6th session: National Assembly votes to pass bills and resolutions

Continuing the 6th Session, on the morning of November 28, at the National Assembly House, under the chairmanship of National Assembly Chairman Vuong Dinh Hue, the National Assembly listened to the presentation of the report explaining, accepting, and revising the draft Law on Real Estate Business (amended) and voted to pass this law. As a result of the vote, with 465 delegates participating in the vote in favor, the National Assembly officially passed the Law on Real Estate Business (amended). The passed draft Law has 10 chapters and 82 articles regulating real estate business, the rights and obligations of organizations and individuals in real estate business and state management of real estate business. The Law takes effect from January 1, 2025.

Next, Vice Chairman of the National Assembly Nguyen Duc Hai chaired the discussion session on the draft Law amending and supplementing a number of articles of the Law on Property Auction. 26 delegates spoke, 1 delegate debated, expressing a unified view on the necessity of developing the draft Law and the content of many articles and clauses in the draft Law to institutionalize the Party's viewpoints and policies on perfecting the legal system, building a socialist-oriented market economy, and at the same time overcoming current negative limitations in the field of property auction, ensuring publicity, transparency and soundness. Opinions also suggested continuing to review to fully institutionalize the Party's policies, ensuring that the provisions of the law are consistent with the Constitution, consistent and synchronous in the legal system, and compatible with international treaties. In addition, delegates also participated in a number of specific contents such as: Scope, level of amendment of the Law, scope of regulation of the Law to avoid duplication with specialized laws; Explaining terms, concepts, regulations on auctioned assets, prohibited acts, registration for auction participation, pre-deposits and handling of pre-deposits, forms of auction, rights and obligations of auction property owners and auction winners, handling cases in auctions, preventing negative phenomena in auctions...

At the beginning of the afternoon session, after listening to the Report on explanation, acceptance and revision of the draft Resolution on piloting a number of specific mechanisms and policies on investment in construction of road traffic works, the National Assembly voted to pass the Resolution. As a result, with 464 delegates participating in the vote in favor (accounting for 93.93%), the National Assembly officially passed the Resolution on piloting a number of specific mechanisms and policies on investment in construction of road traffic works.

The Resolution takes effect from the date of approval and is implemented until June 30, 2025, regulating the piloting of a number of specific policies on investment in road construction for the projects listed in the Appendix attached to the Resolution. The regulation allows the proportion of state capital participating in investment projects under the public-private partnership method to exceed 50% of the total investment for 2 projects as prescribed in Appendix I attached to this Resolution.

Continuing the session, the National Assembly listened to the Report on explanation, acceptance and revision of the draft Law on Forces participating in protecting security and order at the grassroots level and voted to pass the Law with 386 delegates participating in the vote in favor, accounting for 78.14%. The passed draft Law has 5 chapters and 33 articles, stipulating the position, functions, tasks, principles of organization, operation, working relations, force building, ensuring operating conditions and responsibilities of agencies and organizations towards the forces participating in protecting security and order at the grassroots level. The Law takes effect from July 1, 2024. The Ordinance on Commune Police No. 06/2008/PL-UBTVQH12 ceases to be effective from the effective date of this Law.

Next, the National Assembly discussed the draft Law on Defense Industry, Security and Industrial Mobilization. Vice Chairman of the National Assembly Tran Quang Phuong chaired the session. Delegates focused on discussing the specific contents of the draft Law such as: Scope of regulation, consistency in the legal system; truly unique breakthrough policy mechanisms to concentrate resources for the development of defense industry and industrial mobilization; on the interpretation of terms; on the relationship between defense industry, security industry and industrial mobilization; on the system of defense and security industry organizations; on the policy regime in defense and security industry...
