Listen and promptly resolve voters' petitions

In recent times, the Provincial People's Council and local authorities at all levels have always paid attention to listening to and resolving voters' opinions and recommendations. Many issues and recommendations from voters have been resolved promptly and thoroughly, contributing to strengthening people's trust in People's Council delegates and local authorities.

Pursuant to Official Dispatch No. 393/HĐND-VP dated August 28, 2024 of the Standing Committee of the Provincial People's Council on the proposal to resolve and respond to voters' petitions after the twenty-first session of the Provincial People's Council, term XV; Report No. 07/BC-MTTQ-BTT dated August 22, 2024 of the Standing Committee of the Provincial Vietnam Fatherland Front Committee on synthesizing voters' opinions and petitions after the twenty-first session of the Provincial People's Council, term XV, term 2021-2026, the Provincial People's Committee has requested Heads of provincial departments, branches, and sectors, Chairmen of People's Committees of districts and cities to focus on resolving voters' petitions (Official Dispatch No. 3495/UBND-TH dated August 30, 2024); based on the implementation results of units and localities, the Provincial People's Committee reports the results as follows:

ON INFRASTRUCTURE INVESTMENT AND POPULATION STABILITY ARRANGEMENT

Voters of Muong Kim commune, Than Uyen district: Propose the Provincial People's Committee to direct the investor to speed up the construction progress of Cu Thanh irrigation project so that people can soon have water for irrigation.

The Provincial People's Committee responded as follows:
On August 27, 2024, the Provincial People's Committee directed the Project Management Board for Investment in Construction of Agricultural and Rural Development Works to focus on completing procedures and speeding up the construction progress of the project; currently, the Project Management Board is coordinating with the People's Committee of Than Uyen district in the work of handing over landmarks and site clearance scope, expected to start construction in October 2024, and complete the entire project in June 2025.

Voters of Pa Ve Su commune, Muong Te district: Petition the Provincial People's Committee to direct the authorities to consider connecting the national grid to households in the above group of Khoang Then village, Pa Ve Su commune (about 20 households)

The Provincial People's Committee responded as follows:

The Provincial People's Committee has assigned Lai Chau Electricity Company to direct the inspection and propose a plan. The results of the inspection and verification of the reality of Muong Te Electricity Company determined that: Currently, Khoang Then village, Pa Ve Su commune, Muong Te district has national grid electricity, however, there are about 20 newly separated households, the population has not been able to use national grid electricity, the distance from the farthest household to the low voltage line after Seo Then B substation is about 2 km.

In order to provide electricity to the above 20 households soon, the Provincial People's Committee has directed Lai Chau Electricity Company to continue reporting to the Northern Power Corporation for attention and arranging the Group's capital in the investment plan for the period 2024-2025 to invest in electricity for the households; at the same time, directed the People's Committee of Muong Te district to proactively arrange the allocated public investment capital sources and mobilize other legal capital sources for investment according to the direction of the Chairman of the Provincial People's Committee in Official Dispatch No. 1178/UBND-KTN dated April 4, 2023 and No. 4121/UBND-KTN dated October 27, 2023.

ON REGIMES AND POLICIES

Voters of Trung Chai commune, Nam Nhun district: Request the Provincial People's Committee to consider and amend Decision No. 39/2017/QD-UBND dated August 24, 20217 of the Provincial People's Committee in accordance with the principles of applying allowances for officials and civil servants performing the task of receiving citizens, handling complaints, denunciations, petitions and reflections at the Citizen Reception Office or citizen reception locations prescribed in Decree No. 64/2014/ND-CP dated June 26, 2014 of the Government, Circular No. 320/2016/TT-BTC dated December 14, 2016 of the Minister of Finance.

The Provincial People's Committee responded as follows:

- Pursuant to Clause 2, Article 7 of Circular No. 320/2016/TT-BTC dated December 14, 2016 of the Minister of Finance, it is stipulated that: "Based on the actual situation in the locality and the ability to balance the local budget, the Provincial People's Committee shall submit to the People's Council of the same level for decision on the specific content and expenditure levels accordingly...". The Provincial People's Committee has submitted to the Provincial People's Council to issue Resolution No. 13/2017/NQ-HDND dated July 14, 2017 on regulations on compensation regime for people performing the task of receiving citizens, handling complaints, denunciations, petitions and reflections in Lai Chau province and the Provincial People's Committee has issued Decision No. 39/2017/QD-UBND dated August 24, 2017 on regulations on the implementation of compensation regime for people performing the task of receiving citizens, handling complaints, denunciations, petitions and reflections in the province.

- Clause 3, Article 1 of Resolution No. 13/2017/NQ-HDND stipulates the following principles of application: “The allowance regime is calculated based on actual working days for those performing the task of receiving citizens, handling complaints, denunciations, petitions and reflections at the citizen reception headquarters and citizen reception locations specified in Clause 1 and the subjects specified in Clause 2 of this Article. In case these subjects participate in receiving citizens, handling complaints, denunciations, petitions and reflections at the citizen reception headquarters or citizen reception locations for 50% or more of the standard time of a working day, they will receive the full allowance; if it is less than 50% of the standard time of a working day, they will receive 50% of the allowance prescribed in this Resolution”. The actual working day is the day of receiving citizens, which is reflected in the citizen reception book and is stipulated in Article 11 of Circular No. 04/2021/TT-TTCP dated October 1, 2021 of the Government Inspector General: "Reception of citizens to make complaints, denunciations, recommendations, and reflections must be recorded in the Citizen Reception Book or information entered into the National Database on citizen reception, settlement of complaints, denunciations, recommendations, and reflections or the software for managing citizen reception work."

