On March 7, the Government issued Decree 30/2024/ND-CP regulating the management of road motor vehicles registered abroad and brought into Vietnam by foreigners for tourism.
This Decree takes effect from May 1, 2024.
6 types of documents that foreigners must carry when participating in traffic in Vietnam
Accordingly, there must be a vehicle going ahead to guide traffic for foreign motor vehicles while participating in traffic in Vietnam. The vehicle guiding traffic is a car (if the tourist drives a car) or a motorbike (if the tourist drives a motorbike) arranged by a Vietnamese international travel service business and must be attached with a logo or flag with the symbol of that business.
Only allowed to participate in traffic on routes within the provincial administrative boundaries and the time of circulation in Vietnam territory according to the regulations in the approval document of the Ministry of Public Security.
When driving a foreign motor vehicle, the driver must comply with the provisions of Vietnam's road traffic laws; carry and present the following documents when requested by a competent authority:
First, passport or international travel documents, documents related to residence in Vietnam.
Second, a foreign driving license appropriate to the type of vehicle being driven and still valid.
Third, a valid certificate of technical safety and environmental protection inspection for motor vehicles or equivalent documents issued by a competent authority of the country of vehicle registration (for automobiles).
Fourth, the vehicle registration certificate is issued by the competent authority of the country where the vehicle is registered and is still valid.
Fifth, the motor vehicle owner's civil liability insurance certificate is valid in Vietnam.
Sixth, customs declaration of temporary import and re-export of road vehicles.
In addition to carrying all the above documents, foreigners are only allowed to participate in traffic on routes within the administrative boundaries of the province and the time of circulation in Vietnam territory is in accordance with the regulations in the approval document of the Ministry of Public Security.
At the same time, when participating in traffic, there must be a vehicle going ahead to guide traffic for foreign motor vehicles while participating in traffic in Vietnam. The traffic guide vehicle is a car (if the tourist drives a car) or a motorbike (if the tourist drives a motorbike) arranged by a Vietnamese international travel service business and must be attached with a logo or flag with the symbol of that business.
Conditions for foreigners to drive in Vietnam
Decree 30/2024/ND-CP increases the time allowed for foreign motor vehicles to participate in traffic in Vietnam to a maximum of 45 days instead of 30 days as previously prescribed.
In addition, to be able to drive in Vietnam, foreigners must meet the following conditions:
General conditions: Must go through a Vietnamese international travel service business to request approval to organize for foreign tourists to bring foreign motor vehicles to participate in traffic in Vietnam; Have a written approval to organize for foreign tourists to bring foreign motor vehicles to participate in traffic in Vietnam issued by the Ministry of Public Security.
Specific conditions: Being a foreigner; Having a passport or valid international travel document and visa, valid residence document in Vietnam, except for cases of visa exemption according to the provisions of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014 (amended 2019, 2023). In case a foreigner enters Vietnam under a unilateral visa exemption, the passport must be valid for at least 6 months; foreigners using an electronic visa must enter through international border gates decided by the Government; Having a valid foreign driving license suitable for the type of vehicle being driven; Must complete entry and exit procedures according to the provisions of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014 (amended 2019, 2023).
Procedures for approving foreign motor vehicles to participate in traffic in Vietnam
According to regulations, Vietnamese international travel service businesses must send to the Ministry of Public Security 01 set of documents in one of the following forms: Directly, online, by post. The documents include the following documents:
- Official dispatch requesting approval to organize for foreign tourists to bring foreign motor vehicles into Vietnam to participate in traffic according to Form No. 01 of the Appendix attached to Decree 30/2024/ND-CP;
- List of vehicle drivers according to Form No. 02 Appendix attached to Decree 30/2024/ND-CP;
- Copy of international travel service business license (applicable to international travel service businesses applying for approval to organize tours for foreign tourists to bring foreign motor vehicles to participate in traffic in Vietnam for the first time).
The Decree stipulates that no later than 05 working days from the date of receiving the complete dossier specified above, the Ministry of Public Security shall issue a written response approving or disapproving (stating the reasons) the participation of foreign motor vehicles in traffic in Vietnam.
Approval documents according to Form No. 03, disapproval documents according to Form No. 07 Appendix attached to Decree 30/2024/ND-CP and are returned directly, or online, or by post.
The approval document issued for foreign tourists to bring foreign motor vehicles into Vietnam is notified by the Ministry of Public Security to the Ministry of Culture, Sports and Tourism, Ministry of Foreign Affairs, Ministry of Transport, Ministry of National Defense, Ministry of Finance, People's Committees of relevant provinces and centrally run cities for coordinated management.
The Decree clearly states that in cases of force majeure (in cases where foreigners or foreign motor vehicles cannot leave Vietnam's territory due to unforeseeable objective events that cannot be immediately remedied despite having applied all necessary and permissible measures):
- International travel service businesses must send a written report to the Ministry of Public Security on the reasons for the vehicle's delayed departure compared to the time specified in the Ministry of Public Security's approval document according to Form No. 04 of the Appendix to Decree No. 30/2024/ND-CP and sent directly, online, or by post;
- After receiving the report from the international travel service business, the Ministry of Public Security shall send a written response to the international travel service business and send it to the Ministry of Culture, Sports and Tourism, the Ministry of Foreign Affairs, the Ministry of Transport, the Ministry of National Defense, the Ministry of Finance, and the People's Committees of relevant provinces and centrally run cities for coordination in management according to Form No. 05 of the Appendix to Decree No. 30/2024/ND-CP.
