On the afternoon of April 4, at the National Assembly Office headquarters - 22 Hung Vuong, Party Central Committee member, Vice Chairman of the National Assembly Le Minh Hoan attended the conference to review the draft Law on Science, Technology and Innovation organized by the Committee on Science, Technology and Environment.

Attending the event were Vice Chairmen of the Committee for Science, Technology and Environment Nguyen Phuong Tuan and Ta Dinh Thi; Deputy Minister of Science and Technology Bui The Duy; members of the Committee for Science, Technology and Environment; representatives of the Committees of the National Assembly; representatives of the Ministry of Science and Technology and a number of relevant ministries and branches.

Manage performance, not process

In his opening speech, Chairman of the Committee for Science, Technology and Environment Le Quang Huy emphasized: The Law on Science and Technology was issued in 2013, after more than 10 years of implementation, has played an important role in creating a basic legal corridor for continuing to strongly and synchronously innovate the organization, management mechanism, and operation mechanism of science and technology. On that basis, science and technology have made positive progress, making practical contributions to the socio-economic development of the country.

However, the process of law enforcement also shows that current laws still have contents that are not suitable to the requirements and demands from practice to develop science and technology, unleash all resources, and develop the economy and society rapidly and sustainably.

Also according to Chairman of the Committee Le Quang Huy, in recent times, the Party and State have issued many Resolutions, directives and conclusions related to science, technology and innovation, especially Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science, technology, innovation and national digital transformation.

The National Assembly promptly issued Resolution No. 193/2025/QH15 on piloting a number of special mechanisms and policies to create breakthroughs in the development of science, technology, innovation and national digital transformation to resolve obvious problems and be able to be implemented immediately. However, there are still many contents that need to be further researched, institutionalized fully, fundamentally and systematically in laws that play an important role and are the foundation of this field.

Conference overview

In order to promptly and fully institutionalize the Party and State's policies and guidelines on perfecting institutions in the field of science, technology and innovation; overcome shortcomings and inadequacies arising in the process of law enforcement; remove all barriers, unleash all resources for national development, and successfully achieve the set growth targets, the Chairman of the Committee on Science, Technology and Environment said that the development of the Law on Science, Technology and Innovation is very necessary.

Deputy Minister of Science and Technology Bui The Duy said: The draft Law consists of 8 chapters and 95 articles (an increase of 14 articles compared to the 2013 Law on Science and Technology due to the addition of innovative content and restructuring of the Law, so the form has many changes compared to the current law. The draft Law has major amendments with 26 articles, adding 23 articles.

The draft Law closely follows the policy contents in Resolution 118/NQ-CP of the Government on the thematic meeting on law-making in July 2024, specifically: Innovation in research, development and innovation activities, state management of science, technology and innovation; development of science and technology potential; attracting investment, facilitating the use of budget for science, technology and innovation; promoting science, technology and innovation activities in enterprises and developing the science and technology market; enhancing the dissemination of science and technology knowledge.

In order to promptly institutionalize the tasks and solutions in Resolution No. 57-NQ/TW, the draft Law on Science, Technology and Innovation has also added policies related to the legal corridor for creative start-up activities.

The draft Law is designed according to the principles of reducing administrative procedures, strengthening post-auditing, and comprehensive digital transformation in the management and activities of science, technology and innovation. Changing management thinking towards effective management, not process management. Attracting non-state budget investment sources for science and technology by encouraging enterprises to invest and provide funding for scientific research and technology development. Maximizing the inheritance of the contents of the 2013 Law on Science and Technology, which has been effectively implemented in the past and is suitable for the requirements of science, technology and innovation development.

Develop multiple options when considering

At the conference, delegates and experts contributed opinions on the scope of regulation, subjects of application, associated with the name of the draft law; the consistency of the draft law's content with the Party's policies and guidelines; the level of full institutionalization of the Party's policies and guidelines (especially the level of institutionalization of Resolution 57 of the Politburo).

Delegates also commented on the basic policy contents of the draft Law and the level and appropriateness of concretizing policies through articles and clauses in the draft Law: innovation in research, development and innovation activities, state management of science, technology and innovation; development of science and technology potential; attracting investment, facilitating the use of budget for science, technology and innovation; promoting science, technology and innovation activities in enterprises and developing the science and technology market; enhancing the dissemination of science and technology knowledge; creating a legal corridor for creative start-up activities (New policy supplemented compared to the Government's Resolution, to promptly institutionalize tasks and solutions in Resolution No. 57-NQ/TW); ensuring requirements on national defense, security, financial resources, human resources; constitutionality, legality, consistency with the legal system; Compatibility with relevant international treaties to which Vietnam is a member; necessity and rationality of administrative procedures; decentralization, delegation of authority...

Speaking at the conference, Vice Chairman of the National Assembly Le Minh Hoan shared the difficulties of the Ministry of Science and Technology, the Standing Committee of the Science, Technology and Environment Committee and appraisal agencies in drafting the Law on Science, Technology and Innovation.

Emphasizing the need to change the mindset of law-making in accordance with the direction of General Secretary To Lam that the law must create space for development, the Vice Chairman of the National Assembly requested that the drafting agency unify the explanatory content of the provisions of the draft Law, including ensuring the construction of a legal foundation for the development of the country's science.

The Vice Chairman of the National Assembly also noted that there should be no detailed regulations in the law, because science and technology is a field of constant change. In the next 5 years, it is not known what will appear and what will disappear, so the more detailed the regulations, the more confusing it will be.

Conference delegates

Regarding management and control, scientists are very interested. The Vice Chairman of the National Assembly noted that control must be done in a way that is not too rigid and does not create difficulties for scientists, including the role of the state in capital and budget, which is very important.

In addition, for issues that have different opinions, many options can be designed, including specific explanations for each option, to report to the National Assembly Standing Committee.
