The organization of government is appropriate to the nature of managing a large city.
Presenting the Report on the draft Resolution, Minister of Home Affairs Pham Thi Thanh Tra said that Hai Phong city is a centrally-governed city, a key economic development center (especially marine economy) of the Northern region and the whole country; an educational, medical and scientific and technological center of the Northern coastal region, an important traffic hub, connecting international maritime traffic routes; located in the development triangle of Hanoi - Hai Phong - Quang Ninh.
Identifying the important role and position of Hai Phong city, on January 24, 2019, the Politburo issued Resolution No. 45-NQ/TW on the construction and development of Hai Phong city to 2030, with a vision to 2045, which identified specific goals by 2025: "Building an urban government with a streamlined apparatus, operating effectively and efficiently"; by 2030, "Basically meeting the criteria of a special-class urban area. The urban government is built and perfected in accordance with the requirements of a smart city".
After more than 5 years of implementing the Resolution, the City has achieved important achievements and results in socio-economic development and ensuring national defense and security, and people's lives have been increasingly improved. However, the current local government organization model is not suitable for the characteristics and nature of managing a large urban area, does not meet the development requirements of the City in the new period, affecting the effectiveness and efficiency of state management in a dynamically developing area.
According to Minister Pham Thi Thanh Tra, the Draft Resolution has 10 articles with the following basic contents: On the model of urban government organization in Hai Phong city; Tasks and powers of local authorities when organizing urban government; On the organizational structure of the People's Council and People's Committee; On the tasks and powers of specialized agencies, district-level People's Committees, and public service units; On cadres and civil servants working in wards, communes, and towns.
In particular, regarding the model of urban government organization in Hai Phong city: Local government in districts and wards in Hai Phong city is the People's Committee of the district and ward and is the state administrative agency in the district and ward (not organizing the People's Council of the district and ward). The organization of local government in Hai Phong city and other administrative units of Hai Phong city has the People's Council and the People's Committee according to the provisions of the current Law on Organization of Local Government.
Regarding the tasks and powers of local authorities when organizing urban government: Clearly define the tasks and powers of local authorities in cities, districts, Thuy Nguyen city and wards to ensure full implementation of the tasks and powers of state agencies, in accordance with the urban government organization model, meeting the requirements of urban development, better serving the needs of people, organizations and businesses.
At the same time, the draft Resolution also transfers the functions, tasks and powers of the District People's Council and Ward People's Council previously implemented to the People's Council, People's Committee, Chairman of the People's Committee of Hai Phong City; People's Committee, Chairman of the District People's Committee; People's Council, People's Committee, Chairman of the People's Committee of Thuy Nguyen City and Ward People's Committee; and at the same time, adds a number of tasks and powers to these agencies (similar to what Ho Chi Minh City and Da Nang are implementing) to ensure conformity with the urban government organization model.
It is necessary to submit a Resolution to the National Assembly.
Reviewing the draft Resolution, Chairman of the Law Committee Hoang Thanh Tung said that the Law Committee agreed with the need to submit to the National Assembly for consideration and promulgation of a Resolution on the organization of urban government in Hai Phong city. The draft Resolution dossier meets the requirements as prescribed and is eligible to be submitted to the National Assembly for consideration.
Regarding the scope of regulation, the Law Committee proposed that the Resolution only focus on regulating the model of urban government organization in Hai Phong city. Other contents related to specific mechanisms and policies that are different from the provisions of the law and are being piloted in other localities should be regulated in the Resolution on piloting a number of specific mechanisms and policies for the development of Hai Phong city that the Government is planning to propose to amend and supplement in the coming time to ensure compliance with the requirements of the Politburo and the provisions of the Law on Promulgation of Legal Documents.
Regarding the specific contents of the draft Resolution, the Law Committee basically agrees with the organization of the urban government model in Hai Phong city; agrees with the strengthening of the apparatus, increasing the number of full-time People's Council delegates for the City People's Council; agrees with the transfer and addition of some authorities to the City People's Council to strengthen capacity, ensuring full implementation of the tasks and powers of local government in the context of not organizing People's Councils of districts and wards.
Regarding the People's Committee and the Chairman of the People's Committee of the City, the Law Committee requested the drafting agency to continue reviewing and revising a number of regulations on specific tasks and powers of the People's Committee and the Chairman of the People's Committee to ensure appropriateness and accuracy. Accordingly, it is recommended to carefully consider the regulation assigning the People's Committee of the City to decide on transferring a number of functions, tasks and powers according to the provisions of law under the functions, tasks and powers of specialized agencies under the People's Committee of the City to other specialized agencies and administrative agencies under the People's Committee of the City, People's Committees of districts, towns and cities under the City (Point d, Clause 1, Article 3) to ensure the principle of decentralization, delegation of authority and ensure consistency with the provisions in legal documents of central state agencies;...
