People with a car driving license are exempt from the motorbike theory test.

From March 2025, when testing for a driver's license, candidates will be able to take all 4 exams. If they pass, their scores will be retained, and if they fail, they will have to retake the exam for the failed exam.

The above regulation is according to Circular 12/2025/TT-BCA, dated February 28, 2025, of the Ministry of Public Security on testing, granting driving licenses; granting and using international driving licenses. This Circular takes effect from March 1, 2025. Compared to Circular 35/2024/TT-BGTVT of the Ministry of Transport (now the Ministry of Construction) regulating training, testing, granting driving licenses; granting and using international driving licenses; training, testing, and granting certificates of training in road traffic law knowledge, Circular 12/2025/TT-BCA has many new regulations.

Many notable new points

Accordingly, the driving test content for classes A1, A, B1 stipulated in Article 12, Circular 12/2025/TT-BCA includes theory and practice in the picture. Candidates who pass the theory test or practice driving in the picture will have their test results reserved for 1 year. Candidates who do not pass the theory test will continue to take the practice driving test in the picture. Meanwhile, the driving test content for all classes of cars includes: Theory, simulation, driving in the picture and driving on the road. Candidates will be able to take all 4 contents. The passed contents will be reserved for 1 year; the unpassed part can be re-registered. Candidates can register to take the test in any locality after graduating from a driving training course with a training certificate issued by a driving training facility.

Notably, Clause 1, Article 4, Circular 12/2025/TT-BCA states: "Candidates taking the A1 and A driving test with a valid car driving license are exempt from the theory test". Specifically, class A1 is granted to drivers of 2-wheeled motorbikes with a cylinder capacity of up to 125cm3 or an electric motor capacity of up to 11 kW; class A is granted to drivers of 2-wheeled motorbikes with a cylinder capacity of over 125cm3 or an electric motor capacity of over 11kW and types of vehicles specified for class A1 driving licenses. Previously, Circular 35/2024/TT-BGTVT stipulated that the theory test for class A1 driving licenses (up to 175cm3) is exempted if the candidate has a car driving license. Candidates registering for an A2 driving license (over 175cm3) will not be exempted from the theory test.

With the above changes in the driving license testing, many people are happy because they will no longer be "bound". Mr. Huynh Van Hong (residing in Hoa Binh commune, Cho Moi district) said that many of the above regulations are beneficial to the people. The best regulation is that even if you fail this test, you can still take the other tests. This helps test takers save a lot of effort and time, because each time they take the test, they have to take a practice test many times. Mr. Le Thanh Ha (residing in Vinh Trach commune, Thoai Son district) is very excited because the State has flexible regulations in testing for driving licenses. "Thus, when I complete the theory test at a center in Thoai Son district, I can bring my application to register for the test in Long Xuyen city or anywhere I want. This helps people take the initiative in time and space" - Mr. Ha said.

Regarding the time limit for issuing a driving license, in Article 19 of Circular 12/2025/TT-BCA, the Traffic Police Department issues a driving license to those who pass the test within 7 working days from the end date of the test. The electronic driving license is integrated into the electronic data system and electronic identification account within 3 working days from the end date of the test. Previously, in Circular 35/2024/TT-BGTVT, it was stipulated that the time limit for issuing a driving license is no later than 10 days from the end date of the test and the person who passed the test has completed the obligation to pay the driving license fee.

In response to people's questions about whether private driving schools are currently qualified to operate after the transfer of the task of testing, issuing, and exchanging driving licenses from the Ministry of Transport to the Ministry of Public Security, a representative of the Traffic Police Department informed that the training work for testing, issuing, and exchanging driving licenses is currently socialized and managed by the Ministry of Transport. After March 1, 2025, it will be managed by another agency assigned by the Government. Regarding the task of testing, issuing, and exchanging driving licenses, the Ministry of Public Security received it from the Ministry of Transport and assigned the traffic police force to be responsible for testing, issuing, and exchanging driving licenses. "Basically, for now, we will keep the current status of the data system and software for managing testing, issuing, and exchanging driving licenses of the transport sector. We will organize testing, issuing, and exchanging driving licenses for people according to regulations after receiving it," a representative of the Traffic Police Department informed.
