Lam Dong strengthens management of karaoke and dance club activities

According to the Department of Culture, Sports and Tourism of Lam Dong province, in recent times, the management of karaoke and discotheque business activities has been focused on by all levels, sectors and local authorities and has achieved positive results. However, currently, districts and cities in the province are facing difficulties in granting and adjusting karaoke licenses locally.

In addition, currently, in Lam Dong province, there is a situation where some establishments outside have signs saying "singing for each other, cafe music" but in reality, their operations inside are similar to karaoke services. The business activities of these establishments have many potential risks of causing disruption to security and order in the area. The establishments operate similarly to karaoke businesses but have not been approved by the authorities regarding Fire Prevention and Fighting Safety, karaoke business conditions, and security and order safety conditions.

On the other hand, the above activities of many organizations, individuals and business households are infringing upon copyright and related rights stipulated in the Law on Intellectual Property and guiding documents of the Government, Ministries and branches on copyright and related rights.

In order to promptly overcome the above situation and create conditions for organizations, individuals, business households in karaoke, dance hall activities and conditional business lines of performing arts in the area to comply with the provisions of law; Lam Dong Department of Culture, Sports and Tourism has requested the Department of Culture, Sports and Tourism of districts and cities to study and guide business households and owners of establishments to comply with the provisions of Decree No. 148/2024/ND-CP dated November 12, 2024 of the Government amending and supplementing a number of articles of Decree No. 54/2019/ND-CP dated June 19, 2019 of the Government.

Instruct business households and owners of establishments that organize performing arts activities to comply with the provisions of Article 4 of the 2005 Law on Intellectual Property, amended and supplemented in 2009, 2019 and 2022 (Law on Intellectual Property) on copyright and rights related to copyright for performances, audio and video recordings, broadcast programs, and satellite signals carrying encrypted programs; promote propaganda activities and raise awareness among people, businesses, and the law on copyright and related rights violations.

In addition, strengthen inspection, supervision, and tighten business conditions at karaoke and discotheque establishments in the management area according to the provisions of law and authority. At the same time, take measures to prevent and combat violations of security, order, social safety, fire and explosion prevention.

Close coordination between relevant agencies and units in the inspection and handling of violations against disguised karaoke service establishments, transformed business forms into restaurants, cafes, etc. Comply with regulations on hours and space, avoid causing noise, affecting the lives of people around. Ensure conditions for fire prevention, fighting and security, etc.

In addition, to ensure that state management of performing arts and copyright works is carried out in accordance with the provisions of law, the Department of Culture, Sports and Tourism of Lam Dong province proposes to review and synthesize the list and send it to the Department for synthesis; at the same time, advise the People's Committees of districts and cities to direct and coordinate relevant departments and offices to implement tasks according to their decentralized authority./.
