The provincial THADS Department organized the enforcement of the Thanh Hoa Private Primary and Secondary School Project Area, Quang Trung Street, Dong Huong Ward (Thanh Hoa City) of Tay Do Company Limited.
With the determination to improve the quality and effectiveness of the enforcement work, especially to completely resolve cases with conditions for enforcement, judgments related to bank credit, business, and commerce with large monetary value, the Provincial Enforcement Department has proactively disseminated thoroughly, fully, and promptly the directives, resolutions, and guiding documents of the Central Government, the province, and the industry on enforcement work to the staff and civil servants in the enforcement agencies at 2 levels. The focus is on the Law on Civil Judgment Enforcement, Resolution No. 96/2019/QH14 dated November 27, 2019 of the National Assembly on "Crime prevention and control and law violations, work of the People's Procuracy, People's Court and civil judgment enforcement", Decision No. 17/QD-TTg dated January 13, 2023 of the Prime Minister approving the Project "Improving the quality and effectiveness of civil judgment enforcement for business and commercial judgments and decisions in the period 2023-2028", Resolution No. 23-NQ/BCSĐ dated March 29, 2022 of the Party Committee of the Ministry of Justice on "Leading the implementation of key civil judgment enforcement tasks, monitoring civil judgment enforcement in the period 2022-2026".
Based on the decision of the Minister of Justice on the key work program in the field of THADS, monitoring THAHC in 2024 and the targets and tasks assigned by the General Department of THADS, proactively develop an annual work plan as a basis and target for the industry. At the same time, assign targets and tasks to THADS sub-departments of districts, towns, cities and specialized departments under the Provincial THADS Department. Along with that, the Provincial THADS Department focuses on innovating professional and technical activities in THADS work. Along with the establishment of working groups to directly monitor and direct THA cases with large amounts of money and unsuccessful auctions, the Provincial THADS Department focuses on directing the review, verification and accurate classification of THA cases, especially judgments and decisions related to credit and banking in the province to have specific solutions. At the same time, carry out early asset seizure for cases with collateral and eligible for seizure. For newly accepted cases, immediately verify and take appropriate enforcement measures to avoid being passive. On the other hand, the Provincial Department of Enforcement of Civil Judgments requires district-level enforcement agencies to proactively advise the Party Committee, authorities and steering committees of enforcement of civil judgments of districts, towns and cities to lead and direct the settlement of complicated cases in a thorough and lawful manner. In particular, promote the responsibility of the head of the enforcement agency in speeding up enforcement of cases that are eligible for enforcement and pending cases. The Provincial Department of Enforcement of Civil Judgments continues to thoroughly educate the staff in the sector to uphold their sense of responsibility, proactively overcome difficulties and obstacles arising in the process of performing their tasks and focus on resolving each case effectively.
Thanks to the "fundamental" solutions and the application of many new methods directed by the Provincial Department of Enforcement, in 2024, the enforcement work of the enforcement agencies in the province has had many clear changes. In the past year, the provincial enforcement agencies reviewed and identified 21,275 cases requiring enforcement. Of which, 16,767 were proactive enforcement decisions; 4,508 were enforcement decisions upon requests from citizens, organizations, and enterprises. Through classification, the total number of cases eligible for enforcement was 16,672, with the amount to be resolved of more than 1,504.7 billion VND. From the results of verification and classification, the provincial enforcement agencies have completed 14,467 cases, corresponding to the amount resolved of 936.923 billion VND. The above THA results are 255 jobs and 552,635 billion VND higher than in 2023 and compared to the plan assigned by the General Department of THADS, in terms of work, it reached 103.67% of the plan, ranking 14/63 provinces and cities nationwide; in terms of money, it reached 130% of the plan, ranking 12/63 provinces and cities nationwide and ranking 2nd in the North Central region. In particular, THADS agencies have done a good job of governmental mass mobilization, by successfully persuading people who must THA voluntarily complete 14,194 jobs out of the total number of jobs to be executed and not having to organize forced THA enforcement. Specifically, the revenue for the State budget is 115,681 billion VND, an increase of 54,652 billion VND compared to 2023; Collected for credit institutions and banks is more than 361,441 billion VND, an increase of 92,597 billion VND compared to 2023; recovered assets appropriated and lost in criminal cases of corruption and economic crimes is 41,407 billion VND...
On the other hand, the provincial THADS agencies continue to effectively carry out the THAHC work. Accordingly, the People's Courts at all levels have transferred 10 decisions to THAHC agencies at level 2. In line with the assigned tasks, THADS agencies have monitored 10/10 cases and publicly posted them, and organized meetings with people who must execute the judgments. By the end of 2024, THADS agencies have completed 7 cases, the remaining 3 cases are in the process of being resolved. In addition, State administrative agencies and competent persons in State administrative agencies in the province must execute 94 judgments. As a result, 60 cases have been executed, and 34 cases have not been executed.
The results of resolving the cases are evidence of clear changes in the quality and effectiveness of the THADS work of the provincial THADS agencies. Through THADS work, the rights and interests related to the State, the People and organizations and enterprises have been promptly protected, contributing positively to ensuring social order and safety, and socio-economic development of districts, towns and cities in the province.
