On the morning of November 9th, Mr. Nguyen Kim Son, Minister of Education and Training , representing the Government, presented the draft Law on Teachers to the National Assembly. The draft law introduces many new points regarding salary policies and retirement age for teachers.
Teacher salary policy
According to Minister Nguyen Kim Son, with the promulgation of the Law on Teachers, teachers in public educational institutions are special civil servants, enjoying all the rights and policies applicable to civil servants within the legal system, and also benefiting from some specific policies to provide them with better opportunities for development.
"The State has a policy to attract highly qualified people, talented individuals, outstanding graduates, young scientists , and people with special aptitudes to participate in recruitment as teachers; and to have teachers work in particularly difficult areas inhabited by ethnic minorities, mountainous regions, coastal areas, and islands," Mr. Son said.
Referring to the new points, the Minister said that, compared to current regulations, the draft Law on Teachers has standardized the teaching staff through a system of job titles and professional standards for teachers.
Teachers in non-public educational institutions are treated equally with teachers in public educational institutions in terms of identification, professional standards, basic rights and obligations, and certain policies such as training, professional development, recognition, rewards, and handling of violations.
In addition, teachers' salaries will be prioritized. The basic salary, according to the teacher salary scale, will be the highest in the administrative and public service salary system. Teachers will also receive professional incentive allowances and other allowances depending on the nature of their work and the region, as stipulated by law.
Furthermore, according to Minister Son, teachers will continue to receive seniority allowances until the salary policy under Resolution 27-NQ/TW is implemented.
For preschool teachers; teachers working in particularly difficult areas such as ethnic minority regions, mountainous areas, coastal areas, and islands… are given priority in terms of higher salaries and allowances compared to other teachers.
For newly recruited teachers, the initial salary increase is one level higher in the administrative and public service salary scale system.
Regarding the retirement age for teachers, the Minister of Education and Training stated that there will be separate regulations tailored to the specific characteristics of the profession. Specifically, teachers in preschools, if they so wish, may retire at a younger age, but not more than 5 years younger than the prescribed age, and their pension will not be reduced due to early retirement.
Teachers holding the titles of professor, associate professor, or doctoral degree, as well as teachers working in specialized fields, are entitled to retire at a higher age.
Consideration of salary policies for teachers in private schools.
Regarding the review of salaries and allowances for teachers, Mr. Nguyen Dac Vinh, Chairman of the Committee on Culture and Education, stated that the Committee agrees with the regulations in the draft Law and considers this an important and necessary content to promptly institutionalize the Party's policies. The reviewing body also endorses the preferential policies, support, and incentives to attract teachers as stipulated in the draft law.
However, according to Mr. Vinh, there are suggestions to study and implement the Party's Resolution on salary policy reform in accordance with its spirit; and to consider regulating salary policies for teachers in the non-public sector.
This opinion also suggests not revising the policy on renting public housing already stipulated in the Housing Law; conducting a thorough impact assessment to ensure feasibility, especially regarding the resources for implementing the policy of ensuring collective housing for teachers working in rural areas.
Regarding the retirement scheme for teachers, the Committee agreed that teachers in preschools can retire at a younger age (no more than 5 years younger) than stipulated in the Labor Code and will not have their pension reduced for early retirement. However, some opinions suggested that a thorough assessment of the resources needed to ensure the implementation of this policy is necessary.
Regarding training and professional development, the Committee generally agrees with the regulations on training and professional development for teachers, without distinction between teachers in the public and private sectors.
However, according to Mr. Vinh, there are suggestions to clearly define the State's responsibility in paying the training costs for teachers when they are sent to participate in training programs.
