The People's Committee of Ninh Thuan province has proposed many solutions to remove obstacles for a series of renewable energy projects in the province that are "frozen" due to the conclusion of the Government Inspectorate.

The People's Committee of Ninh Thuan province has just drafted a draft to remove obstacles and difficulties for renewable energy projects according to Resolution No. 233 of the Government.
Renewable energy projects in Ninh Thuan have encountered some major problems, including receiving the wrong incentive price mechanism (FIT price) (14 projects); recognizing the commercial operation date and receiving FIT price without having an acceptance document (35 projects, but investors have resolved 100%); overlapping irrigation planning (4 projects) and problems with land procedures;
Other problems include some projects that are in commercial operation or have completed investment but have not been updated in the 8th power plan, some projects have had payment suspended by EVN or only 50% of output payment due to problems with location and boundaries.
Regarding the proposal to re-determine electricity purchase prices and withdraw incentives for renewable energy projects that enjoy preferential prices in violation of regulations, the Ninh Thuan Provincial People's Committee said that this plan would cause great economic losses to investors, affect the investment environment and the possibility of international lawsuits.
Therefore, the province proposed that the Prime Minister assign the Ministry of Industry and Trade to coordinate with Vietnam Electricity Group (EVN) to review and propose a reasonable and appropriate solution.
For projects that overlap with irrigation planning, Ninh Thuan will assess the socio-economic efficiency of implementing the planning and energy projects, and consider integrating both into the planning.
For projects with violations in land procedures, Ninh Thuan proposed that the projects be allowed to be completed according to the law and currently both projects with problems have been 100% resolved.
For projects that have not been updated in the 8th power plan, the province will request the Ministry of Industry and Trade to add these projects to the plan and implementation plan. As for projects whose payment has been suspended by EVN, the province will request the Ministry of Industry and Trade to direct EVN to make payment according to the contract.
Recover preferential electricity bills through compensation
In the report on the implementation plan of the Government's resolution on removing obstacles and difficulties for renewable energy projects, the Ministry of Industry and Trade said that renewable energy projects that do not meet the conditions for enjoying FIT prices will have to determine the electricity purchase and sale price according to regulations.
At the same time, recover the preferential FIT prices that have been incorrectly enjoyed through offset payments for electricity purchases. The solution is based on optimization to analyze, evaluate, and compare socio-economic benefits, minimizing disputes, complaints, and impacts on the investment environment.
To handle this, the Ministry of Industry and Trade proposed a plan for EVN to take the lead and coordinate with project investors to determine conditions for enjoying preferential prices. For projects not entitled to this price, EVN will report to the competent authority as a basis for offsetting payment for electricity purchases.
