Counterfeit goods are increasingly sophisticated
Japanese consumer goods have long been favored by Vietnamese consumers because of their good quality, durability, convenience and reasonable prices. However, the reality is that the better the product sells, the more likely it is to be counterfeited.
According to statistics from the General Department of Market Management (GDM), in the period of 2021 - 2023, the market management force has inspected and handled thousands of cases related to intellectual property infringement of Japanese products in Vietnam.
Specifically, 123 cases of cosmetics were handled, with fines of more than VND959 million; 31 cases of functional foods were handled, with fines of VND226 million; 100 cases related to food hygiene and safety, with fines of VND707 million.
Regarding household electrical appliances, a popular product in the Vietnamese market, the market management force detected and handled 95 cases, imposing fines of over VND 1.6 billion; the fashion industry had 93 cases handled, imposing fines of over VND 1.3 billion; and the most were motorcycle spare parts with 611 cases handled, imposing fines of over VND 4.2 billion...
Right at the genuine and fake goods showroom of the General Department of Market Management at 62 Trang Tien, Hoan Kiem, Hanoi, more than 300 genuine and fake "made in Japan" products are also announced for interested consumers to see and identify.
The leader of the General Department of Market Management said that currently, the demand of Vietnamese people for Japanese brands of goods is very high, along with that, there is also a situation of commercial fraud with these brands.
Mr. Nguyen Thanh Binh - Deputy Director General of the General Department of Market Management said: "The situation of counterfeit goods and infringement of intellectual property rights is currently one of the pressing issues of society. The negative consequences it brings affect the rights and legitimate interests of consumers and rights holders being protected in Vietnam, causing consumers to misunderstand and reducing the reputation of genuine manufacturers and businesses".
According to Mr. Nguyen Thanh Binh, currently, counterfeit goods, fake goods, and goods that infringe intellectual property are not sold as widely as before, but subjects take advantage of doing business in the e-commerce environment to trade in infringing goods, causing difficulties for the authorities to grasp, inspect, and handle.
Ms. Dai Kha Quynh - Head of Intellectual Property Department, Vietnam Association of Motorcycle Manufacturers (VAMM) said that motorbikes are a popular means of transportation for people in many countries around the world, especially developing countries, including Vietnam. Along with the growth rate of the market, the motorbike manufacturing industry also faces the problem of counterfeit goods, imitation goods, and goods that violate intellectual property rights such as electric vehicles, motorbikes, and motorbike spare parts.
This is a very painful situation not only for consumers but also for manufacturers.
Notably, according to Ms. Dai Kha Quynh, the business of counterfeit goods not only exists in traditional markets but also appears on e-commerce platforms.
A representative of Binh Tay Import Export Joint Stock Company also said: “Currently, the company is the exclusive distributor of Casio computers in Vietnam. Casio brand products from Japan are being counterfeited and imitated very sophisticatedly.”
How to stop counterfeit goods?
To prevent counterfeit goods, Vietnamese authorities have introduced many solutions and initially achieved certain results, such as organizing monitoring and raiding warehouses with signs of counterfeit goods, signing commitments with trading floors to prevent counterfeit goods, raising awareness among consumers through opening showrooms displaying genuine and counterfeit goods, etc.
However, the problem of counterfeit goods is still a serious one. In particular, preventing counterfeit goods sold through e-commerce is facing many difficulties.
Emphasizing that preventing counterfeit goods is one of the key tasks in the coming time, Mr. Nguyen Thanh Binh said: "In the coming time, the Market Management force will strengthen inspection and handling of cases of selling counterfeit goods, poor quality goods, and violations of intellectual property rights on e-commerce platforms.
At the same time, research and deploy solutions to protect consumer rights such as product origin tracing systems to combat counterfeit and fake goods, build online brands and market products in the electronic environment.
According to Ms. Dai Kha Quynh, preventing counterfeit goods is the responsibility of departments, branches and market management. However, consumer awareness is the most effective measure.
Genuine products in the auto and motorbike spare parts industry in particular and other goods in general all have the following characteristics: packaging and boxes of genuine auto and motorbike spare parts are carefully and neatly packaged with full information of the manufacturer such as brand, product code, price...;
Barcodes and barcode labels have full information according to legal regulations, with QR codes for consumers to easily trace the origin of goods.
Additionally, counterfeit goods may have characteristics such as the part number/barcode and the part name on the label matching, but the actual product does not match the name on the label.
Color, material, finishing… of the product compared to fake products, genuine products have better materials, higher finishing in paint color and details.
For example, the cutting edges or welds are neat and sharp, the paint is even and of high quality, the manufacturing materials meet standards...
A representative of Binh Tay Import Export Joint Stock Company also said that consumers need to be smart to distinguish through the anti-counterfeit stamp and the serial number printed on the body of the device that matches the serial number printed on the warranty card. Notably, counterfeit products are often cheaper than genuine products sold on the market, so users need to consider.
