On September 11, 2024, the Government issued Decree No. 112/2024/ND-CP detailing regulations on rice cultivation land. This decree clearly outlines policies to support the protection of rice cultivation land; investment, investment support, infrastructure development, and the application of modern science and technology in planned high-yield, high-quality rice cultivation areas.

New regulations on the management and use of rice-growing land.

An additional 321 billion VND has been allocated to protect and develop rice-growing land.

According to the Decree, the State budget will provide support of VND 1,500,000/ha/year for land exclusively used for rice cultivation; and VND 750,000/ha/year for other rice-growing land.

Support local rice production.

According to the Decree, the State budget will provide support of VND 1,500,000/ha/year for land exclusively used for rice cultivation; and VND 750,000/ha/year for other rice-growing land, excluding upland rice fields that have been expanded spontaneously without adhering to the land use plan for rice cultivation.

In addition, an extra subsidy of VND 1,500,000/ha/year will be provided for land exclusively used for rice cultivation in planned areas with high yield and quality.

Accordingly, the use of funds from land allocated or leased by the State for non -agricultural purposes from land specifically designated for rice cultivation, as stipulated in Clause 1, Article 12, and state budget funds supporting rice production in the local budget balance as stipulated in Clause 1, Article 14 of this Decree, shall be determined by the Provincial People's Committee and submitted to the Provincial People's Council based on the actual conditions of the locality. The Provincial People's Council shall decide on the specific principles, scope, support levels, and use of support funds for the following activities:

Support for rice farmers includes: using legally registered rice varieties for production; applying production processes, technical advancements, and technologies recognized by competent state agencies; building demonstration models; conducting agricultural extension activities; organizing training, workshops, and production and product consumption linkages; improving and enhancing the quality of rice-growing land; assessing physical and chemical properties; creating agricultural and soil maps of rice-growing areas every 5 years; repairing, maintaining, and repairing agricultural and rural infrastructure in the commune; and supporting the purchase of protected rice variety rights.

This includes investment policies, support for infrastructure development, and the application of modern science and technology to planned rice-growing areas with high productivity and quality.

According to the Decree, the State invests in infrastructure development from the central budget's supplementary targeted allocation to localities in accordance with the principles, criteria, and allocation norms of public investment capital from the state budget for each medium-term period issued by competent authorities, prioritizing investment in irrigation and transportation projects in areas planned for high-yield, high-quality rice cultivation; the process and procedures shall comply with the law on public investment.

Investment support for businesses

According to the Decree, enterprises are eligible for up to 100% state budget support when investing in the construction of irrigation and transportation infrastructure in areas planned for high-yield, high-quality rice cultivation.

The project applies to certified greenhouse gas emission reduction rice production processes; projects applying circular economy models; certified organic production projects; and projects linking rice production along the value chain.

Projects for processing food products; projects for producing biological preparations; and projects for processing raw materials and high-tech products from rice and rice by-products that comply with legal regulations on high technology.

The Decree states that projects as stipulated in point (i) above must have an area of ​​500 hectares or more, and projects as stipulated in point (ii) with a total investment of 30 billion VND or more will receive state budget support of up to 40%, but not exceeding 15 billion VND/project, for the purchase of production lines, equipment, technology, and technology copyrights.

Funding sources, target groups, support processes, and procedures for implementing support shall comply with the Government's regulations on policies to encourage businesses to invest in agriculture and rural areas.

Funding sources and support procedures for economic organizations with foreign investment capital are implemented according to separate legal regulations.

Investment support for cooperatives and cooperative unions.

According to the Decree, investment projects for infrastructure development in areas planned for high-yield, high-quality rice cultivation will utilize state policies as guided by the Government's regulations detailing the implementation of certain articles of the Law on Cooperatives.

Cooperative societies and cooperative unions may collaborate to implement one of the following projects in planned high-yield, high-quality rice cultivation areas: projects applying certified greenhouse gas emission reduction rice production processes; certified organic production projects; or projects linking rice production along the value chain.

Projects for the production and processing of food products; projects for the production of biological products and the processing of raw materials for high-tech products from rice and rice by-products.

The draft clearly states that projects as stipulated in point (iii) must have an area of ​​100 hectares or more, and projects as stipulated in point (iv) will receive maximum support from the State for 100% of the investment capital for infrastructure construction, procurement of production lines, equipment, technology, and technology copyrights, but not exceeding 5 billion VND/project.

The forms of support, the level of support, regulations on support from public investment capital, the process of compiling support needs, the methods of implementing support, and the post-investment management mechanism shall comply with the provisions of the Law on Cooperatives and guiding documents on policies supporting investment in infrastructure and equipment development.

Projects as stipulated above are eligible for one-time state support. If a project or a component of a project has already received state budget support under this Decree, it is not eligible for further state budget support under other laws, and vice versa.
