The Ministry of National Defense proposes regulations on penalties for violations of management and protection at the Ho Chi Minh Mausoleum Relic Site.
The Ministry of National Defense said that compared to Decree No. 120/2013/ND-CP regulating administrative sanctions for violations in the fields of national defense and cryptography, in the draft, the Ministry of National Defense proposed to add 3 new articles regulating sanctions for violations in management and protection of the Ho Chi Minh Mausoleum Relic Site (section 6, chapter 2 of the draft).
Fines of up to 3 million VND for writing, drawing, and defacing works in the Ho Chi Minh Mausoleum Relic Site
Specifically, a fine of 1-3 million VND will be imposed on acts of writing, drawing, dirtying, or polluting structures in the Ho Chi Minh Mausoleum Relic Site.
Fines from 5 to 8 million VND for illegal gatherings in the target area for protecting the Ho Chi Minh Mausoleum Relic Site.
A fine of 20 to 30 million VND shall be imposed for one of the following acts: Cutting down special landscape forests in Area K9; causing insecurity and disorder in the target area for protecting the Ho Chi Minh Mausoleum Relic Site, but not to the extent of criminal prosecution.
Violations of regulations on the operation of the Ho Chi Minh Mausoleum Relic Site will be fined up to 75 million VND.
According to the draft, a fine of 10 - 15 million VND will be imposed for one of the following acts:
1- Obstructing or failing to comply with requests for inspection, control or orders of the management and protection forces of the Ho Chi Minh Mausoleum Relic Site.
2- Using words or actions that threaten, insult, or offend the honor and dignity of those in the management and protection force of the Ho Chi Minh Mausoleum Relic Site while on duty.
3- Organizing, inciting, assisting, enticing or inciting others to not comply with the requests for inspection, control and orders of the management and protection forces of the Ho Chi Minh Mausoleum Relic Site.
The draft clearly states that a fine of 20 - 30 million VND will be imposed for one of the following acts:
1- Filming and taking photos in restricted areas or protected areas where filming and taking photos are prohibited.
2- Using force or threatening to use force against people in the management and protection force of the Ho Chi Minh Mausoleum Relic Site while performing their duties.
3- Causing damage to property and vehicles of the management and protection forces of the Ho Chi Minh Mausoleum Relic Site while performing their duties.
Fines of 50-75 million VND for acts that endanger or harm the security and safety of activities in the Ho Chi Minh Mausoleum Relic Site, but not to the extent of criminal prosecution.
Fines up to 75 million VND for violating regulations on protecting equipment and constructions at the Ho Chi Minh Mausoleum Relic Site
According to the draft, there will be a fine of 5-8 million VND for the act of leaving waste, toxic chemicals, and poisons in the Ho Chi Minh Mausoleum Relic Site.
Fines from 8 to 10 million VND for intentionally creating obstacles to obstruct activities in the Ho Chi Minh Mausoleum Relic Site.
Fines from 20 to 30 million VND for acts of damaging equipment and works at the Ho Chi Minh Mausoleum Relic Site worth less than 100 million VND.
Fines of 50-75 million VND for acts of destroying or appropriating equipment and works of the Ho Chi Minh Mausoleum Relic Site, but not to the extent of criminal prosecution.
The Ministry of National Defense said that the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site, drafted by the Ministry of National Defense, has been reviewed by the Ministry of Justice and submitted to the National Assembly and the National Assembly Standing Committee.
According to the law-making program, this Ordinance will be adopted in 2024. Therefore, to ensure that administrative sanctions in these areas are enforced immediately after the above Ordinance takes effect, it is necessary to stipulate in the draft Decree. During the process of developing the Decree, the Ministry of National Defense will regularly update the new content of the Ordinance to ensure consistency, synchronization and timeliness.
