Continuous detection of violations

In 2024, the provincial Market Management force deployed many measures and developed plans to inspect and control against acts of intellectual property infringement, counterfeit goods and commercial fraud. Through market inspection and control, the Market Management Department discovered many cases with signs of trading in prohibited goods, counterfeit goods, and intellectual property infringement.

In the first quarter of 2024, the provincial Market Management force discovered and fined the Son Tung fashion clothing store in Minh Xuan ward (Tuyen Quang city) for trading in counterfeit goods of famous brands. At this facility, the Market Management force confiscated the violating products and imposed a fine of VND 25 million. Of which, a fine of VND 10 million was imposed for trading in counterfeit goods and VND 15 million was imposed for trading in goods that infringe intellectual property rights on the internet.

On May 20, Market Management Team No. 5, Market Management Department of Tuyen Quang province coordinated with the Economic Police Department - Provincial Police to inspect the store of Nguyen Huu Duong business household, Tan Phu residential group, Son Duong town (Son Duong). Through inspection, the store was selling 461 products including helmets, ready-made clothes of all kinds and socks with signs of counterfeiting the trademarks of Louis, Chanel, Gucci, Nike, Adidas, which are protected trademarks in Vietnam. The value of the goods according to the listed price at the store at the time of inspection was more than 43 million VND. Market Management Team No. 5 temporarily detained all 461 violating products and imposed a fine of 45 million VND.

Most recently, on June 11, Market Management Team No. 1, Market Management Department of Tuyen Quang province issued a decision to sanction Toan Phat Technology Trading Company Limited, Group 9, Doi Can ward, for committing an administrative violation of using the announced logo to attach to the e-commerce website or sales application without approval or confirmation of the notification of the competent State agency as prescribed; not notifying the e-commerce website or sales application to the competent State management agency as prescribed before selling goods or providing services to consumers.

Resolutely handle violations

According to the assessment of the Market Management Department of Tuyen Quang province, the situation of smuggling, trading in banned goods, counterfeit goods, smuggled goods and trade fraud in the province still occurs at times and in some places, but there are no hot spots or prominent points because Tuyen Quang is a province without borders and without large production and processing areas. Smuggled and counterfeit goods are mainly brought from other provinces by passenger vans and trucks and then broken down and brought to small businesses and market stalls in remote communes.

Subjects use social networks, online apps on mobile phones, computers to do business, without a clear business location, use express delivery services, shippers... to avoid inspection by authorities. It is forecasted that in the last 6 months of 2024, the situation of smuggling, trading in counterfeit goods, and commercial fraud will become more complicated. Especially at the end of 2024 and before, during, and after the Lunar New Year 2025.

Faced with the above situation, Director of the Market Management Department of Tuyen Quang Province Le Manh Thao said that the provincial Market Management force focused on doing a good job of basic investigation, grasping the market situation, making a list of subjects and establishments with signs of suspected smuggling, trade fraud and counterfeit goods; warehouses and yards storing smuggled goods, detecting urgent issues to have timely solutions. At the same time, the Department has coordinated with agencies such as the Provincial Police, the Department of Health, the Department of Agriculture and Rural Development of the province... to carry out the fight against smuggling, counterfeit goods, poor quality goods, food safety violations and trade fraud.

Notably, since the beginning of the year, the Provincial Market Management Department has inspected the gold market and discovered 16 establishments in the province violating regulations on product labeling. The total fine is 189 million VND. Regarding the petroleum market, the Department has coordinated with relevant sectors to regularly inspect and check petroleum stores. In 2024, no petroleum stores have been found to be in violation. According to the report of the Market Management Department of Tuyen Quang province, in the first half of 2024, the whole province inspected and handled 211 cases of counterfeit goods, goods infringing intellectual property rights, and goods of unknown origin, collecting more than 1.2 billion VND to the State budget. The value of goods that are evidence of administrative violations subject to remedial measures and forced destruction of goods is 725 million VND. The value of goods that are evidence of administrative violations confiscated pending processing is nearly 500 million VND.

On the side of the Department of Industry and Trade, the unit continues to promote the campaign "Vietnamese people prioritize using Vietnamese goods" in conjunction with activities responding to "Vietnamese Consumer Rights Day" to promote and mobilize businesses and business establishments to provide transparent information, consumers to choose safe consumption, the Law on Protection of Consumer Rights has been issued by the National Assembly, according to the plan from July 1, 2024 will take effect. Accordingly, consumers have the rights, responsibilities, and obligations to protect their own rights and the community's rights.

The Provincial Market Management Department recommends that if people discover organizations or individuals committing violations related to smuggled goods, production and trade of counterfeit goods, or goods of unknown origin, they can contact the hotline number of the Standing Office of the Provincial Steering Committee 389 at 0915 096 626 to report to the authorities.
