In the past time, the three judicial branches, namely the police, the People's Procuracy (PS) and the People's Court (TAND) in the province have regularly led, directed and organized the serious and effective implementation of coordination contents in the work of investigation, prosecution, trial and execution of criminal sentences.
According to Chief Justice of the Provincial People's Court Nguyen Thi Nga, in recent years, the quality and effectiveness of coordination in investigation, prosecution, trial and execution of judgments between judicial agencies have been significantly improved, ensuring accuracy and compliance with the law. In particular, judicial agencies have promptly resolved difficulties in complicated cases, key cases, and cases of public concern. Especially in the process of implementing the coordination regulations, the work of receiving and handling denunciations and reports of crimes and the relationship in the investigation, prosecution and trial stages has helped to handle crimes in each sector in accordance with legal procedures, as well as promptly detect shortcomings to overcome, prevent wrongful convictions and avoid criminals from escaping.
The work of selecting and resolving typical cases of the three sectors was carried out in accordance with procedures and regulations. The process of adjudicating cases focused on improving the quality of questioning and debate in court in the spirit of judicial reform, carefully, objectively and comprehensively considering evidence to issue legal judgments and decisions... Particularly for the People's Court sector, in 2022 and the first 6 months of 2023, implementing the coordination regulations, People's Courts at all levels resolved over 11,000 cases, reaching a general resolution rate of 91.7%. In addition, criminal case work has always been focused on and there is close coordination between the prosecution agencies at all levels. During the trial process, the principle of not wrongfully convicting innocent people, not letting criminals escape, being cautious in assessing evidence, and focusing on litigation in court in the spirit of judicial reform must be ensured. The court's judgments are guaranteed to be in accordance with the law, with no judgments exceeding the statutory time limit. In particular, the trial is organized promptly and at the right time to meet the requirements of the fight against crime and effectively serve local political tasks.
Regarding the settlement of civil and administrative cases, the People's Courts at all levels have resolved them within their jurisdiction, ensuring the time limit and procedural procedures as prescribed by law, ensuring the legitimate rights and interests of citizens and organizations. Civil trials are always organized in accordance with the spirit of Resolution No. 08 of the Politburo, ensuring that litigants debate openly and democratically in court. In addition, the People's Courts at all levels also focus on and strengthen mediation work, creating conditions for the parties to reach agreement on the direction of case settlement, contributing to reducing conflicts and contradictions in interests and obligations of the parties.
For the police sector, during the implementation of the coordination regulations, investigation agencies at all levels have received nearly 4,000 denunciations, reports of crimes and recommendations for prosecution, of which 3,816 were directly handled, verified and resolved.
Particularly for the two-level People's Procuracy, in addition to receiving and handling denunciations and reports of crimes, the activities of initiating investigation and supervising investigation are also always closely monitored, contributing to improving the quality and speeding up the progress of investigation and case settlement. Thanks to that, the return of files for further investigation is limited. In the first 6 months of 2023, the two-level People's Procuracy accepted to exercise the right to prosecute and supervise investigation of 2,160 cases, 3,969 defendants; of which 1,259 new cases, 2,566 defendants were prosecuted.
Promoting the achieved results, in the coming time, the three judicial branches will continue to implement the regular meeting regime between the branches according to the regulations; promptly inform each other about the situation of criminal activities, difficulties and obstacles in the process of performing the tasks of each branch and promptly remove obstacles in investigation, prosecution, trial and execution of sentences; speed up the progress of resolving cases and incidents that have occurred. Proactively coordinate closely, improve the quality and effectiveness of investigation, prosecution, trial and execution of criminal sentences, minimize the return of files for additional investigation and re-investigation; investigate and handle the right people, the right crimes, and the law; try strictly, impose appropriate punishments to deter criminals...