From the above regulations, it can be seen that the implementation of the allowance regime for people performing the task of receiving citizens, handling complaints, denunciations, petitions and reflections as stipulated in Resolution No. 13/2017/NQ-HDND dated July 14, 2017 of the Provincial People's Council and Decision No. 39/2017/QD-UBND dated August 24, 2017 of the Provincial People's Committee ensures conformity with the actual situation in the locality, ensuring compliance with the provisions of Decree No. 64/2014/ND-CP dated June 26, 2014 of the Government and Circular No. 320/2016/TT-BTC dated December 14, 2016 of the Minister of Finance.
2. Voters of Phong Tho town, Phong Tho district: Currently, many enterprises and employers have not organized health check-ups before assigning work and periodically for employees. Voters request the Provincial People's Committee to direct functional agencies and units to strengthen inspections, requiring enterprises and employers to conduct health check-ups for employees before assigning work and periodically according to the provisions of the Law on Labor Safety and Hygiene 2015.

The Provincial People's Committee responded as follows:

Implementing the Law on Labor Safety and Hygiene and guiding documents, in recent times, the Provincial People's Committee has issued many documents directing relevant departments, branches and localities to strengthen management, guidance and inspection of labor safety and hygiene, health examination for workers before work arrangement and periodic examination according to the provisions of a number of documents[1]. However, the number of enterprises is large and the inspection force of functional agencies according to decentralization and authority is still limited, not covering the whole. In 2024, the Labor Safety and Hygiene Inspection Team in Phong Tho district inspected 16 enterprises in the district and recommended that enterprises comply with the health examination for workers according to regulations.

Accepting voters' recommendations, in the coming time, the Provincial People's Committee will continue to direct relevant departments, branches and localities to strengthen state management, inspection, examination and compliance with laws on health examination for workers according to regulations.

Voters who are currently signing contracts under Decree No. 68/2000/ND-CP dated November 17, 2000 and Decree No. 161/2018/ND-CP dated November 19, 2018 (now Decree No. 111/2022/ND-CP of the Government) in Than Uyen district: At the twenty-first session of the Provincial People's Council, term XV, the Provincial People's Committee responded to the delegates' opinions on considering amending and raising the allocation norms in Article 13 and Article 29 of the provisions attached to Resolution No. 58/2021/NQ-HDND, dated December 10, 2021 of the Provincial People's Council (responded in Report No. 321/BC-UBND dated July 17, 2024). However, this response is not satisfactory. From 2023 to now, the Government has adjusted the basic salary twice (from 1,490,000 VND to 2,390,000 VND, an increase of 57%) and increased the regional minimum wage. In addition to cadres, civil servants, and public employees, other subjects such as retirees and monthly allowance recipients are also considered and have their pensions and allowances increased, but the subjects of laborers signing contracts under Decree No. 111/2022/ND-CP of the Government in the province have not received attention. It is recommended that the Provincial People's Committee consider and submit to the Provincial People's Council to amend Resolution No. 58/2021/NQ-HDND dated December 10, 2021 in the direction of increasing the allocation rate for labor contract expenses in Article 13 and Article 29 to match the increase in basic salary in the past time.

The Provincial People's Committee responded as follows:
On June 30, 2024, the Government issued Decree No. 73/2024/ND-CP regulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces, in which the basic salary applied from July 1, 2024 is VND 2,340,000/month. However, the Decree does not apply to subjects of labor contracts under Decree No. 68/2000/ND-CP dated November 17, 2000 and Decree No. 161/2018/ND-CP dated November 19, 2018 of the Government.
For the 2024 budget, based on the number of assigned labor contracts and the norms prescribed in Article 29 of Resolution No. 58/2021/NQ-HDND dated December 10, 2021 of the Provincial People's Council. The Provincial People's Committee has assigned a budget for the number of contract workers of Than Uyen district of 9,900 million VND. According to Report No. 3069/BC-UBND dated August 23, 2024 of Than Uyen District People's Committee on evaluating the results of implementing labor contracts for support and service work under Decree No. 111/2022/ND-CP in 2024, the number of contract workers present at July 1, 2024 is 109 people with a total payment of 639,637,519 VND/month (contract salary/month is 517,824,050 VND/month, the state budget support for insurance payment is 121,813,469 VND/month), corresponding to the amount of expenses to be paid in 2024 is 7,675 million VND (lower than the budgeted amount). The average actual budget allocated for 01 contract is 5,867,234 VND/person/month, which is higher than the regional minimum wage stipulated in Clause 1, Article 3 of Decree No. 74/2024/ND-CP dated June 30, 2024 of the Government on minimum wage for employees working under labor contracts (Than Uyen district belongs to region IV, the monthly minimum wage is 3,450,000 VND/month). In addition, at Point a, Clause 2, Article 8 of Decree No. 111/2022/ND-CP stipulates: "Employees doing support and service work stipulated in Clause 1, Article 4 of this Decree are entitled to receive salary and other benefits as agreed in the labor contract"; therefore, the contract salary/month can increase when the employer balances the unit's existing resources to support employees.

