Before answering the question of what blood alcohol concentration (BAC) leads to a motorcycle being impounded, it's necessary to understand what BAC is. BAC is the amount of alcohol present in a liquid or in a person's breath, measured in percentages (%) or in isomers (‰). It is commonly used to assess the impact of alcohol on the human body or in alcohol-containing products such as alcoholic beverages, cosmetics, or medical solutions.

In most countries, blood alcohol concentration is an important measure of safe driving ability. Legal limits on permissible blood alcohol levels often vary depending on the regulations of each country or region. For example, in many countries, the permissible blood alcohol limit for driving is 0.05% (0.5 g/l) or lower. The higher the alcohol concentration, the lower the ability to drive safely and the greater the risk of traffic accidents.

What blood alcohol concentration (BAC) will result in a motorcycle being impounded? According to regulations, all violations related to blood alcohol concentration can lead to vehicle impoundment, with a maximum impoundment period of 7 days. Specifically, motorcycle drivers will have their vehicles impounded if their breath or blood alcohol concentration exceeds 0.25 mg to 0.4 mg per liter of breath or 50 mg to 80 mg per 100 ml of blood. This applies to drivers whose breath or blood alcohol concentration exceeds 0.4 mg per liter of breath or 80 mg per 100 ml of blood.

Besides knowing what blood alcohol concentration level results in a motorbike being impounded, people should also be aware that those who violate alcohol limits and have their motorbikes temporarily seized must retrieve them within the prescribed time limit. If they fail to retrieve their motorbike within this time limit, their motorbike may be subject to penalties as stipulated in Clause 8, Article 1 of Decree 31/2020/ND-CP.

Specifically, within 3 days from the expiration of the temporary detention period, if the offender does not come to claim the vehicle without a valid reason, the person who issued the temporary detention decision must announce it on the mass media of the central or local agency where the vehicle is detained, and publicly post it at the headquarters of the competent authority that temporarily detained the vehicle.

After 30 days from the date of public posting or the final announcement in the mass media, if the violator does not come to claim the items or cannot be identified, the competent authority must issue a decision to confiscate the items and means used in the administrative violation for processing according to the law.

After a vehicle is confiscated, it becomes the property of the entire nation and is processed according to the procedures stipulated in the Law on Management and Use of Public Assets and related documents.
