Construction and development of National Data Center

On the afternoon of October 22, continuing the program of the 8th Session of the 15th National Assembly, authorized by the Prime Minister, Minister of Public Security Luong Tam Quang presented a report on the draft Law on Data.

The draft law devotes a chapter to regulating the construction and development of the National Data Center.

The main information technology components of the National Data Center include: data sharing and coordination platform; cloud computing infrastructure; national aggregated database; data analysis system for management; national public service portal; system, software for management, exploitation, provision of data services, open data portal, and paid data service portal.

The National Data Center is responsible for integrating, synchronizing, storing, analyzing, and exploiting data of Party, State, and socio-political organizations in accordance with the law to create and manage a national comprehensive database.

At the same time, monitor data quality assurance, data coordination activities; build measurement and performance evaluation systems for data management activities.

Implement legal regulations on the use of cryptography to secure data within the scope of state secrets stored and exchanged in cyberspace; organize international cooperation on data; provide products and services on data and information technology infrastructure...

It is expected that the establishment of the National Data Center will be decided by the Government according to its authority and this will be a new unit under the Ministry of Public Security.

In the period from now to 2030, it is expected that the National Data Center will attract, train, and develop human resources to operate and manage the system to meet national and international standards in data management.

Currently, the construction of the National Data Center is being implemented on the basis of the implementation of Resolution No. 175/NQ-CP dated October 30, 2023 of the Government (the estimated cost of constructing the National Data Center in phase 1 (until 2025) is about 20 trillion VND).

Based on the actual situation and needs, the Ministry of Public Security will continue to research and propose projects to build National Data Centers in the next investment phases in accordance with the 2026-2030 medium-term public investment plan to submit to competent authorities for approval to ensure savings, efficiency, avoid waste and best suit the development of technology.

Fear of information leakage

Examining the above draft law, the National Assembly's National Defense and Security Committee basically agreed with the provisions on the National Data Center.

This will help the Government and ministries, branches and localities focus on infrastructure and technology resources; solve the problem of limitations of information systems, integration and data sharing between agencies; increase efficiency and transparency in state management; save investment resources...

However, there are opinions suggesting reviewing and clarifying more about the organizational model, functions, rights, obligations, progress, and effectiveness of the implementation of the construction of the National Data Center.

Notably, the concentration of large amounts of data information at the National Data Center, in addition to its advantages, also poses many potential risks in terms of information leakage, security, and safety. Therefore, there are opinions suggesting that the report clarify further response plans and resolve issues that may arise.

There are also opinions that, in reality, there have been a number of incidents (caused by humans or natural disasters) to national data centers, leading to great economic losses, significantly affecting socio-economic development, national defense, security, order, and social safety at a certain point in time.

To proactively ensure regular and continuous operation of data connection and minimize economic damage to the country, the drafting agency needs to study regulations on the National Data Backup Center.

Meanwhile, other opinions agreed on the establishment of a National Data Center but suggested that research be conducted to establish the center as a new unit under the Government. Only then will it have enough capacity and potential to meet the requirements and tasks set forth.

In addition, the National Defense and Security Committee basically agrees with the provisions of the draft Law on providing data to Party and State agencies and socio-political organizations. However, it recommends reviewing the provisions to ensure feasibility and compliance with the provisions of the Constitution; and at the same time, stipulating measures to ensure information security of organizations and individuals when implementing these provisions.
