37th Session of the National Assembly Standing Committee: Timely handling of arising issues in resolving complaints and denunciations

Continuing the 37th Session, on the morning of September 26, the National Assembly Standing Committee gave opinions on the Government's report on citizen reception, handling of administrative complaints and denunciations in 2024.

Presenting the Preliminary Review Report of the Government's Report on citizen reception, handling of administrative complaints and denunciations in 2024, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Standing Committee of the Law Committee highly appreciated the efforts of ministries, branches, localities and agencies in organizing citizen reception with practical and effective innovations.

Regarding the advantages in complying with the law on the direct responsibility of heads of state administrative agencies to receive citizens, the Government assessed that heads of all levels and sectors have increasingly performed their responsibilities to receive citizens as prescribed. However, data in the Government's Report shows that the situation of heads of agencies authorizing citizen reception at ministries, sectors and localities is still widespread. At the same time, due to the lack of data from many localities, there is not enough basis for comparison with 2023 to convincingly and fully demonstrate the above assessment and assessment.

Regarding the citizen reception work of the People's Court and the People's Procuracy, the number of citizens directly coming to make recommendations, reflect, and make administrative complaints and denunciations is not much and there are no large groups. At the State Audit Office, there were no cases of citizens coming to make complaints and denunciations or make recommendations. For the People's Court, although the number of citizen receptions is not much, compared to 2023, it has increased significantly (up 33.8% in number of people and 50.2% in cases).

The report also shows that, regarding the results of receiving and handling complaints and denunciations, the number of complaints eligible for processing in 2024 in ministries and branches is 52.1%, in the Government Inspectorate is 34.4%, and in 45/63 localities is 85.1%. The Standing Committee of the Judicial Committee requested the Government to clarify the reasons why the number of complaints not eligible for processing in central ministries and branches, especially in the Government Inspectorate, is much higher than in localities, in order to have appropriate solutions for handling and overcoming.

For the People's Court, the People's Procuracy and the State Audit, due to their specific characteristics, the number of petitions, reflections, complaints and denunciations on administrative matters under their responsibility for handling is not much. The number of petitions eligible for handling by the People's Procuracy is 80.4%, by the People's Court is 46% and by the State Audit is 6%.

In addition, in 2024, the rate of complaints resolved by state administrative agencies at all levels under their authority reached 80.2%, not reaching the target of 85% set by the Government in the 2023 Report; in particular, in localities, the resolution rate only reached 76.8%. Therefore, the Standing Committee of the Judicial Committee believes that agencies need to make more efforts to meet the goal of "timely, thoroughly, and legally resolving newly arising complaints and denunciations right from the grassroots level".

Agreeing with the Preliminary Review Report of the Law Committee, Chairwoman of the Judicial Committee Le Thi Nga said that currently, only 45/63 localities have been able to compile data, all of which are lower than the 12 months of 2023, so there is not enough basis for comparison and evaluation. Because there is not yet complete data, there cannot be a "full picture" of the results of handling complaints and denunciations.

The Chairman of the Judiciary Committee suggested that the Government urgently rectify localities to submit correct and complete reports, ensuring that sufficient data from 63 localities is compiled before the upcoming 8th Session of the 15th National Assembly. At the same time, the Report should clearly indicate which ministries, branches and localities have performed well in receiving citizens and which ministries, branches and localities have leaders who rarely receive citizens.

According to the figures in the Report, the rate of correct complaints is 18%, correct denunciations is 37.4%. The Chairman of the Judicial Committee believes that this shows that the administrative handling and work of the agencies that receive complaints from the people are not good enough, and the quality of their operations needs to be improved. In addition, to overcome the problem of duplicate applications, the Chairman of the Judicial Committee suggests solving it by building a unified software system nationwide, from which to filter clearly to know the specific status of the number of applications that have not been resolved, are being resolved and have been resolved.

Also at the meeting, the National Assembly Standing Committee considered and decided to adjust the Law and Ordinance Development Program.
