Fines for unregistered vehicles in 2024, know or you will be fined

In fact, current regulations of the Road Traffic Law do not mention the concept of "Unregistered Vehicle". Meanwhile, Decree 100/2019/ND-CP stipulates penalties for the act of "not completing vehicle registration procedures" or is still understood by many people as the error of "Unregistered Vehicle".

According to Decree 100/2019/ND-CP, when people buy a car, receive it as a gift or a donation, they must complete the vehicle registration procedure (to transfer the vehicle owner's name in the vehicle registration certificate to their name) within 30 days from the date of vehicle transfer.

In case people do not transfer the name or ownership of the vehicle, they will be subject to administrative penalties as prescribed in Articles 30 and 80 of Decree 100/2019/ND-CP, as follows:

- Owners of motorbikes, scooters and similar vehicles who do not complete the vehicle registration procedure (to transfer the vehicle owner's name in the Vehicle Registration Certificate to their own name) as prescribed when purchasing, receiving a gift, being gifted, being allocated, being transferred, or inheriting property will be fined from 400,000 to 600,000 VND for individuals and from 800,000 to 1.2 million VND for organizations.

- Owners of cars, tractors, specialized motorbikes and similar vehicles that do not complete the vehicle registration procedure (to change the vehicle owner's name in the Vehicle Registration Certificate to their own name) as prescribed when purchasing, being given, being gifted, being allocated, being transferred, or inheriting property will be fined from 2 to 4 million VND if the violator is an individual and from 4 to 8 million VND for organizations.

Instructions for transferring motorbike ownership without the previous owner

People can transfer the ownership of a motorbike without the previous owner, similar to the steps in the procedure for "transferring ownership of a motorbike that has been transferred to many organizations or individuals".

According to Article 31 of Circular 24/2023/TT-BCA, the steps to transfer motorbike ownership without the old owner are as follows:

Step 1: Recall procedures

The person using the vehicle goes to the agency that is managing the vehicle registration file to complete the revocation procedure. Then, declare the revocation declaration form, the vehicle registration number on the public service portal. Next, provide the online file code and submit the paper file with the vehicle registration number and vehicle registration.

After confirming the valid documents, the vehicle registration authority issues a certificate of registration and license plate revocation.

In case the agency managing the records and the agency registering the vehicle transfer are the same, the person using the vehicle does not have to carry out the revocation procedure. Instead, they only need to submit the vehicle registration certificate and license plate when carrying out the transfer procedure.

Step 2: Transfer motorbike ownership without the previous owner

The person using the vehicle must complete the vehicle registration transfer procedure at the vehicle registration office where he/she is permanently or temporarily residing. The commune-level police where he/she resides shall carry out the motorbike registration transfer. The district-level police where he/she resides shall carry out the car registration transfer.

Vehicle transfer documents include: Vehicle registration declaration (clearly stating the purchase and sale process and commitment, taking responsibility for the legal origin of the vehicle), registration fee documents, registration revocation certificate, vehicle license plate (with a copy of the engine number and chassis number with the seal of the vehicle registration agency).

Step 3: The person who needs to transfer the vehicle name will receive an appointment paper within 30 days. The competent authority will verify the vehicle registration data.

Step 4: Receive vehicle registration results

After 30 days, if there is no dispute or complaint, the vehicle registration authority will issue a decision to impose a penalty for not completing the recall procedure and resolve the vehicle registration transfer for the person currently using the vehicle.
