The People's Council of Ha Tinh province has just issued a plan to conduct a vote of confidence and vote of no confidence for those holding positions elected by the Provincial People's Council for the 2021-2026 term. This content will be implemented at the end-of-year 2023 session of the Provincial People's Council (expected to be held from December 5-10, 2023).
According to the plan, the Provincial People's Council will take a vote of confidence for those holding positions elected by the Provincial People's Council before January 1, 2023 as prescribed in Clause 2, Article 2 of Resolution No. 96/2023/QH15, including: Chairman of the Provincial People's Council, Vice Chairman of the Provincial People's Council, heads of committees of the Provincial People's Council; Chairman of the Provincial People's Committee, Vice Chairman of the Provincial People's Committee, members of the Provincial People's Committee.
In case a person simultaneously holds multiple positions elected by the People's Council, the vote of confidence shall be conducted once for those positions. No vote of confidence shall be taken for a person holding a position who has announced his/her resignation pending retirement or has been elected or appointed in the year of the vote of confidence.
The vote of confidence and vote of no confidence are carried out in accordance with Resolution No. 96/2023/QH15 dated June 23, 2023 of the National Assembly and related documents.
Procedure for preparing for a vote of confidence
No later than October 20, 2023 (45 days before the scheduled opening date of the session), the Standing Committee of the Provincial People's Council shall review and plan a list of people to be voted on for confidence, and request those to be voted on for confidence to prepare a report and a declaration of personal assets and income.
No later than November 5, 2023 (30 days before the scheduled opening date of the session), the person whose vote of confidence is taken shall send a report and a declaration of personal assets and income to the Standing Committee of the Provincial People's Council for synthesis and sending to the Provincial People's Council delegates according to regulations.
No later than November 10, 2023 (25 days before the expected opening date of the session), the Provincial Fatherland Front Committee shall synthesize the opinions and recommendations of voters and people related to the person subject to the vote of confidence (if any) and send them to the Standing Committee of the Provincial People's Council.
No later than November 15, 2023 (20 days before the scheduled opening date of the session), the Standing Committee of the Provincial People's Council shall send the report of the person subject to the vote of confidence and the report summarizing the opinions and recommendations of voters and the People related to the person subject to the vote of confidence (if any) to the Provincial People's Council delegates; send the contents of the opinions and recommendations of voters and the People (if any) to the person subject to the vote of confidence.
In case it is necessary to clarify issues related to the person being voted for, no later than November 20, 2023 (15 days before the scheduled opening date of the session), the Provincial People's Council delegate shall send a document to the Standing Committee of the Provincial People's Council to request the competent authority to verify and respond in writing.
No later than November 25, 2023 (10 days before the date of the meeting to collect the vote of confidence), the Provincial People's Council delegates shall send a document to the Standing Committee of the Provincial People's Council and the person subject to the vote of confidence to request the person subject to the vote of confidence to clarify the contents of the basis for assessing the level of confidence.
No later than December 2, 2023 (3 days before the date of the meeting to collect the vote of confidence), the person whose vote of confidence is collected is responsible for sending an explanatory report (if any) on the issues raised in the report summarizing the opinions and recommendations of voters, the People and the opinions of the Provincial People's Council delegates to the Standing Committee of the Provincial People's Council and the Provincial People's Council delegates upon request.
The purpose of the vote of confidence and vote of confidence is to improve the effectiveness and efficiency of the People's Council's supervisory activities; contribute to assessing the prestige and performance results of the assigned tasks and powers of the person being voted on, helping the person being voted on to see the level of trust in order to continue to strive, practice, improve the quality and efficiency of work; serve as a basis for competent agencies and organizations to consider planning, training, fostering, arranging and using cadres.
The vote of confidence and vote of no confidence shall be conducted in accordance with Resolution No. 96/2023/QH15 dated June 23, 2023 of the National Assembly and related documents. Violations of the law on the vote of confidence and vote of no confidence shall be handled in accordance with the provisions of law.
