DNO - On October 5, the Department of Construction coordinated with the Academy of Construction and Urban Management Officers (Ministry of Construction) to organize a conference to disseminate and train the implementation of the 2023 Housing Law, the 2023 Real Estate Business Law and documents detailing these laws for officials, civil servants and public employees working at departments, branches, localities and banks, real estate businesses, management boards and apartment building management and operation units in Da Nang city.

Speaking at the conference, Deputy Director of the Department of Construction Tran Van Hoang emphasized that the Housing Law 2023 and the Real Estate Business Law 2023, which will take effect from August 1, 2024, have resolved many existing issues related to housing policies and the real estate market; institutionalized the Party and State's policies and guidelines on housing and the real estate market; overcome shortcomings and overlaps, ensuring consistency between legal documents; and strengthened decentralization and delegation of authority in State management of the implementation of housing and real estate projects.
Implementing the provisions of the Housing Law 2023 and the Real Estate Business Law 2023, the Department of Construction of Da Nang City is advising the City People's Committee to issue a number of legal documents such as: price framework for management, operation and exploitation of apartment buildings; regulations related to investment in construction of multi-apartment buildings...
The conference to disseminate and train on the implementation of the Housing Law 2023 and the Real Estate Business Law 2023 is also an opportunity for trainees to focus on studying and exchanging with experts, officials from the Ministry of Construction and experienced officials about new regulations as well as policies to remove obstacles and difficulties in the housing sector and the real estate market, in order to deploy and implement regulations well, promoting socio-economic development.
Deputy Director of the Department of Housing and Real Estate Market Management (Ministry of Construction) Nguyen Manh Khoi said that the Prime Minister and the Government are very interested in directing the synchronous implementation of the Housing Law 2023, the Real Estate Business Law 2023 and the propaganda, dissemination and training work to implement these legal policies to quickly bring the two laws into life, creating a driving force to promote socio-economic development.
To implement the two laws on Housing and Real Estate Business, up to now, the Government has issued 5 decrees and the Ministry of Construction has issued 2 circulars detailing these two laws.
Specifically, the Government issued Decree No. 95/2024/ND-CP dated July 24, 2024 detailing a number of articles of the Housing Law; Decree No. 98/2024/ND-CP dated July 25, 2024 detailing a number of articles of the Housing Law on renovation and reconstruction of apartment buildings; Decree No. 100/2024/ND-CP dated July 26, 2024 detailing a number of articles of the Housing Law on development and management of social housing.
Decree No. 94/2024/ND-CP dated July 24, 2024 detailing a number of articles of the Law on Real Estate Business on the establishment and management of information systems and databases on housing and the real estate market; Decree No. 96/2024/ND-CP dated July 27, 2024 detailing a number of articles of the Law on Real Estate Business.
The Ministry of Construction issued Circular No. 05/2024/TT-BXD dated July 31, 2024 detailing a number of articles of the Housing Law; Circular No. 04/2014/TT-BXD dated July 30, 2024 providing guidance on the framework program for training and fostering knowledge of real estate brokerage practice and real estate transaction management.
From August 1, 2024, the two laws and detailed regulations mentioned above have come into effect.
“Except for some regulations that have been transferred, the remaining detailed regulations and implementation instructions of the two laws are encapsulated in the above-mentioned five decrees and two circulars, making it convenient for officials, civil servants, public employees, businesses, and people to look up, apply, and implement in practice,” Mr. Nguyen Manh Khoi emphasized.
Nguyen Thi Thanh Huong, Director of the Information and Magazine Center of the Academy of Construction and Urban Management (Ministry of Construction) shared that the two laws on Housing and Real Estate Business, along with five decrees and two circulars that have been issued and have come into legal effect, are the basis for provinces and cities to issue decisions within their authority, contributing to the completion of legal documents in order to soon bring newly issued laws into life.
In particular, the two laws and their detailed regulations and implementation guidelines have overcome shortcomings and limitations, especially in land valuation, land acquisition, compensation, and resettlement support. At the same time, they have created a synchronous legal corridor, liberated land resources, promoted the healthy development of the real estate market, and accelerated the implementation of investment projects...
Through this conference, members will grasp and understand more clearly the regulations, especially new points to facilitate implementation in practice, thereby contributing to promoting the socio-economic development of Da Nang city.
