National Assembly Chairman Tran Thanh Man signed to certify Resolution No. 193/2025/QH15 "On piloting a number of special mechanisms and policies to create breakthroughs in the development of science, technology, innovation and national digital transformation."
This Resolution applies to domestic organizations and individuals; foreign organizations and individuals participating in science, technology, innovation and national digital transformation activities in Vietnam and other relevant organizations and individuals.
Public scientific and technological organizations and public higher education institutions are established, participate in establishing enterprises, and contribute capital to enterprises to commercialize scientific research and technological development results owned or assigned to manage and use by such organizations.
With the consent of the head of the organization, officials and managers working at public science and technology organizations and public higher education institutions are allowed to contribute capital, participate in the management and operation of enterprises, work at enterprises established by that organization or participate in the establishment to commercialize research results created by that organization.
In case the management officer is the head of a public science and technology organization or public university, he/she must have the consent of the direct superior.
Regarding risk acceptance in scientific research and technological development, the Resolution stipulates: Organizations and individuals engaged in scientific research and technological development activities are exempted from civil liability when causing damage to the State in the process of performing scientific and technological tasks using the state budget when they have fully implemented relevant procedures and regulations in the process of implementing scientific research and technological development activities.
The organization in charge of implementing a scientific and technological task using the state budget during the implementation process has fully implemented the regulations on management of scientific and technological tasks, the research process and content have been explained but have not achieved the expected results, it does not have to refund the funds used.
The Resolution clearly states: The central budget is used to invest, purchase, lease, maintain, operate, and maintain digital platforms and information systems at national and regional scales for central and local agencies and organizations to use and exploit together to serve socio-economic development, ensuring efficiency and avoiding waste. The process and procedures for allocating funds for investment, purchase, lease, maintenance, operation, and maintenance of digital platforms and information systems at national and regional scales for common use by agencies and organizations are in accordance with the provisions of law.
This Resolution takes effect from the date of its approval by the National Assembly (February 19, 2025).
In case there are different provisions on the same issue between this Resolution and other laws or resolutions of the National Assembly, the provisions of this Resolution shall apply.
In case other legal documents provide for preferential or more favorable mechanisms and policies than this Resolution, the beneficiaries shall be entitled to choose to apply the most favorable incentive level./.
