Difficulties, challenges, and Vietnam's accession prospects to Convention 87.

This convention not only aims to meet international labor standards but also demonstrates Vietnam's strong commitment to protecting workers' rights. Currently, Vietnam has ratified 7 out of 8 fundamental ILO conventions, with Convention No. 87 being the last one remaining.

Convention No. 87 clearly stipulates the right of workers to freely form and join trade unions, allowing them to freely decide on their organization without interference from the government. This is crucial in protecting the legitimate rights of workers and creating a fairer working environment. However, Vietnam needs to carefully consider the specific political and social factors of the country before proceeding with accession.

The process of domesticating Convention No. 87 can be carried out in two main ways: firstly, by directly applying the convention's provisions to the national legal system; and secondly, by incorporating and adjusting the provisions in existing legal documents. Joining the Convention will require amendments to several articles in the Labor Code and the Trade Union Law to ensure compatibility with international regulations.

Although joining Convention No. 87 brings many benefits, including market expansion and enhanced protection of workers' rights, it also poses many challenges to the existing trade union system.

The current trade union system in Vietnam is closely tied to the leadership of the Party, and allowing the emergence of many new worker representative organizations could lead to disruptions in labor relations. Without proper management and coordination, competition between these organizations could cause instability in the workplace.

The formation of independent trade unions could lead to "union pluralism," which would create divisions within the ranks of workers and weaken the role of mainstream trade unions. This could threaten the political stability and social security of the country.

History has shown that uncontrolled labor movements can lead to serious consequences, as has happened in several Eastern European countries.

Furthermore, in the face of attempts to exploit workers' representative organizations to undermine the Party and the State, it is necessary to strengthen propaganda and education for workers about the purpose and significance of participating in legitimate trade union organizations. They need to be aware of the risks of joining organizations of unknown origin, and be wary of invitations from reactionary forces.

To prepare for accession to Convention No. 87, Vietnam needs to develop a specific and detailed roadmap. This roadmap should not only include assessing the impact of accession on labor relations and trade unions, but also consider the effects on the country's political stability.

In addition, amending and supplementing legal regulations is crucial to facilitate the establishment of organizations representing workers in accordance with the requirements of the Convention.

Furthermore, strengthening and developing the existing trade union system is also indispensable. Trade union organizations need to be empowered to attract workers' participation while maintaining a crucial role in protecting their rights. If well-organized, the Vietnamese trade union system can still dominate in representing workers, even with the emergence of new organizations.

In the context of globalization, the recognition and application of international labor standards is an irreversible trend. Vietnam needs to clearly define specific goals and a roadmap to effectively accession to Convention No. 87, while ensuring domestic political and economic stability.
