Violation of traffic safety conditions
In the 2024 inspection plan of the Quang Nam Department of Transport approved and issued in Decision No. 2685 dated December 14, 2023 of the Provincial People's Committee Chairman, the functional sector will inspect compliance with legal regulations on business and conditions for transport business by automobile to transport goods with 19 units.
Therefore, from April 2 to 26, 2024, the Department of Transport Inspectorate conducted direct operations at the enterprise, but at the time of inspection, 1 unit had stopped operating.
Statistics show that 18 freight transport business units have conducted business in the right type licensed by the Department of Transport. The total number of vehicles under the management of the functional sector is 363; the total number of drivers is 400 and all have signed labor contracts, received professional training, and had regular health check-ups...
A member of the inspection team said that although there are still many difficulties, especially in exploiting sources of goods for transportation, the transport business units basically comply with and implement legal regulations.
However, the authorities have also discovered many violations by many businesses. For example, only 7/18 units pay social insurance and other types of insurance for drivers; up to 15/18 units do not make periodic reports.
For the violation of not properly implementing the traffic safety procedures in freight transport business, enterprises including Viet Han - Quang Nam Branch, Le Loc Phat, Song Phu, Phu Huong were fined 7 million VND/enterprise, and had their transportation business licenses revoked for 2 months.
For the violation of not organizing periodic health check-ups for drivers, 2 businesses (Trung Tran Hoa, Son Tien) were administratively fined 22 million VND each.
Nhon Nghia Company was fined 5 million VND for not returning its badge to the Department of Transport. In addition to the fine of 7 million VND, Nui Thanh Cooperative also had its transportation business license revoked for 2 months.
Because the content of not paying social insurance for employees is not under the authority of the Department of Transport Inspectorate, it will notify the Quang Nam Social Insurance to review, verify and handle according to regulations.
Through inspection, it was found that the transport business units have established departments or officers to manage traffic safety conditions; and have developed procedures to ensure traffic safety.
The responsible persons of 14 enterprises organized to implement the process correctly, but there were still 4 units that did not implement as established process.
They are Viet Han Construction and Investment Trading Joint Stock Company - Quang Nam Branch, Le Loc Phat Construction Company Limited, Song Phu General Trading - Service Company Limited, Phu Huong Company Limited.
Many violations in passenger transport
In the first months of 2024, the Department of Transport Inspectorate also conducted inspections at 22 passenger transport business units, but at the time of performing official duties, 8 addresses had stopped operating.
Deploying operations at the Road Motor Transport Cooperative of Nui Thanh District (abbreviated as Nui Thanh Cooperative), the delegation discovered that this unit did not fully implement traffic safety procedures.
For example, not checking the traffic safety conditions of the car and driver before performing the transportation task; not logging into the journey monitoring device to monitor the vehicle's operation in order to immediately remind the driver when detecting violations.
The cooperative also did not organize professional training for 23 drivers from January 1 to August and September of 2023; did not keep statistics on the distance the vehicles had traveled when the drivers finished their assigned tasks...
Chief Inspector of the Department of Transport - Mr. Truong Van Son said that the 14 units subject to this inspection have a total of 561 vehicles with 574 drivers. Of these 561 vehicles, 432 are owned by the unit and 129 are rented from individuals, doing business with cooperative members. The vehicles have badges and full related documents. The KDVT unit has installed and maintained vehicle surveillance cameras to ensure compliance with regulations.
In general, transport business units have made many efforts to maintain operations to serve travel and freight transport and basically comply with regulations, thereby contributing to ensuring traffic safety and order.
However, there are still many violations in the transport business and especially passenger transport. The case of Nui Thanh Cooperative is typical.
Not to mention that during the inspection period, the delegation discovered that 2 units did not organize full periodic health check-ups for 23 drivers. Of the 12 units (except 2 cooperatives) that are required to pay social insurance, including 319 drivers, through inspection, 9 units paid full insurance for 307 drivers, 1 unit did not pay insurance for 10/10 drivers (Trung Tran Hoa enterprise), 2 other enterprises did not pay insurance for drivers at the time of signing the labor contract in 2023.
Faced with the above violations, the relevant authorities request that the units review the relevant organizations and individuals and promptly correct them, report the results to the Department of Transport Inspectorate for monitoring, and synthesize a report to the Director of the Department of Transport.
Comply with social insurance payment, periodic health check-ups for drivers; regularly maintain and maintain data transmission lines from journey monitoring devices and cameras; monitor and supervise data on journey monitoring devices and image information from cameras to promptly warn and prevent violations...