Voters of Bum Nua commune, Muong Te district: Currently, when people come to medical centers and hospitals in the province for examination and treatment, they have to pay an advance hospital fee of one to two million VND, while in many cases, the patient's family members cannot afford to pay an advance hospital fee when they are admitted to the hospital. Voters request the Provincial People's Committee to consider reducing the advance hospital fee.

The Provincial People's Committee responded as follows:

According to the report of the Department of Health, in fact, at all medical examination and treatment facilities in the province in the past time, a number of patients did not have health insurance cards or participated in health insurance but were subject to co-payment of medical examination and treatment costs (5%, 20%), but when their condition was temporarily stable, they escaped from the hospital, leading to a loss of hospital fees at medical facilities; in fact, at Muong Te Medical Center in 2023, they lost nearly 22 million VND in revenue, and in the first 6 months of 2024, they lost nearly 7 million VND in patient treatment costs. The temporary collection of a portion of the fee when a patient enters a medical examination and treatment facility is for the purpose of making an advance payment so that the patient is responsible for repaying the costs and missing procedures when examining and treating, or making an advance payment to pay for services used at the hospital for patients without a health insurance card. The advance payments will be made public, compared and refunded to the patient when all the medical examination and treatment procedures are completed according to regulations. In response to voters' opinions, the Provincial People's Committee will direct the Department of Health and medical examination and treatment facilities to have flexible handling measures, suitable to each patient's family's circumstances, so as not to affect the patient's medical examination and treatment.

Voters of Vang San commune, Muong Te district: Propose the Provincial People's Committee to consider and increase the level of study support for children going to work abroad.

The Provincial People's Committee responded as follows:

Currently, the policy to support workers working abroad under contracts in the province is implemented according to the provisions of Clause 1, Article 25 of Circular No. 55/2023/TT-BTC dated August 15, 2023 of the Minister of Finance on regulations on management, use and settlement of career funds from the state budget to implement national target programs for the period 2021 - 2025. Specifically:

- Foreign language training support: Maximum 4,000,000 VND/person/course;

- Support for meals and living expenses during training period: 50,000 VND/person/day;

- Accommodation support during training period: 400,000 VND/person/month;

The content and support level in the above regulations basically cover the training costs before workers go to work abroad.

Voters of Ho Mit Secondary School, Tan Uyen District: Pursuant to Circular No. 36/1999/TT-BGD&DT dated September 27, 1999 of the Ministry of Education and Training on guidelines for implementing the 40-hour workweek regime for the education and training sector, preschools and primary schools in the province have implemented a 5-day workweek, with Saturday and Sunday off. After considering the proposal of the Tan Uyen District People's Committee in Official Dispatch No. 2989/UBND-GDDT dated November 23, 2023, the Lai Chau Provincial People's Committee issued Official Dispatch No. 4656/UBND-VX to the Department of Education and Training to preside over and coordinate with relevant agencies and units to research and advise the Provincial People's Committee to direct the implementation of the 40-hour workweek regime for the education and training sector to ensure suitability with the specific situation and conditions of the province. Voters requested the Provincial People's Committee and the Department of Education and Training to soon issue directives and instructions so that the People's Committees of districts and schools have a basis to develop implementation plans in the upcoming 2024-2025 school year.

The Provincial People's Committee responded as follows:

The Provincial People's Committee issued Official Dispatch No. 3845/UBND-VX dated September 24, 2024 on implementing teaching and learning 5 days/week, with Saturday and Sunday off for schools according to Circular No. 36/1999/TT-BGDDT and assigned the Department of Education and Training to perform the following tasks:

- Provide specific instructions on implementing 5-day/week teaching and learning to ensure effective implementation of the content, program, and tasks of the school year according to regulations;
- Inspect and check the implementation of teaching and learning 5 days/week; promptly report and propose to the Provincial People's Committee to consider and resolve difficulties, problems, and issues arising beyond its authority;
- At the end of the 2024 - 2025 school year, organize an assessment of the situation and results of implementing 5-day/week teaching and learning in the province and report the implementation results to the Provincial People's Committee.

Voter Lo Suoi Tung, San Thang commune, Lai Chau city: Propose the Provincial People's Committee to consider and have an allowance regime for the position of Vice President of the association at the commune level and the Heads of the Association of the Elderly like other organizations.

The Provincial People's Committee responded as follows:
According to the provisions of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations, the Association of the Elderly is a social organization, operating on the principles of voluntariness, self-management, and self-financing of operating expenses.
The position of Vice President of the Association of the Elderly at the commune level and the Heads of the Association of the Elderly at the village, hamlet, and residential group levels are not considered part-time workers at the commune, hamlet, and residential group levels. On the other hand, in the context of limited provincial budget, it is not possible to balance the budget to issue allowances for this position. Currently, each year the provincial budget must balance more than 45 billion VND to implement policies for part-time workers at the commune, hamlet, and residential group levels and those directly participating in activities at the hamlet, hamlet, and residential group levels according to Resolution No. 69/2023/NQ-HDND of the Provincial People's Council.
8. Voters of Ban Moi, San Thang commune, Lai Chau city: Propose to consider a policy of visiting and giving gifts to Party members with 30 years of Party membership or more (and have a policy of supporting visits for families with Party members with 30 years of Party membership or more when they pass away).

