Timely and fully grasp the new points of the law that will take effect in 2025

(QBĐT) - From January 2025, many laws will come into effect, such as: Law on Road Traffic Order and Safety (TTATGT) 2024, Law on Notarization 2024, Law on amending and supplementing a number of articles of the Law on Property Auction 2024... In order to meet the need to learn about the law, especially new points that directly affect people's lives and activities, reporters of Quang Binh Newspaper had a discussion with Ms. Hoang Thi Le Hai, Head of the Department of Dissemination and LegalEducation (Department of Justice) about this content.

- Reporter: The Road Traffic Safety Law stipulates the points of the driving license and the age and health of the driver. Could you please elaborate on this content?

- Ms. Hoang Thi Le Hai: Pursuant to Article 58 of the law, driving license points are used to manage drivers' compliance with road traffic safety laws on the road traffic safety database system, including 12 points. The number of points deducted for each violation depends on the nature and severity of the violation of road traffic safety laws. Data on driving license points deducted by violators will be updated into the database system immediately after the penalty decision comes into effect and the person whose driving license points are deducted will be notified. Driving licenses that have not been deducted all points and have not been deducted points within 12 months from the date of the most recent point deduction will have all 12 points restored.

In case all points are deducted from the driving license, the driver is not allowed to drive a vehicle on the road. After at least 6 months from the date of deduction of all points, the driver is allowed to participate in the test on knowledge of road traffic safety laws as prescribed in Clause 7, Article 61 of this Law organized by the Traffic Police force. If the result is satisfactory, the full 12 points will be restored. After being changed, reissued, or upgraded, the driver's license will retain the same number of points as before the change, reissue, or upgrade. The person with the authority to handle administrative violations has the authority to deduct points from the driver's license.

Diversify popular forms to help more people and students access the law better.

Article 59 of the Road Traffic Safety Law clearly stipulates: People aged 16 and over are allowed to drive motorbikes; those aged 18 and over are granted driving licenses of class A1, A, B1, B, C1, and are granted certificates of training in road traffic law to drive specialized motorbikes on the road. People aged 21 and over are granted driving licenses of class C, BE; those aged 24 and over are granted driving licenses of class D1, D2, C1E, CE. People aged 27 and over are granted driving licenses of class D, D1E, D2E, DE. The maximum age of drivers of passenger cars (including buses) with more than 29 seats (excluding the driver's seat), sleeper cars is 57 years old for men and 55 years old for women.

Drivers of vehicles participating in road traffic must ensure health conditions appropriate to each type of vehicle they are allowed to drive. The Minister of Health shall prescribe health standards and health examinations for drivers, drivers of specialized motorbikes, etc. The Minister of National Defense and the Minister of Public Security shall prescribe the age of drivers in the Army and Police forces performing defense and security duties.

- Reporter: Many readers want to understand more clearly about the notary training time (for reduced cases). So how is the new point of the 2024 Notary Law on this content specifically regulated, madam?

- Ms. Hoang Thi Le Hai: Pursuant to Clauses 2 and 3, Article 11 of the Law, the cases that are eligible for notary training are reduced to 6 months, including: People who have worked for 5 years or more as judges, prosecutors, investigators, chief court examiners, intermediate bailiffs, chief civil judgment enforcement examiners, chief inspectors of the Procuracy, level II legal assistants, chief inspectors of the Judiciary, and chief specialists, chief legal officers, chief researchers, and chief lecturers in the legal field.

In addition, there are a number of other subjects, such as: Bailiffs, lawyers, auctioneers who have practiced for 5 years or more; professors, associate professors specializing in law, doctors of law. People who have been senior examiners of the Court, senior executors, senior examiners of civil judgment enforcement, senior inspectors of the Procuracy, first-class legal assistants, senior inspectors of the Judiciary; senior experts, senior legal practitioners, senior researchers, senior lecturers in the field of law.

- Reporter: Could you please tell us the necessary conditions to become an auctioneer?

- Ms. Hoang Thi Le Hai: Article 10 of the 2016 Law on Property Auction (amended and supplemented in Clause 6, Article 1 of the Law amending and supplementing a number of articles of the 2024 Law on Property Auction) stipulates that auctioneers must meet the following criteria: Being a Vietnamese citizen permanently residing in Vietnam, complying with the constitution and laws, having good moral qualities, having a university degree or higher in one of the following fields: law, economics , business administration, accounting, auditing, finance, banking. A person who has graduated from the auction training course prescribed in Article 11 of the 2016 Law on Property Auction, amended by Clause 6, Article 1 of the 2024 Law on Property Auction, and meeting the requirements for the auctioneer internship test.

To become an auctioneer, citizens must complete an auction training course (6 months), receive a certificate of completion from an auction training facility, and pass the auction internship test.
