Outstanding social and economic policies take effect in December

In December 2023, a number of new legal policies will come into effect.

Notably, Decree 75/2023/ND-CP amends Decree 146/2018 detailing the Law on Health Insurance.

Removing the "bottleneck" in the payment mechanism for medical examination and treatment costs under health insurance

On October 19, 2023, the Government issued Decree No. 75/2023/ND-CP amending and supplementing a number of articles of Decree No. 146/2018/ND-CP dated October 17, 2018 of the Government detailing and guiding measures to implement a number of articles of the Law on Health Insurance.

Deputy Minister of Health Tran Van Thuan said that with many new points, Decree No. 75 has breakthrough regulations, removing "bottlenecks" in the payment mechanism for medical examination and treatment costs under health insurance to facilitate medical examination and treatment under health insurance, ensuring the rights of health insurance participants.

The Decree supplements and supports health insurance premium levels, amends health insurance benefits and strengthens the role and responsibility of ministries, branches, and medical examination and treatment facilities in managing and effectively using the health insurance fund.

The innovative and breakthrough provisions of the Decree demonstrate the determination of the Government, the Ministry of Health and other ministries and sectors in improving the quality and effectiveness of medical examination and treatment under health insurance, creating favorable conditions for both health insurance participants, medical examination and treatment facilities and state management activities on health insurance; improving the effectiveness of management and use of health insurance funds.

The Decree takes effect from December 3, 2023. In particular, the regulation abolishing the total payment level will be applied from January 1, 2019, while some regulations on adding subjects and increasing the benefit level will be applied from the date of promulgation of the Decree (October 19, 2023) to ensure the timely rights of health insurance participants.

New regulations on terms and interest rates for State investment credit loans

On November 7, 2023, the Government issued Decree No. 78/2023/ND-CP amending and supplementing a number of articles of Decree No. 32/2017/ND-CP dated March 31, 2017 of the Government on State investment credit. In particular, Decree No. 78/2023/ND-CP amends the term and interest rate of State investment credit loans.

According to the new regulations, the Vietnam Development Bank will base on the results of project appraisal, production and business characteristics, capital recovery capacity of each project and debt repayment capacity of customers to decide the loan term for each project.

The interest rate for State investment credit loans is decided by the Vietnam Development Bank, ensuring the principle of sufficient compensation for capital mobilization costs, operating expenses and risk provisioning costs for loans signed with credit contracts from December 22, 2023, but not lower than 85% of the average lending interest rate of domestic commercial banks in the same period; the state budget does not subsidize interest rates and management fees for these loans.

This Decree takes effect from December 22, 2023.

Procedure for receiving and handling reports and denunciations of domestic violence

The Government issued Decree 76/2023/ND-CP detailing a number of articles of the Law on Prevention and Control of Domestic Violence. It clearly states the process of receiving and handling reports and denunciations of domestic violence.

The Decree clearly states that the National Hotline for Domestic Violence Prevention and Control (the Hotline) uses a 3-digit short-number to receive and process reports and denunciations of domestic violence.

The hotline operates 24 hours a day to receive reports and denunciations of domestic violence.

The switchboard is guaranteed operational resources by the State. The switchboard automatically records and pays telecommunications fees for all incoming and outgoing calls.

The Decree also clearly states the process of receiving and handling reports and denunciations of domestic violence through the addresses specified in Points a, b, c, d and dd, Clause 1, Article 19 of the Law on Prevention and Control of Domestic Violence.

Foreigners residing in Vietnam who are victims of domestic violence are provided with temporary shelter and support for essential needs; care and treatment; legal aid and psychological counseling; and skills to respond to acts of domestic violence as prescribed in Points d, dd and e, Clause 1, Article 22 of the Law on Prevention and Control of Domestic Violence.

The Decree takes effect from December 25, 2023.

From December 1, transactions worth 400 million VND or more must be reported.

According to Decision 11/2023 replacing Decision 20/2013/QD-TTg of the Prime Minister, from December 1, 2023, transactions with a value of 400 million VND or more must be reported to the State Bank.

This Decision stipulates the level of large-value transactions that must be reported to the State Bank of Vietnam according to the provisions of Clause 2, Article 25 of the Law on Anti-Money Laundering (The Prime Minister decides the level of large-value transactions that must be reported in accordance with socio-economic conditions in each period).

Reporting entities are financial institutions, organizations and individuals doing business in related non-financial sectors as prescribed in Clauses 1 and 2, Article 4 of the Law on Anti-Money Laundering 2022./.
