In Circular 29/2024, the Ministry of Education and Training clearly stipulates cases where extra teaching is allowed and not allowed to limit negative events related to this activity.
Article 4, Circular 29/2024 stipulates 3 cases where extra teaching and organization of extra teaching are not allowed.
Specifically, no extra teaching is organized for primary school students, except in the following cases: training in arts, physical education, life skills training; teachers teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned to teach by the school according to the school's education plan; teachers at public schools are not allowed to participate in the management and operation of extra classes outside of school but can participate in extra classes outside of school.
Regarding extra-curricular teaching and learning activities, Article 6 of Circular 29/2024 stipulates each specific case and requires full implementation.
Accordingly, organizations or individuals organizing extra-curricular teaching and learning activities outside of school that collect fees from students must register their business according to the provisions of law. Publicize the subjects for which extra-curricular teaching is organized; the duration of extra-curricular teaching for each subject according to each grade level; the location, form, and time of extra-curricular teaching and learning; the list of extra-curricular teachers and the amount of tuition collected before enrolling students for extra-curricular teaching and learning classes.
Heads of agencies, organizations and units whose cadres, civil servants and public employees violate regulations on extra teaching and learning, depending on the nature and severity of the violation, shall be handled according to the provisions of law.
If schools, tutoring facilities, organizations or individuals violate regulations on tutoring and learning, depending on the nature and severity of the violation, they will be handled according to the provisions of law.
What are the requirements for teachers to teach outside of school?
According to Clause 1, Article 80 of Decree 01/2021, the law does not prohibit teachers from establishing business households. However, Clause 3, Article 4 of Circular 29/2024 stipulates that teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching.
Article 6 of Circular 29/2024 stipulates that organizations or individuals organizing extra teaching and learning activities outside of school that collect fees from students, in addition to registering their business according to the provisions of law, must also publicly disclose information about the subjects they teach.
Along with that, organizations or individuals teaching extra classes must publicly disclose the number of extra classes for each subject according to each grade level; location, form, and time of organizing extra classes; list of extra teachers and tuition fees before enrolling students for extra classes.
Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.
At the same time, teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal or Director or head of the school about the subjects, location, form, and time of extra-curricular teaching.