The Provincial People's Committee responded as follows:

Currently, the Central Government has no policy regulating the regime of visiting and giving gifts to Party members with 30 years of Party membership or more and supporting visits to families with Party members with 30 years of Party membership or more when they pass away. Therefore, according to the provisions of Clause 3, Article 21 of Decree No. 163/2016/ND-CP, in case the locality issues a policy, it will be a special policy and the locality must ensure funding sources. In addition, Clause 2, Section I, Part B of Directive No. 21/CT-TTg dated June 10, 2023 of the Prime Minister on developing socio-economic development plans and state budget estimates for 2024 stipulates that "Only submit to competent authorities to issue new policies, projects and tasks when the implementation resources are balanced"; in Clause 8, Article 7, Chapter II of Circular No. 76/2023/TT-BTC dated December 29, 2023 of the Minister of Finance regulating the implementation of the 2024 state budget estimate, which stipulates: "Only issue policies to increase state budget expenditure when absolutely necessary and with guaranteed sources". Based on the above regulations and due to limited local budget resources, the Provincial People's Committee has not considered submitting to the Provincial People's Council to issue policies on regimes as proposed by voters.

Voters of Lung Than Village, San Thang Commune, Lai Chau City: Propose that the People's Committee consider and increase the daily labor allowance for militia forces in the province. According to Resolution No. 45/2021/NQ-HDND dated August 10, 2021 of the Provincial People's Council, the daily labor allowance for militia forces in the province is 130,000 VND/day/person. In case the term of service is extended as prescribed by the competent authority, the additional allowance is 60,000 VND/day/person, which is low compared to the general income.

The Provincial People's Committee responded as follows:
Regarding the policies for the militia and self-defense forces at Point a, Clause 1, Article 11 of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on force organization and building and policies and regimes for the militia and self-defense forces, it is stipulated that: “a) The level of daily labor allowance is decided by the People's Committee of the province submitted to the People's Council of the same level, but not lower than VND 119,200. In case the term of performing the obligation to participate in the Militia and Self-Defense Forces is extended according to the decision of the competent authority, the increased allowance level is decided by the People's Committee of the province submitted to the People's Council of the same level, but not lower than VND 59,600”.

From the above regulations, based on the ability to balance the local budget, the Provincial People's Committee submitted to the Provincial People's Council to issue Resolution No. 45/2021/NQ-HDND dated August 10, 2021 on the regulation of the daily labor allowance for militia forces in the province at 130,000 VND/person/day. In case the period of performing militia service is extended according to the decision of the competent authority, the allowance level increases by 60,000 VND/person/day.
Currently, the Ministry of National Defense has drafted a Decree amending and supplementing a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government in the direction of increasing the level of enjoyment of a number of regimes and policies of the Militia and Self-Defense Forces, including adjusting the increase of the level of daily labor allowance. After having the regulation document, the Provincial People's Committee will study and submit to the Provincial People's Council to issue an allowance level suitable to the reality and the budget balance capacity of the locality.

Voters of the Cooperative Union; Red Cross; Literature and Arts Association; Lawyers Association; Association of the Elderly; Association of Former Youth Volunteers; Union of Science and Technology Associations (referred to as Provincial Mass Organizations):

- Propose that the Provincial People's Committee promptly concretize and implement the contents of the regime and policies for cadres working at the Association's organizations as stated in Clause 2, Article 7 "Regulations and policies for people working regularly at the Association" stipulated in Decision No. 1010-QD/TU dated November 28, 2023 of the Provincial Party Standing Committee on promulgating the Regulations on organization and operation of the provincial mass association assigned by the Party and the State. Units under the Association propose that competent authorities consider ensuring the civil service regime for people of working age assigned and mobilized to work at the Association according to the decision of competent authorities and those recruited within the Association's staffing quota at agencies under the Association according to regulations.

The Provincial People's Committee responded as follows:

According to the provisions of Clause 2, Article 7 of Decision No. 118-QD/TW dated August 22, 2023 of the Secretariat on the Regulations on organization and operation of mass associations assigned by the Party and State at the Central level; Clause 2, Article 7 of Decision No. 1010-QD/TU dated November 28, 2023 of the Standing Committee of the Provincial Party Committee on the Regulations on organization and operation of provincial-level mass associations assigned by the Party and State, it is stipulated: "Regulations and policies for people working regularly at the association: People of working age are assigned and mobilized to work at the association according to the decision of the competent authority and people recruited within the association's payroll quota shall receive salaries, allowances and other regimes and policies according to regulations for cadres and civil servants".

According to Official Dispatch No. 2478/BNV-TL dated May 7, 2024 of the Ministry of Home Affairs on the public service allowance regime, in which the response to the provinces is as follows: "The Ministry of Home Affairs is coordinating with relevant agencies to institutionalize Decision No. 118-QD/TW dated August 22, 2023 of the Secretariat on the Regulations on organization and operation of mass associations assigned by the Party and State at the Central level; completing the Decree replacing Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations, in which proposes regimes and policies for people working at associations to be submitted to the Government for consideration and decision; During the time the Government has not yet issued a Decree replacing Decree No. 45/2010/ND-CP for comments, the public service allowance regime shall be implemented according to the provisions of Decree No. 34/2012/ND-CP dated April 15, 2012 of the Government.

Therefore, after receiving guidance documents from the Central Government, the Provincial People's Committee will implement them according to regulations.

- Propose that all levels consider and resolve the salary allowance regime for leaders of the Association of Veteran Youth Volunteers at district and city levels and communes, wards and towns who have not yet received salary allowances; and the salary regime for the team of full-time officials of the Association of the Elderly at district level.

