the 6th session of the 15th National Assembly and the end-of-year 2023 session of People's Councils at all levels.
In the submission, the National Assembly Standing Committee asked for the National Assembly's opinion on adding cases where a vote of confidence is not required.
Specifically, through summarizing the practice of taking a vote of confidence and comments from many agencies, the majority of opinions of the National Assembly Standing Committee agreed that it is necessary to add to Clause 5, Article 2 of the draft Resolution the regulation on not taking a vote of confidence for people who are on leave for treatment of serious illnesses with confirmation from a medical facility and have not been in charge of work for 6 months or more according to the decision of a competent agency or individual up to the time of opening the session to take a vote of confidence.
Regarding the subjects of the vote, in addition to the above-mentioned content of asking for opinions, the draft resolution also adds cases where a vote of confidence is not taken for those who have announced their resignation pending retirement, announced their retirement or were appointed or elected in the year of the vote of confidence to comply with Regulation No. 96-QD/TW and the practice of taking a vote of confidence in the past.
Regarding the basis for assessing the level of trust for the person who is given a vote of confidence (Article 6), the submission clearly states that Resolution No. 85/2014/QH13 only sets out 2 criteria including: Political qualities, ethics, lifestyle; compliance with the Constitution and laws; Results of performing assigned tasks and powers.
Based on Regulation No. 96-QD/TW, Law on Cadres and Civil Servants, the draft Resolution has detailed the content of evaluation criteria suitable for the subjects eligible for votes of confidence at the National Assembly and People's Councils.
At the same time, supplement the content of the responsibilities of the person being voted for in implementing resolutions and conclusions on the supervision work of the National Assembly, agencies of the National Assembly, the People's Council, and Committees of the People's Council; results of handling complaints and denunciations in the field and scope of responsibility; respecting, listening to and studying to resolve opinions and recommendations of voters and people; results of implementing commitments and promises (if any).
One of the new points in the voting process is the addition of the authority of the National Assembly Standing Committee and the People's Council Standing Committee to decide on the list of people to be voted on for confidence and the addition of a regulation on the time limit of 45 days to send a document requesting the person to be voted on for confidence to send a Report and Declaration of Assets and Income to the National Assembly Standing Committee and the People's Council Standing Committee.
Regulations on the meeting to take a vote of confidence and vote of confidence can only be conducted when at least two-thirds of the total number of National Assembly deputies and People's Council deputies attend have also been added.
In addition, the regulations on the consequences of taking a vote of confidence to institutionalize Regulation No. 96-QD/TW were also amended.
Accordingly, if a person who is subject to a vote of confidence is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies, he/she must resign. In case he/she does not resign, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council is responsible for submitting to the National Assembly or People's Council for a vote of confidence at that session or the nearest session.
If a person subject to a vote of confidence is rated as "low confidence" by two-thirds or more of the total number of National Assembly deputies or People's Council deputies, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council shall be responsible for submitting to the National Assembly or People's Council for dismissal at that session or the nearest session.
The draft also adds provisions on the consequences of taking a vote of confidence and a vote of no confidence for people who hold multiple positions at the same time; the vote of confidence and dismissal will be carried out once for those positions.
Previously, the Delegation Working Committee (under the National Assembly Standing Committee) proposed a time limit in the regulations on consequences for those who are given a vote of confidence and a vote of no confidence.
Specifically, if a person who is voted for a vote of confidence is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies, he/she must resign.
Within no more than 10 days from the date of announcement of the results of the vote of confidence, if the person does not resign, the National Assembly and the People's Council shall consider and decide on a vote of confidence at that session or the nearest session, but no more than 30 days from the date of announcement of the results of the vote of confidence.
In the submission to the National Assembly, the proposal for the above deadline no longer appears.
It is expected that on the afternoon of May 30, the National Assembly will hear the Presentation and the report on the examination of the draft Resolution on taking a vote of confidence and voting for people holding positions elected or approved by the National Assembly and the People's Council (amended). Immediately after that, this content will be discussed in groups.
On the afternoon of June 9, the National Assembly discussed the draft resolution in the hall, then voted to pass it on the afternoon of June 23.

President, Vice President;
Chairman of the National Assembly, Vice Chairman of the National Assembly, Member of the Standing Committee of the National Assembly, Chairman of the Council of Nationalities, Chairman of the Committees of the National Assembly, Secretary General of the National Assembly;
Prime Minister, Deputy Prime Ministers, Ministers, other members of the Government; Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, State Auditor General.
