Enforcement in case of procrastination
On December 31, 2024, Chairman of the Provincial People's Committee Le Van Dung signed a document requesting the Secretaries of the District Party Committees of Thang Binh, Hiep Duc, and Phuoc Son districts to focus on leadership, mobilize the entire political system to continue to urgently and actively participate, organize propaganda, mobilize, and explain to clear the land (GPMB) to serve the project of renovating and upgrading National Highway 14E. Chairmen of the District People's Committees focused on directing resolutely and resolutely to complete compensation, GPMB, resettlement, and hand over the entire site to Project Management Board 4 (project management unit) before March 1, 2025. This is the final deadline, there must be no delay.
However, reporting to Vice Chairman of the Provincial People's Committee Tran Nam Hung at the site clearance inspection last week, Project Management Board 4 said that the "bottleneck" still exists mainly through Thang Binh and Hiep Duc. In Hiep Duc, the district handed over 26.83/30.2km (accounting for 88.84%) of the site length. It is worth mentioning that within the handed-over area, there is a 1.2km section that cannot be accessed to the construction site for the Viet An bypass (Binh Lam commune). In Thang Binh, the district handed over 14.86/17.4km of the site length (reaching 85.4%), but many sections were handed over in a "leopard-skin" style. The biggest bottleneck is that the site clearance for the railway overpass (Binh Quy commune) has not been completed.
During the inspection, comrade Tran Nam Hung listened to the concerns and recommendations of some households in the area where the railway overpass will be built. Regarding the proposal for compensation and support prices for garden and pond land attached to residential land, the provincial leaders explained to the people that according to the provisions of the 2024 Land Law, current regulations of the Central and the province clearly state that garden and pond land attached to residential land is compensated as agricultural land (not supported at 50% of the residential land price as before). This regulation is applied uniformly nationwide.
In any case where, despite repeated propaganda and mobilization, people still deliberately delay and do not comply with the state's policy on compensation and site clearance, the provincial leaders request Thang Binh and Hiep Duc districts to resolutely organize compulsory land recovery in accordance with the provisions of law. Project Management Board 4 will break ground for the construction of the railway overpass in February 2025; complete the entire project before October 2025.

Resolve multiple complaints
After the inspection, comrade Tran Nam Hung requested the Secretary of the District Party Committee and Chairman of the People's Committee of Thang Binh district to focus on leading and directing the entire political system to actively propagate and mobilize people to comply with the compensation plan and agree to hand over the site.
Research and apply all legal and provincial regulations to consider and provide maximum compensation and support to affected households, contributing to the early stabilization of life, production and living, ensuring maximum legal and legitimate rights and interests of the people. In case of non-compliance, the land will be forcibly recovered according to regulations before March 15, 2025.
Regarding the petition of some households at the railway overpass, the provincial leaders requested Thang Binh to preside over and coordinate with relevant agencies and units to carefully review the records and documents related to Mr. Dang Ha's land (supplied by the family) and the land use process over the periods to re-determine the residential land area in accordance with regulations. At the same time, direct the urgent re-measurement of the land area recovered from the household, invite family representatives to witness and confirm to carry out the next steps.
Mr. Dang Van Hung's household has a large area of recovered land, a wide existing frontage, convenient for daily trading and living, therefore, the provincial leaders agreed in principle to assign Thang Binh district to research and make maximum use of current regulations to consider the arrangement of a second residential plot (adjacent) according to their authority. Arrange for the household a kiosk lot at Binh Quy market for trading and business, exempting the rent for this kiosk for 6 months.
The district encouraged Mr. Hung's household to comply with the policy and hand over the site soon. In the immediate future, the household will temporarily lend the land area that does not affect the house to build a service road to construct a railway overpass. The compliance and agreement of Mr. Hung's household is the basis for considering and applying the above policy. For Nguyen Van Duy An's household, the provincial leaders agreed on the policy of arranging 2 adjacent resettlement lots; the district directed the review and implementation of compensation and support in accordance with regulations.

Through Hiep Duc, for cases of affected production forest land, which according to land records is 5% land, the provincial leaders requested the district to urgently inventory, record the current status and meet with households to make public, have a written commitment to implement compensation according to the type of land in use (production forest) after completing the procedures to remove 5% from the land; mobilize the handover of the site in February 2025 to construct the Viet An bypass.
In the remaining cases, the district will lead and direct the entire political system to actively propagate and mobilize people to comply with the compensation and site clearance plan; hand over the entire site in March 2025.
