Quang Nam clarifies the overlap of mineral planning and district planning
Quang Nam requested clarification of the overlap between the planning for sand and gravel mining in BTM3 area, Tran Duong group, Tra My town and the approved construction planning for Bac Tra My district.

The Standing Vice Chairman of the People's Committee of Quang Nam province, Phan Thai Binh, has just assigned the Department of Planning and Investment to preside over and coordinate with relevant functional agencies, the People's Committee of Bac Tra My district and An Phat Tai Company Limited, Toan Tien Construction Joint Stock Company to inspect the actual situation and related documents; clarify the overlap of the planning for sand and gravel mining in BTM3 area, Tran Duong group, Tra My town with the approved construction planning of Bac Tra My district and the overlap of the planning for sand and gravel mining in BTM5 area, village 3, Tra Giang commune, Bac Tra My district with the scope of the water source protection area of the water intake location of Bac Tra My Clean Water Plant.
On that basis, the Department of Planning and Investment shall take appropriate measures to ensure compliance with legal provisions and regulations on the use of water resources; report and propose to the Provincial People's Committee to consider and resolve procedures for approving investment policies for mineral exploitation projects according to regulations.
Participating in the appraisal of the investment policy of the Project on Exploitation of sand and gravel minerals for common construction materials in BTM3 area, Tran Duong group, Tra My town and BTM5 area, village 3, Tra Giang commune, Bac Tra My district, Quang Nam province, the People's Committee of Bac Tra My district said that according to the construction planning of Bac Tra My district approved by the Provincial People's Committee in Decision No. 3385/QD-UBND dated December 1, 2020, the green park planning has an area oriented to build a wastewater treatment plant.
Currently, the Prime Minister has issued Decision No. 72/QD-TTg dated January 17, 2024 approving the Planning of Quang Nam province for the period 2021 - 2030, with a vision to 2050.
Accordingly, the contents of the district construction planning that are not consistent with the provincial planning will have to be reviewed and adjusted. Therefore, the People's Committee of Bac Tra My district requested the Department of Planning and Investment to consult with the provincial professional agency on the consistency with the provincial planning.
For the BTM5 sand and gravel area, village 3, Tra Giang commune: according to the construction planning of Bac Tra My district approved by the Provincial People's Committee in Decision No. 3385/QD-UBND dated December 1, 2020, the planning of water surface land area has not been oriented for construction planning.
Currently, the Prime Minister has issued Decision No. 72/QD-TTg dated January 17, 2024 approving the Planning of Quang Nam province for the period 2021 - 2030, with a vision to 2050.
Accordingly, the contents of the district construction planning that are not consistent with the provincial planning will have to be reviewed and adjusted. Therefore, the People's Committee of Bac Tra My district requested the Department of Planning and Investment to consult with the provincial professional agency on the consistency with the provincial planning.
According to the People's Committee of Bac Tra My district, the area of BTM5, village 3, Tra Giang commune has an area overlapping with the water source protection area of Bac Tra My Clean Water Plant of Toan Tien Construction Joint Stock Company.
Regarding this issue, the People's Committee of Bac Tra My district has conducted a survey and worked with relevant parties and the parties have also made a commitment, thereby agreeing that when implementing the sand and gravel mining project in the BTM5 area, it will not impact the scope of the identified water source protection zone (the area within a radius of 100m from the water intake location of the Water Plant downstream) to ensure that it does not affect the water intake of the Bac Tra My Clean Water Plant.
