The People's Committee of Quang Ngai province has just submitted a document to the Provincial People's Council requesting the issuance of a Resolution stipulating criteria for deciding on the implementation of bidding to select investors to implement investment projects using land in the province.
Accordingly, the purpose of developing the Resolution is to stipulate criteria for deciding on the implementation of bidding to select investors to implement investment projects using land in the province to ensure compliance with the provisions of law on land, investment, construction, housing, bidding, etc.; the basis for departments, branches, sectors, People's Committees of districts, towns, cities, agencies, units and individuals involved in the implementation of bidding to select investors to implement investment projects using land of all types of projects.
Types of projects, including investment projects to build urban areas with mixed functions, synchronous technical infrastructure systems, social infrastructure with housing according to the provisions of law on construction for new construction or urban renovation and embellishment; rural residential area projects.
The first criterion is the scale of land use of the project. Specifically, the investment project to build an urban area with mixed functions, synchronous technical infrastructure, social infrastructure with housing for new construction or urban renovation and embellishment has a scale of land use area according to the provisions of the law on construction; the rural residential area project has a scale of land use area from 3 hectares or more.
The second criterion is that there must be a detailed plan or a 1/2000 scale zoning plan approved by a competent authority. The third criterion is that the project must be consistent with the urban development program and plan; the provincial housing development program and plan approved by a competent authority. The fourth criterion is that the land on which the project is implemented must have a land use plan approved by a competent authority.
Fifth, the project does not fall into the following cases: a project containing a contiguous land plot managed by a State agency or organization, in which, according to the project proposal, the investor uses part or all of the land area for business purposes and the business land has all the conditions (adjacent to the existing road or has a road leading to this land plot (minimum road cross-section of 5m) with this adjacent side having a length greater than 5m, the depth of the land plot is greater than 20m (for Ly Son district and the area of wards and towns is 10m); has an area accounting for more than 20% of the total area of the land plot implementing the project; has an area of more than 1ha, except for Ly Son district, it is 0.5ha; the land plot implementing the project has a part of land subject to auction of land use rights according to the provisions of Article 125 of the 2024 Land Law; uses public investment capital according to the provisions of the law on public investment).