The Provincial People's Committee responded as follows:

Pursuant to the provisions of Article 3 of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations, the organization and operation of associations are carried out on the principles of voluntariness, self-management and self-sufficiency in operating expenses.

Pursuant to the provisions of Article 3 of Decision No. 30/2011/QD-TTg dated June 1, 2011 of the Prime Minister on remuneration regime for retired persons holding full-time leadership positions at associations: “1. For associations with special characteristics: Funding for implementing remuneration regimes is provided annually by the state budget in accordance with the provisions of the law on state budget. 2. For the remaining associations: Funding for implementing remuneration regimes is guaranteed by the association”.

Currently, the Associations of Former Youth Volunteers at district, city, commune, ward and town levels; and the Associations of the Elderly at district and commune levels in the province have not been recognized by competent authorities as associations assigned by the Party and the State (Associations with special characteristics). Therefore, according to the above regulations, the funds for implementing the remuneration regime are self-guaranteed by the associations.

- Propose that the Provincial People's Committee pay attention to creating conditions for civil servants and public employees working at the Association's organizations to participate in the annual promotion exam.

The Provincial People's Committee responded as follows:

Tại Công văn số 1865/BNV-CCVC ngày 30/4/2021 của Bộ Nội vụ về việc nâng ngạch, thăng hạng đối với người làm việc trong các Hội có tính chất đặc thù, trong đó Bộ Nội vụ trả lời như sau: “Về thi nâng ngạch, thăng hạng đối với người làm việc tại các Hội: Do các Hội là đối tượng áp dụng quy định tại Nghị định số 138/2020/NĐ-CP và Nghị định số 115/2020/NĐ-CP nên đề nghị Sở Nội vụ tỉnh tham mưu cấp có thẩm quyền cử người làm việc ở các Hội tham gia cùng với kỳ thi nâng ngạch công chức hoặc kỳ thi thăng hạng viên chức do tỉnh tổ chức khi đáp ứng được tiêu chuẩn, điều kiện và phù hợp với yêu cầu của vị trí việc làm đã được cấp có thẩm quyền phê duyệt”.

Theo đó, năm 2022, Bộ Nội vụ phê duyệt cho tỉnh 17 chỉ tiêu nâng ngạch công chức đối với người làm việc tại các tổ chức hội (Liên minh HTX: 6, Hội Chữ thập đỏ tỉnh: 6; Hội Luật gia: 01, Hội Chữ thập đỏ huyện Phong Thổ: 01, Hội Chữ thập đỏ huyện Tam Đường: 01, Liên hiệp các hội Khoa học và kỹ thuật: 01, Hội Văn học - Nghệ thuật: 01); Ủy ban nhân dân tỉnh đã tổ chức kỳ thi nâng ngạch công chức, trong đó 07 người làm việc tại các tổ chức hội đã trúng tuyển (01 người nâng ngạch chuyên viên chính, 06 người nâng ngạch chuyên viên). Năm 2023, Ủy ban nhân dân tỉnh ban hành Đề án số 4404/ĐA-UBND ngày 15/11/2023 về việc tổ chức thi nâng ngạch công chức trong các cơ quan hành chính và người làm việc tại các tổ chức hội đặc thù; thăng hạng viên chức từ hạng III lên hạng II tỉnh Lai Châu năm 2023; trong đó đề nghị Bộ Nội vụ phê duyệt 04 chỉ tiêu chuyên viên chính, 12 chỉ tiêu chuyên viên và tương đương cho người làm việc tại Hội. Tuy nhiên, tại Công văn số 7446/BNV-CCVC ngày 18/12/2023 của Bộ Nội vụ về việc tổ chức thi nâng ngạch công chức năm 2023 tỉnh Lai Châu, theo đó Bộ Nội vụ chưa phê duyệt chỉ tiêu nâng ngạch công chức đối với tổ chức hội có tính chất đặc thù, đề nghị UBND tỉnh Lai Châu thực hiện theo đúng quy định tại Nghị định số 85/2023/NĐ-CP ngày 07/12/2023 của Chính phủ về sửa đổi, bổ sung một số điều của Nghị định số 115/2020/NĐ-CP về tuyển dụng, sử dụng và quản lý viên chức.

Mặt khác, tại khoản 2 Điều 7 của Quy chế tổ chức và hoạt động của hội quần chúng cấp tỉnh được Đảng, Nhà nước giao nhiệm vụ ban hành kèm theo Quyết định số 1010-QĐ/TU ngày 28/11/2023 của Ban Thường vụ Tỉnh ủy quy định chế độ, chính sách đối với người làm việc thường xuyên tại hội: “Người trong độ tuổi lao động được phân công, điều động đến làm việc tại hội theo quyết định của cơ quan có thẩm quyền và người được tuyển dụng trong chỉ tiêu biên chế của hội thì hưởng lương, phụ cấp và chế độ, chính sách khác theo quy định đối với cán bộ, công chức”.

