According to the Provincial People's Council, the above localities have strong socio-economic development, the pressure in state management in general and law enforcement in handling administrative violations in particular is more complicated than other localities. The content of supervision focuses on 4 areas: land; environment; construction; social order and safety, prevention of social evils.
Reporting to the Monitoring Team on the situation of administrative sanctions, the People's Committee of Nui Thanh district said that in the period of 2021 - 2023, the whole district detected 656 violations and issued decisions to sanction administrative sanctions with a total amount of nearly 2.2 billion VND. Of which, the district level issued 77 decisions to sanction with a total amount of nearly 1.3 billion VND; the commune level issued 579 decisions to sanction with a total amount of more than 900 million VND.
In Dien Ban, during the same period, the Chairman of the Town People's Committee issued 272 decisions to sanction administrative violations with a total fine of nearly 3.4 billion VND; the amount collected reached more than 2.4 billion VND.
In Tam Ky, decisions have been made to handle 544 cases of administrative violations. Of which, the Chairman of the City People's Committee issued 96 decisions to handle administrative violations in the land sector with a fine of more than 1 billion VND, and has completed the execution of 38 decisions to handle the fine of 405 million VND.
Localities said that through the work of detecting and handling administrative violations, violations have been promptly corrected, enhancing the effectiveness and efficiency of state management in the area. At the same time, they pointed out difficulties, obstacles and shortcomings in handling administrative violations, especially the application of coercive measures to cases of administrative violations but not complying with the penalty decision.
From the practice of law enforcement on handling administrative violations, localities propose and recommend that the Government soon issue a new decree to replace Decree 166/2013/ND-CP on enforcement of decisions on handling administrative violations in accordance with the current Law on Handling Administrative Violations.
At the same time, there should be specific regulations on the organization and operation of the urban rules inspection team in general to ensure the basis for implementation, limit overlaps and duplications with the functions and tasks of specialized agencies directly advising on state management of construction order management, urban order, etc.
