According to the above decision, DNP Holding Joint Stock Company is operating in production and is subject to environmental licensing under the licensing authority of the Provincial People's Committee, but does not have an environmental license as prescribed.
The company was fined 320 million VND for administrative violations.
The additional penalty is to suspend the operation of the source of waste generation without an environmental license of the facility for a period of 4.5 months from the date of receipt of this penalty decision.
The remedial measure is to force DNP Holding Joint Stock Company to relocate to a location that is in accordance with the planning, environmental zoning, and environmental carrying capacity approved by competent authorities because it is not in accordance with the Dong Nai Provincial Planning for the period 2021-2030, with a vision to 2050 (because Bien Hoa 1 Industrial Park has been removed from the province's industrial park planning and is undergoing functional conversion). The implementation deadline is before December 1, 2025 (according to the roadmap set out in Decision No. 324/QD-UBND dated February 5, 2025 of the Provincial People's Committee Chairman on approving the Project to convert Bien Hoa 1 Industrial Park into an urban - commercial - service area and improve the environment).
Previously, the Chairman of the Provincial People's Committee issued a number of decisions on administrative sanctions against enterprises operating in Bien Hoa 1 Industrial Park. According to the decision, in addition to the form of administrative sanctions in the form of fines and additional penalties, the province requested the relocation of the facility to a suitable location because this industrial park is undergoing a change of function.