Do đó, hiện nay giữa các văn bản chưa thống nhất rõ ràng về chế độ, chính sách đối với các trường hợp làm việc tại hội được áp dụng như đối với công chức (quy định tại Nghị định số 138/2020/NĐ-CP của Chính phủ) và viên chức (quy định tại Nghị định số 115/2020/NĐ-CP, Nghị định số 85/2023/NĐ-CP của Chính phủ). Sở Nội vụ đã có Văn bản số 1717/SNV-TCBC ngày 12/9/2024 gửi Bộ Nội vụ về xin ý kiến, hướng dẫn việc áp dụng các quy định nâng ngạch, thăng hạng đối với người làm việc tại các tổ chức hội. Sau khi có ý kiến của Bộ Nội vụ sẽ hướng dẫn các tổ chức hội thực hiện theo quy định.

- Căn cứ khoản 1 Điều 12 Nghị quyết số 58/2021/NQ-HĐND ngày 10/12/2021 của HĐND tỉnh Lai Châu ban hành Quy định về nguyên tắc, tiêu chí và định mức phân bổ dự toán chi thường xuyên ngân sách dịa phương năm 2022 trên địa bàn tỉnh quy định: định mức phân bổ chi thường xuyên khác tính theo tiêu chí biên chế của cấp có thẩm quyền giao: 25 triệu đồng/biên chế/năm. Do số lượng biên chế của hội ít người với định mức cấp chi thường xuyên này gặp rất nhiều khó khăn trong triển khai thực hiện nhiệm vụ. Đề nghị cấp có thẩm quyền xem xét nâng mức phân bổ chi thường xuyên để đảm bảo theo chức năng là tổ chức hội quần chúng được Đảng, Nhà nước giao nhiệm vụ.

Tại khoản 2 Điều 1 Thông tư số 01/2011/TT-BTC ngày 06/01/2011 của Bộ trưởng Bộ Tài chính về quy định việc hỗ trợ kinh phí từ ngân sách nhà nước cho các hoạt động gắn với nhiệm vụ của Nhà nước giao; việc quản lý, sử dụng tài sản, tài chính; quản lý việc tiếp nhận, sử dụng các nguồn tài trợ của cá nhân, tổ chức nước ngoài cho các tổ chức chính trị xã hội - nghề nghiệp, tổ chức xã hội, tổ chức xã hội - nghề nghiệp quy định về nguyên tắc bố trí nguồn kinh phí cho các Hội như sau: “2. Nhà nước chỉ thực hiện hỗ trợ kinh phí đối với những hoạt động của hội gắn với nhiệm vụ của Nhà nước giao theo quy định tại khoản 12 Điều 23 Nghị định số 45/2010/NĐ-CP ngày 21/4/2010 của Chính phủ quy định về tổ chức, hoạt động và quản lý hội”.

Để các Hội chủ động thực hiện hoạt động, Ủy ban nhân dân tỉnh đã trình Hội đồng nhân dân tỉnh phân bổ 25 triệu đồng/biên chế/năm (không bao gồm tiền lương và các khoản phụ cấp theo lương). Ngoài định mức trên, hằng năm ngân sách tỉnh còn hỗ kinh phí để các Hội thực hiện nhiệm vụ tỉnh giao, cụ thể năm 2024 hỗ trợ: Liên minh Hợp tác xã 842 triệu đồng; Hội Chữ thập đỏ 865 triệu đồng; Hội Văn học - Nghệ thuật 1.542 triệu đồng; Hội Luật gia 671 triệu đồng; Hội Người cao tuổi 984 triệu đồng; Hội cựu Thanh niên xung phong 583 triệu đồng; Liên hiệp các Hội Khoa học và kỹ thuật 457 triệu đồng. Như vậy, tổng kinh phí chi hoạt động của các Hội là cao hơn định mức chi của các cơ quan quản lý nhà nước.
Năm 2025, là năm cuối thời kỳ ổn định ngân sách nhà nước giai đoạn 2022-2025, Ủy ban nhân dân tỉnh sẽ chỉ đạo cơ quan chuyên môn rà soát, đánh giá lại mức hỗ trợ cho Hội quần chúng; trên cơ sở đó sẽ nghiên cứu đề xuất trình Hội đồng nhân dân tỉnh ban hành định mức chi thường xuyên áp dụng cho thời kỳ ổn định ngân sách giai đoạn 2026-2030 đảm bảo phù hợp với điều kiện thực tế và khả năng cân đối ngân sách địa phương.

Cử tri thị trấn Phong Thổ, huyện Phong Thổ: Kiến nghị UBND tỉnh chỉ đạo các cơ quan chức năng xem xét, trang cấp cho huyện một xe chữa cháy chuyên dụng để đảm bảo cứu chữa kịp thời khi có hoả hoạn xảy ra.

Theo Thông tư số 07/2020/TT-BCA ngày 10/01/2020 của Bộ trưởng Bộ Công an quy định tiêu chuẩn, định mức sử dụng xe ô tô trong Công an nhân dân, tại mục II, Phụ lục số 12 có quy định trang cấp xe chữa cháy chuyên dụng cho tới cấp Đội Cảnh sát chữa cháy và cứu nạn, cứu hộ thuộc Công an cấp huyện.

Thực hiện Quyết định số 203/QĐ-TTg ngày 28/02/2024 của Thủ tướng Chính phủ về phê duyệt kế hoạch thực hiện Quy hoạch hạ tầng phòng cháy và chữa cháy thời kỳ 2021 - 2030, tầm nhìn đến năm 2050, Ủy ban nhân dân tỉnh đã ban hành Kế hoạch 1151/KH-UBND ngày 02/4/2024, theo đó đã giao Công an tỉnh tham mưu Bộ Công an và các cấp có thẩm quyền bố trí nguồn vốn xây dựng 08 trụ sở, doanh trại cho lực lượng Cảnh sát phòng cháy chữa cháy và cứu nạn cứu hộ cho Công an cấp huyện, thời gian thực hiện đến năm 2030.

