Accordingly, regarding fee management and use, Circular No. 65 clearly states that fee collection organizations are allowed to deduct 70% of the collected fee amount to cover costs for service provision and fee collection activities as prescribed in Article 5 of Decree 120/2016 of the Government detailing and guiding the implementation of a number of articles of the Law on Fees and Charges; pay 30% of the collected fee amount to the state budget (NSNN) according to the corresponding chapter and sub-item of the NSNN table of contents.
In case the fee collection organization is a state agency that is not eligible for operating expenses from fee collection sources according to regulations, it shall pay the entire amount of collected fees to the state budget. The source of expenses for service provision and fee collection activities shall be arranged by the state budget in the estimate of the fee collection organization according to the state budget expenditure regime and norms.
The fee payer shall pay the fee upon receiving the notice of financial obligation from the competent authority providing environmental data. No later than the 5th of each month, the fee collection organization shall deposit the entire amount of fees collected in the previous month into the fee account awaiting payment to the budget opened at the State Treasury. The fee collection organization shall declare, collect, pay and settle the fee in accordance with the provisions of Circular No. 74/2022 of the Ministry of Finance .
