On November 27, the Department of Construction of Lam Dong province sent a document requesting the Department of Culture, Sports and Tourism of Lam Dong and the People's Committee of Da Lat City to consider the capacity of Gia Pham Trading Joint Stock Company (Gia Pham Company) - the unit that is constructing the main stage to organize the opening and closing ceremonies of the 10th Da Lat Flower Festival in 2024, at Lam Vien Square.
The main stage hosting the opening and closing ceremonies of the 2024 Da Lat Flower Festival was completed without an approved design.
According to the Department of Construction, from November 11, 2024, the Department has issued documents and directly instructed this enterprise in organizing events to ensure labor safety throughout the construction, installation process before and during the operation of the stage to organize the activities of the Dalat Flower Festival. Including urging the enterprise to deploy the preparation of stage design documents to serve the Dalat Flower Festival.
On November 21, the Department organized an inspection of the stage scaffolding installation at Lam Vien Square. Here, Gia Pham Company completed the stage scaffolding system without having a design document prepared and approved according to regulations. At the same time, the inspection process recorded that the construction contractor and the supervision contractor had not yet ensured the construction capacity to perform the work.
Gia Pham Company has completed the construction of the stage scaffolding system even though the design documents have not been approved according to regulations.
According to the Department of Construction, Gia Pham Company organized the construction and installation of the scaffolding system and stage for the Flower Festival without ensuring compliance with regulations under Articles 111, 120 and 131 of the Construction Law. On the other hand, there is no record proving that it ensures safety conditions for the organization of the opening ceremony of the 10th Da Lat Flower Festival in 2024.
On November 25, Gia Pham Company provided documents including drawings and explanations of technical design documents for the construction and installation of the Flower Festival event stage and a design drawing review report. Specifically, design drawing review report No. 15/KQTT on the review of design drawings dated November 23, 2024 performed by ACC Construction Consulting Joint Stock Company; certificate of operational capacity No. LAD-00005869 issued by Lam Dong Department of Construction on December 1, 2022.
The scaffolding of the Dalat Flower Festival stage was not constructed in accordance with the provisions of the Construction Law.
Therefore, the Department of Construction requests the Department of Culture, Sports and Tourism of Lam Dong to urge Gia Pham Company to strictly comply with the provisions of the law on construction and the guiding documents of the Department of Construction; at the same time, review the signed contract, in case this company continues to not comply with the provisions of the law, terminate the contract according to the regulations or propose the Provincial People's Committee to consider and handle according to the regulations; request Gia Pham Company to organize the appraisal and approval of the construction design for the construction and installation of the stage for the Da Lat Flower Festival event; organize the quality inspection, assess the load-bearing safety of the stage scaffolding system and stands; be responsible for paying the costs of implementing the above contents due to the installation of the stage before the design documents were appraised and approved.