Tuy nhiên, hiện nay trên địa bàn tỉnh chưa đủ điều kiện để thành lập Đội Cảnh sát chữa cháy và cứu nạn, cứu hộ thuộc Công an cấp huyện. Số lượng xe chữa cháy chuyên dụng được trang cấp cho Công an tỉnh Lai Châu đang còn thiếu so với quy định, điều kiện để đảm bảo duy trì và vận hành xe chữa cháy cần có lực lượng chuyên môn được đào tạo do vậy việc bố trí xe chữa cháy chuyên dụng từ nguồn ngân sách của Bộ Công an cho Công an cấp huyện thời điểm này chưa thể thực hiện được.

Cử tri xã Vàng San, huyện Mường Tè : Kiến nghị UBND tỉnh và các cơ quan chức năng xem xét xây dựng bia tưởng niệm các Anh hùng liệt sĩ cho xã Vàng San (xã có 07 Liệt sĩ)

Theo quy định tại khoản 4 Điều 151 Nghị định số 131/2021/NĐ-CP ngày 30/12/2021 của Chính phủ về quy định chi tiết và biện pháp thi hành Pháp lệnh Ưu đãi người có công với cách mạng: “4. Nhà bia ghi tên liệt sĩ được xây dựng tại các xã, phường, thị trấn, quận huyện không có nghĩa trang liệt sĩ”. Hiện nay, trên địa bàn huyện Mường Tè đã có nghĩa trang liệt sĩ, do vậy theo quy định không được xây dựng nhà bia ghi tên liệt sĩ tại xã Vàng San.

Cử tri huyện Tân Uyên: Hiện nay, quá trình triển khai thực hiện dự án Nâng cấp đường tỉnh lộ 133 (Km0-Km21) qua huyện Tân Uyên gặp khó khăn do Công ty TNHH MTV Trường Thịnh Tân Uyên không nhất trí với phương án bồi thường, hỗ trợ. Tháng 12/2019, Công ty đã được trúng đấu giá quyền sử dụng đất thương mại, dịch vụ tại thửa đất thuộc trụ sở UBND xã Thân Thuộc cũ với diện tích 1.274,9 m2, giá khởi điểm được UBND tỉnh phê duyệt tại Quyết định số 1617/QĐ-UBND ngày 05/12/2019 là 5.601.983.000 đồng (tương ứng với 4.394.000 đồng/1 m2). Năm 2023, khi nhà nước thu hồi đất thực hiện dự án: Nâng cấp đường tỉnh lộ 133 (Km0-Km21) thu hồi 175,3 m2 thuộc thửa đất trúng đấu giá của Công ty thì mức giá bồi thường khoảng 720.000 đồng/1 m2, thấp hơn 6,1 so với giá khởi điểm đấu giá được phê duyệt (giá bồi thường về đất nếu phê duyệt là 126.216.000 đồng thấp hơn 644.052.000 đồng so với giá khởi điểm được phê duyệt trúng đấu giá là 770.268.000 đồng). Cử tri đề nghị UBND tỉnh chỉ đạo Ban Quản lý dự án đầu tư xây dựng các công trình giao thông tỉnh phối hợp với các sở, ngành chức năng, UBND huyện Tân Uyên thống nhất giải pháp tháo gỡ vướng mắc để thực hiện dự án theo đúng đúng tiến độ đã để ra.

Ủy ban nhân dân tỉnh đã giao Ban QLDA đầu tư xây dựng các công trình Giao thông tỉnh Lai Châu phối hợp với UBND huyện Tân Uyên làm việc với Công ty TNHH MTV Trường Thịnh Tân Uyên. Sau khi được các cơ quan chuyên môn của huyện giải thích về cơ chế, chính sách khi nhà nước thu hồi đất, thực hiện công tác GPMB của dự án đầu tư công, đại diện Công ty TNHH MTV Trường Thịnh Tân Uyên đã hiểu và nhất trí với đơn giá đền bù theo quy định của nhà nước và không có kiến nghị thêm.

Cử tri xã Pú Đao, huyện Nậm Nhùn: Đề nghị UBND tỉnh có ý kiến với bộ ngành Trung ương cho phép khi tổ chức thực hiện các cuộc thi tuyển công chức các cấp trong phần thi phỏng vấn và vấn đáp cần đảm bảo đầy đủ máy ghi âm, ghi hình để làm minh chứng kết quả thi; được phúc khảo cả phần thi vấn đáp và phân thi phỏng vấn.

UBND tỉnh trả lời như sau: Nhất trí, tiếp thu tổng hợp kiến nghị với các Bộ, ngành trung ương.

Cử tri xã Tà Tổng, huyện Mường Tè: Đề nghị tăng mức xử phạt vi phạm hành chính đối với thẩm quyền xử phạt của Chủ tịch UBND cấp xã. Vì mức xử phạt hành chính đối với thẩm quyền xử phạt của Chủ tịch UBND cấp xã như hiện nay là chưa đủ tính răn đe đối với các đối tượng vi phạm hành chính.

