Approval of the Project "Legislative orientation for the 16th National Assembly term of the Government"

The Prime Minister approved the Project "Legislative orientation for the 16th National Assembly term of the Government".

Guiding principles of the Project

The guiding viewpoint of the Project is to ensure that the work of building and perfecting laws closely follows and promptly and fully institutionalizes the Party's policies in the Documents of the 13th National Congress of Delegates, Resolution No. 27-NQ/TW dated November 9, 2022 of the Politburo on continuing to build and perfect the socialist rule-of-law State of Vietnam in the new period; aiming for the goal of being for the people, for the people; respecting and protecting human rights and citizens' rights according to the provisions of the Constitution and increasingly ensuring democracy, fairness, order and social discipline; under the direct direction of the Government and the Prime Minister.

Proactively study and closely follow the key, core contents and new points in the draft documents of the 14th Congress, especially the draft Political Report at the 14th Congress and the draft Summary Report on a number of theoretical and practical issues on the work of innovation in the direction of socialism over the past 40 years in Vietnam to serve as a premise and political basis for reviewing and proposing the construction and improvement of the legal system.

Create institutional breakthroughs, strongly innovate the thinking of law-making from management to sustainable development creation; start from practical requirements; reform and simplify administrative procedures; focus on people and businesses; promptly resolve practical issues that arise; ensure legal coverage in all areas of economic and social life; proactively and actively participate in the Fourth Industrial Revolution and promote the national digital transformation process.

Specifically and clearly identify legislative orientations and a list of legislative tasks that need to be studied, reviewed, and researched, revised, and newly developed. The legislative orientations and tasks are identified as an important basis for ministries and ministerial-level agencies to proactively study, review, and propose the development of laws, ordinances, and resolutions to be included in the annual legislative program and implemented during the 16th National Assembly term, and at the same time serve as a "pillow" premise to prepare for the next National Assembly term...

The objective of the Project is to identify key tasks that need to be performed to develop the Project with a reasonable roadmap; ensure close coordination between relevant agencies and organizations in the process of developing the Project and forecast conditions on financial resources, human resources and time for implementing the Project to ensure quality and efficiency.

Key tasks and solutions of the Project

The project will be implemented from 2025 to 2031 with 3 key tasks including: 1- Assessing and summarizing the implementation of Conclusion No. 19-KL/TW dated October 14, 2021 of the Politburo on the Law-making Orientation for the 15th National Assembly term; reviewing, researching, and proposing the Legislative Orientation for the 16th National Assembly term; 2- Developing a plan to implement the Legislative Orientation for the 16th National Assembly term; 3- Researching, reviewing, recommending amendments, supplements or researching and proposing the development of new legal documents, ordinances, and resolutions identified in the Legislative Orientation for the 16th National Assembly term.

In which, ministries and ministerial-level agencies evaluate and summarize the implementation of the Law-making Orientation for the 15th National Assembly term; review and propose the Legislative Orientation for the 16th National Assembly term according to the scope and management areas of ministries and ministerial-level agencies, including: Review, evaluate and summarize the implementation of Conclusion No. 19-KL/TW of the Politburo; Plan No. 81/KH-UBTVQH15 dated November 5, 2021; Plan No. 734/KH-UBTVQH15 dated January 22, 2024; Decision No. 2114/QD-TTg dated December 16, 2021...

Review the Party's resolutions and conclusions on sectors and fields to assess the institutionalization of the Party's policies and guidelines and issues arising from practice that need to be researched, built, and perfected in the legal system.

Proposing the Legislative Orientation for the term of the 16th National Assembly, in which specifically identifying the orientations and tasks of law-making under the authority of the National Assembly and the National Assembly Standing Committee in the fields that need to be implemented during the term of the 16th National Assembly; the basis and content that need to be researched, reviewed, and institutionalized; the agency in charge of implementation; the expected deadline for completing the research and review and the deadline for amending, supplementing or promulgating new laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee (if any).

At the same time, ministries, ministerial-level agencies, and relevant agencies organize seminars, workshops, field surveys, learn from foreign experiences, and consult experts and scientists to serve research and review to advise the Government on determining amendments, supplements, or proposals to develop new laws, ordinances, and resolutions that have been identified in the legislative orientation of the 16th National Assembly's term, ensuring quality and progress...
