Plan for arranging and handling public assets when implementing two-level local government

The Ministry of Finance has just issued additional instructions on the arrangement, disposition, and handling of assets when reorganizing administrative units when implementing two-level local government.

Accordingly, the Ministry of Finance has issued general principles in arranging, planning and handling public assets when implementing the two-level government model.

Specifically, agencies, organizations and units subject to administrative unit reorganization shall conduct inventory, classify and make a list of public assets; report to the agency responsible for developing a plan for arrangement, placement and handling; and hand over and receive assets to agencies, organizations and units after administrative unit reorganization according to the plan for arrangement, placement and handling of assets approved by competent authorities.

The development of plans for the arrangement, management and disposal of public assets must be carried out simultaneously with the process of developing a project to reorganize administrative units at all levels.

The arrangement, organization and handling of assets must be suitable to the management and use objects, the nature and characteristics of the assets, making the most of the resources of existing assets but must have a long-term vision to serve long-term goals; it is not necessary to carry out the process of arranging and handling houses and land according to the provisions of Decree No. 03/2025/ND-CP dated January 1, 2025 of the Government when arranging, organizing and handling assets when rearranging and reorganizing administrative units. Prioritize the coordination and reasonable arrangement of assets between new grassroots administrative units in the locality. In case it is necessary to change the function of the assets, the function must be changed to serve the performance of functions and tasks.

Can arrange a working headquarters for many agencies, organizations, units

Regarding working headquarters and public service facilities, according to the guidance of the Ministry of Finance, priority is given to arranging working headquarters and public service facilities of district-level agencies, organizations and units (after abolishing the district level) for grassroots administrative units where the headquarters are located or other State agencies, organizations and units (including central agencies, organizations and units in the area) that have a need to use them as working headquarters and public service facilities; it is possible to arrange one working headquarters for many agencies, organizations and units to use according to the management methods prescribed in Point a, Point b, Clause 6, Article 4a of Decree No. 151/2017/ND-CP (amended and supplemented in Clause 5, Article 1 of Decree No. 114/2024/ND-CP).

In addition, implement the exchange (transfer) of headquarters and public service facilities between provincial, district, commune-level agencies, organizations, units and central agencies in the area with headquarters that have surplus, excess or lack of area compared to standards and norms to ensure maximum utilization of available facilities, headquarters and public service facilities in the area.

For the surplus headquarters and public service facilities after arrangement and reorganization, the asset handling shall be carried out in accordance with the provisions of the law on management and use of public assets; in which, priority shall be given to converting the function to become medical andeducational facilities, and using them for other local public purposes (libraries, parks, cultural and sports institutions, etc.); reclaiming them for handing over to the organization with the function of managing and trading in local houses for management and exploitation (management to serve the long-term goals of the State; preserving and protecting assets; arranging for temporary use by agencies and units; leasing houses attached to land, etc.), handing over to the local land fund development organization for management, development and exploitation in accordance with the provisions of law, etc.

The Ministry of Finance also provides clear guidance for public vehicles. Specifically: For specialized vehicles used for specific activities, they will be handled according to the principle that the agency, organization or unit that receives the task will receive the corresponding assets to continue performing the task.

For cars serving the general work of district-level units after the district level is abolished, they will be assigned or transferred to agencies, organizations and units that are still lacking or do not have assets or will be handled according to regulations.

In case it is necessary to pick up and drop off civil servants, public employees, and workers when they have to change their working location, arrange for existing cars or supplement the quota for using specialized cars to purchase or rent cars according to regulations to serve the pick-up and drop-off, ensuring that civil servants, public employees, and workers fully complete their assigned tasks, ensuring savings and efficiency.

For specialized machinery and equipment, it is handled according to the principle that any agency, organization or unit that is assigned a task using specialized machinery and equipment will receive the corresponding assets to continue performing the task.

For common machinery, equipment, shared machinery, equipment and other assets, priority should be given to utilizing assets that are still usable and transferring them to the new working location of the unit and cadres, civil servants and public employees for continued use, ensuring the performance of tasks after the arrangement, without affecting the unit's operations; minimizing the need to purchase new assets.

In case of surplus, it will be coordinated between new grassroots administrative units in the district and province or handled according to regulations.

Responsibility of District People's Committee in developing plans to handle public assets

The Ministry of Finance also assigned the People's Committees at the district level to develop a plan to arrange, allocate, and handle public assets under their management (including both districts and communes) to report to the People's Committees at the provincial level together with the Project to arrange and reorganize commune-level administrative units. In case there is a plan to transfer a commune-level administrative unit from one district to another to arrange grassroots administrative units, the People's Committees at the district level receiving the commune-level administrative unit are responsible for receiving and developing a plan to arrange, allocate, and handle public assets of that commune-level administrative unit.

The Department of Finance shall preside over and coordinate with relevant agencies to develop a plan to arrange, allocate, and handle public assets under the management of the province to report to the Provincial People's Committee together with the Project to arrange and reorganize provincial administrative units.

Ministries and central agencies with vertical units in the administrative unit's area shall review the organizational structure and the need to use headquarters, public facilities, and public assets of the units according to regulations; in case there is surplus area of ​​headquarters, public facilities, and public assets, they shall be transferred to the locality for management and handling or transferred to local agencies, organizations, and units or transferred to other central agencies, organizations, and units in the area for management and use, ensuring savings and efficiency.