Thẩm quyền xử phạt vi phạm hành chính của Chủ tịch Ủy ban nhân dân cấp xã được quy định tại khoản 1 Điều 38 Luật Xử lý vi phạm hành chính năm 2012 (đã được sửa đổi, bổ sung năm 2020). Ủy ban nhân dân tỉnh tiếp thu ý kiến cử tri xã Tà Tổng, huyện Mường Tè và đề xuất cấp có thẩm quyền xem xét theo quy định.

Liên minh Hợp tác xã: Hiện nay Liên minh HTX chỉ có ở cấp tỉnh, không có ở cấp huyện, do vậy công tác theo dõi, tổng hợp, thực hiện các nhiệm vụ tổng hợp, tư vấn thành lập mới, hỗ trợ, củng cố phát triển HTX trên địa bàn toàn tỉnh. Đến thời điểm 31/5/2024, toàn tỉnh có 354 HTX đang hoạt động, 289 Tổ hợp tác. Tạo việc làm thường xuyên cho trên 8.000 thành viên và người lao động. Định hướng đến năm 2030: Toàn tỉnh có khoảng 430 tổ hợp tác với trên 3.200 thành viên; 410 hợp tác xã với trên 7.500 thành viên; 04 Liên hiệp hợp tác xã với 21 hợp tác xã thành viên. Tạo việc làm trên 10.000 lao động thường xuyên trong các HTX trở lên. Các HTX sản xuất kinh doanh trải khắp trên địa bàn toàn tỉnh, giao thông đi lại còn khó khăn, nhiều nơi chưa có phương tiện vận tải công cộng nên khó khăn trong công tác đi cơ sở để theo dõi, quản lý về các HTX, các đơn vị thành viên. Ngoài ra, Liên minh HTX tỉnh là Thường trực Ban Chỉ đạo phát triển KTTT tỉnh, trong đó Chủ tịch Liên minh HTX tỉnh là Phó Trưởng ban Thường trực. Chủ tịch Liên minh HTX tỉnh là Ủy viên Ban Chấp hành Liên minh HTX Việt Nam và kiêm nhiệm chức danh Chủ tịch Quỹ hỗ trợ phát triển HTX tỉnh. Liên minh HTX tỉnh được trang bị 01 xe từ năm 2005 đến nay đã hết khấu hao. Vì vậy, Liên minh HTX đề nghị tỉnh quan tâm xem xét trang bị ô tô để cơ quan thực hiện nhiệm vụ được giao được thuận lợi hơn.

Hội Chữ thập đỏ tỉnh: Hội Văn học nghệ thuật và Hội Chữ thập đỏ tỉnh: đề nghị UBND tỉnh xem xét trang bị ô tô phục vụ công tác cho Hội Chữ thập đỏ tỉnh và Hội Văn học nghệ thuật để triển khai thực hiện các nhiệm vụ được Đảng và Nhà nước giao. Hiện tại hoạt động công tác Hội và phong trào Chữ thập đỏ trên địa bàn sẽ gặp rất nhiều khó khăn, thiếu chủ động trong quá trình triển khai thực hiện nhiệm vụ tại cơ sở khi không có ô tô phục vụ công tác chung. Bởi tính đặc thù của các hoạt động nhân đạo xã hội, thường xuyên vận động, kết nối nguồn lực từ các nhà tài trợ, tham gia các hoạt động trao tặng quà, phòng chống thiên tai, cứu trợ, các đợt tuyên truyền vận động Hiến máu tình nguyện... tại các địa bàn, vùng xâu, vùng xa.

Đối với kiến nghị số 6 và kiến nghị số 7, UBND tỉnh trả lời như sau:
Nghị định số 72/2023/NĐ-CP ngày 26/9/2023 của Chính phủ về quy định tiêu chuẩn, định mức sử dụng xe ô tô không quy định tiêu chuẩn, định mức xe ô tô cho các hội quần chúng mà chỉ quy định hỗ trợ xe ô tô và hỗ trợ kinh phí khi thực hiện nhiệm vụ do Đảng, nhà nước giao nhiệm vụ. Tại điểm b khoản 2 Điều 20 Nghị định số 72/2023/NĐ-CP quy định hỗ trợ kinh phí để mua xe ô tô từ nguồn ngân sách nhà nước hoặc hỗ trợ bằng hiện vật:

Đối với các hội có số biên chế được giao từ 20 người đến 50 người được hỗ trợ 01 xe; từ trên 50 người được hỗ trợ tối đa 02 xe.

Đối với các hội có số biên chế được giao dưới 20 người được hỗ trợ kinh phí để thuê xe hoặc khoán kinh phí sử dụng xe ô tô khi thực hiện nhiệm vụ do Đảng, Nhà nước giao.

Theo Quyết định số 2294/QĐ-UBND ngày 19/12/2023 của Ủy ban nhân dân tỉnh Lai Châu về quy định biên chế trong các tổ chức hội quần chúng được Đảng, nhà nước giao nhiệm vụ; theo đó, Liên minh Hợp tác xã được giao 16 biên chế, Hội Chữ thập đỏ được giao 17 biên chế, Hội Văn học nghệ thuật có 9 biên chế, như vậy 03 đơn vị không thuộc trường hợp được hỗ trợ xe ô tô mà chỉ được hỗ trợ kinh phí để thuê xe hoặc khoán kinh phí sử dụng xe ô tô khi thực hiện nhiệm vụ do Đảng, Nhà nước giao.
