On the afternoon of October 22, continuing the program of the 8th Session, 15th National Assembly , authorized by the Prime Minister, General Luong Tam Quang - Minister of Public Security presented the Report on the Data Law Project.

Tighten personal data management

According to Minister of Public Security Luong Tam Quang, many countries in the world have regulations on data, operation, exploitation, and use of data (data of state agencies, organizations, businesses, individuals)... Thereby, creating mechanisms and policies to apply data to state management activities and socio-economic development.

In our country, up to now, 7 national databases have been initially created and formed; some national databases have been interconnected and shared data, contributing to reforming and simplifying administrative procedures for people; technology infrastructure for building data centers has initially received more investment attention...

 

The Draft Law on Data consists of 7 chapters and 67 articles. The Law regulates the construction, development, processing and management of data; application of science and technology in data processing; National comprehensive database; National data center; data products and services; state management of data; responsibilities of agencies, organizations and individuals related to data activities.

Through review, there are currently 69 Laws that have regulations on databases (including national databases and specialized databases). However, in the above laws, only a few laws have regulations on the responsibilities of the database management agency in building, collecting, managing, operating, connecting, sharing, exploiting and using information in the database.

In particular, all laws do not specifically and uniformly regulate data processing and management; they do not regulate the creation of databases compiled from national databases and specialized databases to serve the direction and operation work...

Meanwhile, establishing a data market, building and developing data-related products and services now plays a very important role. It is considered a breakthrough factor to gradually create and promote the opening of a data market, using the data market as a driving force for data development and stimulating and promoting digital transformation of industries and fields, increasing competitiveness, ensuring the digital transformation process in our country.

“Therefore, the development of the Data Law is extremely important, necessary and urgent to ensure full coverage of the contents and tasks that the Government has identified in the digital transformation work; enhance the effective use of information in databases to serve state management, both exploit and apply data in socio-economic development, and tighten the management of personal and non-personal data, ensuring information security and safety” – General Luong Tam Quang emphasized.

Minister Luong Tam Quang also emphasized the four purposes of promulgating this law. Specifically, including: creating unity, synchronization, and effective use of data to serve state management and socio-economic development; serving the development of digital government and reforming and reducing administrative procedures; socio-economic development; developing the National Data Center.

The Draft Law devotes a chapter to regulating the construction and development of the National Data Center. The National Data Center is responsible for integrating, synchronizing, storing, analyzing, and exploiting data of Party and State agencies and socio-political organizations in accordance with the law to create and manage a national comprehensive database. At the same time, it supervises the assurance of data quality and data coordination activities; builds measurement and performance evaluation systems for data management activities. Implements legal regulations on the use of cryptography to secure data within the scope of state secrets stored and exchanged in cyberspace; organizes international cooperation on data; provides products and services on data and information technology infrastructure...

It is expected that the establishment of the National Data Center will be decided by the Government according to its authority and this will be a new unit under the Ministry of Public Security. In the period from now to 2030, it is expected that the National Data Center will attract, train, and develop human resources to operate and manage the system to meet national and international standards in data management.

Potential risk of disclosure, loss of security and information safety

Presenting the review report of the Data Law Project, Chairman of the National Assembly's Defense and Security Committee Le Tan Toi said that the review agency basically agreed with the necessity of promulgating the Data Law. The draft Law dossier is complete, the Basic Impact Assessment Report clearly assesses the proposed policies, and is qualified to be submitted to the National Assembly for consideration and comments at the 8th Session.

Chairman of the National Assembly's Defense and Security Committee Le Tan Toi presented the report on the review of the Data Law Project.

“There are opinions that this is an extremely important, necessary, and urgent Law project to ensure national digital transformation, to serve state management, to exploit and apply data in socio-economic development, to tighten personal and non-personal data, to ensure information security and safety, so it should be considered and approved according to the one-session process” – Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi informed.

Basically agreeing with the regulation on the National Data Center, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that this will help the Government and ministries, branches and localities focus on infrastructure and technology resources; solve the problem of limitations of information systems, integration and data sharing between agencies; increase efficiency and transparency in state management; save investment resources...

However, there are opinions suggesting reviewing and clarifying more about the organizational model, functions, rights, obligations, progress, and effectiveness of the implementation of the construction of the National Data Center.

At the same time, the concentration of large amounts of data information at the National Data Center, in addition to its advantages, also poses many potential risks in terms of information leakage, loss of security and safety. Therefore, there are opinions suggesting that the report clarify further response plans and solutions to problems that may arise.

It is argued that, in reality, there have been a number of incidents at national data centers, leading to major economic losses and significantly affecting socio-economic development, national defense, security, order, and social safety at a certain point in time.

"To proactively ensure regular and continuous operation of data connection and minimize economic damage to the country, the drafting agency needs to study regulations on the National Data Backup Center" - Chairman of the National Assembly's Defense and Security Committee Le Tan Toi emphasized.
