Deputy Head of the City's National Assembly Delegation Nguyen Thi Suu spoke at the conference.

These draft laws and resolutions will be submitted at the 9th Extraordinary Session of the 15th National Assembly and are expected to be approved under the one-session process.

Regarding the Law on Organization of Local Government (amended), delegates focused on discussing the model of local government organization; organization and operation of the People's Committee; decentralization, decentralization, delegation of authority between local governments at all levels; tasks and powers of local governments; organizational structure and operation of People's Councils; implementation effect and transitional provisions.

Delegate Nguyen Anh Dung, Deputy Head of the Legal Committee - City People's Council, agreed and highly appreciated the content of the draft law. Mr. Dung said that the draft law has resolved the problems arising after two sessions of the People's Council; at the same time, he suggested that it is necessary to further study the regulations on questioning by the People's Council towards the civil enforcement agency; clearly stipulate the number of full-time delegates of the People's Council...

Regarding the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the State apparatus, delegates said that the issuance of the resolution is extremely necessary, providing a sufficient legal basis to more specifically stipulate cases of reorganization of the apparatus to which the resolution applies to facilitate the organization and implementation in practice; ensuring the normal, continuous operation of the State apparatus, society, and people to take place continuously, smoothly, and without interruption after the reorganization of the apparatus...

Delegates also contributed comments on the implementation of functions, tasks, and powers of competent agencies and individuals; regulations on specific principles to handle a number of issues related to the reorganization of the State apparatus.

Delegate Nguyen Thi Thuy Phuong, representative of the Department of Justice, gave comments at the conference.

Delegate Nguyen Thi Thuy Phuong, representative of the Department of Justice, suggested that it is necessary to study and supplement regulations on allowing the number of deputies of the heads of agencies and organizations after the rearrangement to be higher than the level currently prescribed in legal documents to ensure coverage of all types of agencies and units implementing the rearrangement. Study and expand the scope of agencies and organizations that are allowed to prescribe the functions, tasks, powers, and organizational structures of agencies under their authority that are different from the regulations of superior state agencies to suit the requirements of rearranging the apparatus from the central to local levels.

“The Government needs to develop a plan to implement this resolution of the National Assembly, clearly identifying the work items that need to be implemented, the responsibilities of agencies and organizations, the deadline for completion, and a specific list of laws and resolutions of the National Assembly that need to be amended and supplemented in the coming time to meet the requirements of the work of reorganizing the state apparatus,” Ms. Phuong stated her opinion.

Regarding the Law on Promulgation of Legal Documents (LDOs), delegates suggested that the drafting agency consider adding provisions on the subjects of application of the law to the draft law; consider clearly defining the development and promulgation of LDOs in which emergency cases, LDOs can be developed and promulgated according to shortened procedures, and in which cases, LDOs can be developed and promulgated in special cases for easy application.

“Some contents of the Law on Promulgation of Legal Documents need to be consistent with the Law on Organization of Local Government; some sub-sections need to be added; the concepts of “replacement” and “abolition” in Clause 3, Article 8 need to be clarified…”, commented Chairman of the City Bar Association Nguyen Van Phuoc.

Delegates have proposals on the legal document system; that is, the suitability of reducing the form of legal documents of People's Councils and People's Committees at commune level, of People's Councils and People's Committees at district level as stipulated in the draft law.

Regarding social criticism, consultation and comments on policies and draft legal documents, there are currently two types of opinions, which are the proposal that in addition to the Vietnam Fatherland Front Committee (VFF), it is necessary to study and expand the right to social criticism to other political and social organizations to comply with the regulations on supervision and social criticism of the VFF and socio-political organizations; keep it the same as the draft law submitted by the Government.

Concluding the conference, Deputy Head of the City National Assembly Delegation Nguyen Thi Suu highly appreciated the contents of the delegates' comments. Ms. Suu acknowledged and accepted the opinions; at the same time, she said that the delegation will synthesize the opinions to submit to the upcoming extraordinary session of the National Assembly.
